AGP~EMENTTO PURCHASE TAX-DEEDED LfuND Agreement It was moved by Councilman Robblns, seconded by Councilman Burry, to Purchase and unanimously adopted to authorize the purchase by the City of a Tax-Deeded parcel of real property on Quito Road from the County for a stipulated Land purchase price of III PETITIONS, ORDINANCES & FORMAL RESOLUTIONS A. Franchise Enabling Ordinance ~38.12 and su~rized the contents of the Franchise Ordinance, and in view of the changes that had been made since its Enabling original introduction, the Mayor ordered that Ordinance 38.12 be re- Ord. introduced as ~m~uded. B. RESOLUTION ~341 Res.341 Correct-. It was moved by Councilman Robbins, seconded by Mr.Burry .and un~aimo~ly ing Tech- carried 'to adopt Resolution ~341 correcting a technical error in the nical Error description of two parcels in the Chester Avenue Improvement Project. C. ORDINANCE NS-5.14 Amendment The City Administrator presented the Ordinance constituting an to Sub- mant of the Subdivision Ordiuance to require underground public utilities div. Ord. in subdivisions within the City of Saratoga. He also presented a letter requiring dated September 21, 1966, from Mr. Ornellas,of the Builders Association, Underground with a cuggested form of Underground Utilities Ordinance attached thereto. Utilities After discussion of the changes in the Ordinance as suggested by the Builders Association, and with the agreement of the rest of the Council- men, the Mayor ordered Ordinance NS-5.14 be introduced as modified by paragraphs (1), (2) and (3) of the proposed form of the Ordinance as submitted by the Builders Association. IV SUBDIVISIONS, BUILDING SITES AND ZONING REQUESTS A Tract 4200 - Underground utilities Tract 4200 The City Administrator read the recommendation of the Planning Committee Waiver dated September 20~ 1966, and it was moved by Councilman Burry, seconded denied. by Councilman Robbins, and unanimously approved to deny the request for waiver of underground utilities in Tract 4200. B SDR-593 - Ralston Johnson SDR-593 It was moved by Councilman Burry~ seconded by Councilman Robbins, and Waiver unanimously adopted to approve the Planning Commission's report of denied September 20, 1966, and to deny the request for waiver of the under- ground utilities requirement for SDR-593. C A-1G2, Robert Neale - Release of Bond A-102 Release It was moved by Councilman Robbins~ seconded by Councilman Burry and of Bond unanimously adopted to authorize release of the $1000 bond posted by Robert Neale to guarantee compliance with the design review require- ments of A-102. D SDR-656 ~ Donald Miller SDR-656,1 It was moved by Councilman Burry, seconded by Councilman Robbins, and Site unanimously approved to adopt Resolution ~SDR-656-1 granting site Approval approval to DDnald Miller for one lot site on Cody Lane, subject to receipt of the recorded Record of Survey, and the required Offer of Dedication on Vickery Avenue. -2° V PUBLIC HEARINGS - 8:00 P.M. FINANCE (1) Payment of Claims It was moved by Councilm~n Burry, seconded by Councilman Robbins Bills and unanimously carried to approve disbursements on the report dated September 21, 1966, and authorize that warrants be dra~rn in payment for a total amount of $11,799.36. (2) Cit~ Clerk The City Clerk's financial Report and the Treasurer's Report for the month of August, 1966, were accepted and ordered filed. C. COUNCIL COMMITTEES No reports D. City Administrator presented written conuunications and the Request for Mayor directed that Mrs. Stoner's request of September 17, 1966, Traffic wi~h~e~rd to a traffic signal at Quito Road and McCoy Avenue Signal be referred to the Public Welfare Connnittee for study and recom- mendation. B. O~cal Clarifi- cation of (1) Mr. Charles Murphy requested and received clarification of the C.A.T.V. provision of the proposed G.A.T.V. Ordinance restricting the Ordinance franchisee from engaging in the sale and repair of television sets. (2) There being no further oral communications, Mayor Tyler acknowledged Visitors with pleasure the presence of Mr. O. W. Johnson, Planning Commis- sioner, !"Mr. Charles Smith and Mrs. Dorothy Parker of the Good Government Group, and Mr. Stewart Howell and Don Bush of Saratoga Chamber of Commerce.
