Absent: None B. ~TES It was moved by Councilman Robbins, seconded by Councilman B~, and unani- mously Carried~ to waive the ?ea~ng of the April 19, 1967 minutes and approve them as ~itten. H~f explained Ordinance 15-j is an ordinance establishing the sai~y of Ord the City Administrator introduced at the last meeting. Motion by Councilman i5-J Burry for adoption of O~dinsce 15-J; seconded by Councilman H~tman; motion c~ried unanimously and so ordered. B. O~Ii~I~CE NS-3-ZC-37 - SECOND ~ING The City Administrator stated that Ordinance NS-3-ZC-37 fezones an area at Ord Cox and Cumberland Drive from A to R-1-12,500; that a public he~ing was held NS-3- . at the last meeting and this is the appropriate time for adoption o~~ this ZC-37 ordinance~ since it is in accord with the Gener~ Plan. Councilman Robbins moved; seconded by Councilman Burry~ for adoption of 0r~nance NS-3-ZC-D7~ motion c~ried unanimously. C ~ ES0LUTION NO. 356 ~. Huff explained that a transfer of funds between the General Fund Un~lo- Res. cated Reserve and the Land Acquisiticn ~d Improvement Fund is necessary 3.~6 because ?egular pa~ent is due on Hakone G~dens land p~chase~ Since one property o~er was paid in advance~ the budget allotment is depleted. Coun~ cilman B~ry moved; seconded by Councilman Robbins; to authorize Resolution 356, a transfer of funds in the amount of $25,000; motion c~ried unanimously. D. ~SOLUTION NO. 40-~ M~. Huff reported 'that~ at termination of William Hanley~ the City Attorney Res. had been authorized to accept ~d consent to deeds and ~ants f~ the City 40~ of Saratoga~ and Resolution 40-5 supersedes the ~revious authorization and conveys it to t~e new City Clerk. Councilms P.~%man moved for adoption of Resolution 40-5 ~ seconded by Councilman ~yler; motion c~ried un~imously and so ordered. E. ~SOLD~ION NO. 357 M~~. ttuff explained that Resol'~ion 3TQ- 357 opposes payment of compensation Res. for removal of certain outdoor advertising signs, displays and devices~ and 357 the League of California Cities ~s requesting endorsement of this opposition in the form of a resolution to be forw~ded to Confessmen ~d Senatoi's from California. SDR-675 - CAv~BELL ~ION I~GH SCHOOL DISTRICT ~. Huff presented maps to the Council for Campbell Union Hi~j~, Schco! Dis-- trict's request for conditional site approval on Prospect Roa~. He said the SchOol District f~ther requested certain modifications to Conditions IIJ and IIK in the Bulldog Site ~ommittee Report dated M~ch 13~ 1967. W~E HO~R, 1541 The A!ameda~ San Jose~ appe~ed to represent the High School District as a business consultant~ He referred to their letter Res~ to the City dated April ~7~ 1967~ outlining ~ternatlves to %he c~nditions SDR- as required~ ~. Hover stated that the School District is ~.~thout funds to 67~-1 comply with Condition II-B~ to pro~de for ~ 60 foot half-street ~d would Camp- be able to pave only ~ 20 foot portion of Prospect Road. Heft; archetect, explained that the ~ea is already five acres under recomended State Board of Education site area, he indicated that facilities have been made as compact as possible for best use of the available l~d. City Attorney Faber Johnston opined that government code authority im ~hich school districts. could overrule Council decisions would not apply in this building site approval; since it is covered by t~ subdivision o~dinanee and not the zoning ~dinance. Cby (4) The Mayor gave an account of the forma. tion of a Planning Policy Commi'btee Planning for Santa Clara Connty with representatives from 15 cities and the Boerd Policy of Supervisors. Mayor Glennon has been elected Charman by the group~ Cte~ with Jerry Kasnsr~ Planning Commissioner~ also representing Saratoga~ B ~ FIN~CE (1) M~tion by Co,~acilman Robbins; seconded by Councilman Hartman and carried Claims unanimously to approve the list of disb~sements dated May 3, 1967, ~ld authorize that w~rants be ~a~m in pa~ent for a total smo~t of $55,471.22. COUEIL COET~ES ~ EPORTS (1) Councilm~ Tyler read a report dated ~y 3, 1967 recommending deni~ of SDR-670 requezt for modification of 'Condition II-J, SDR-670~ by DoUglas Hines. Hines Motion by Councilm~ ?yler; seconded by Councilman H~tman~ to adopt the hblic Welf~e Cq~ttee report dated May 3~ 1967~ denying request for modification of Condition II~,J, SDR-.670; motion c~ried unanimously. (2) Councilman '~bi~g read a repo~ of the Policy Comittee dated ~y 3, 1967 concerning a ~q~st for lighting of intersections at Horshoe Drive and Horseshoe Highway 9~ reco~ending that other methods of reducing the hazed at the & H~ 9 intersections be investigated. Mayor Glennon directed ~. Eads to refer Lights this matter to the Citizens' General Plan Comettee for stu~ and recom- mendation. Stu Howell, Chamber of Comeroe, offered that an approximate cost for street li~ts is $425-$435 per ~it, .completely installed and in ope r at i on. DEP~TENT i~8 ~ OFFICERS (1) Following recommendation by the Director of Pnblic Works, Councilman Argonaut H~tman moved for an extension to ~ 24~ 1967; to the Copenhaver Construction Co. contract for reconstruction of gutter flo~'line on ~gonaut Drive; s~ecomded by Councilm~ ~ler; c~ried unanimcusly. '~i COEECA~0NS A ~ ~ITT~ (1) Mayor Glennon acknowledged receipt of letters from Dr~ Wilbur Kellum regarding his rsce~ ~esignation from the Pi~ming Commission~ and the West V~ley Junior College resolution exte~f~ing congratulations to B~. tluff on his appointment as City Clerk-Ad~nistrator. (2) Mayor Glennon referred a requiem;st from the Saratoga Chamber of Comeroe to serve beer at the annual Feetill to be held in Wildwood Park on September 14~25 to the Policy COmittee for study and report. (4) A letter from ~Lcso ~atherine Andersen~ leader of Girl Scout Troop 276 Girl in which ~he thanked tb.e Council for their gracious reception of the Scouts girls at the last meeting was read by Mayor Glennon. B ~ 0R~L COR~JNICATIONS (1) Mr~ Robert Minerall, Madrone Hill Road, appeared before the Council to represent residents of Piedmont Road in request.~ng that the standard fo~· this road be reduced to 26 feet inch~ding c.~?b and gutters, since p~'o~ perty owners in this area are un~.~il]ing to provide right of way for a 36 foot street on the basis that it will encourage excessive speed by persons leaving the Montalvo area. The Santa Clara County Parks and Recreation Department has agreed to include construction and maintenance costs of this road in their 1967~68 budget if necesss~7~ figures are Piedmont ceived in time. Road The City Attorney stated that no formal resolutions or ordinances are necessary if a study by the Director of Public Works deems the reduction in standards advisable under the circumstsn~!es~ This road is no~ private but is used by patrons of Montalvo srea~ a County park: and the proposal is for dedication as a public street when brought up to standard. FKq. WADE HOVER appeared as counsel for the residents of Piedmont Road. M~. PETE PASETTA: Saratoga-Los Gatos Highway: spoke in favor of the reduction so that the residents of Piedmont Road can shed the responsi- bility for its maintenance° Councilman Robbins moved~ seconded by Councilm~m~ Burry~ to authorize the Director of Public Works to permit deviations from present standards~ upon recommendation of the Public Welfare Co~mnittee; motion c~rried unanimously. (2) Stusa~t Howell of the Chamber of Co,~mnerce requested permission from the Council for serving of champagne at a ~eception in the Council Chambers preceding the 'S~ratogan of the Year~ ceremonies on May 15: 1967. The City Administrator was directed to cheek the Council Chambers use policy for a decision° M~yor Glennon acknowledged tb~ attendance of Dr. Theodore Norton as Planning Commission representative: and the p~esence of University ~f Sant~ Clara studentsS and extended thanks to Mrs. Stark and Mro Wilberding of the Good Government Group for ~erving coffee following the meeting.
