ROLL CALL Present: Councilmen Glennon, Hartm~n, Tyler, Burry, Robbins Absent: None B. MI~lJTES It was moved by Councilman Burry; seconded by Councilman Tyler; to waive Minutes the reading of the minutes of May 3, 1967 and approve them subject to corrections...Page 2, IV-B, paragraph ~, line 5#change 'requirements' to ' recommended', and Page 3, IV-C(2)...insert Robbins for Hartman re Policy Committee report; motion carried unanimously. II BIDS ~ND C0N~IRACTS A. FRUITVALE AVENUE PLAN LINE M~. Huff presented the proposed agreement for preparation of plan lines for Fruitvale Avenue. He said the Public Welfare Committee had[ reviewed the Fruitvale proposal and recommended that the City retain Jennings, McDermott &Heiss Ave Plan for the engineering services. The cost is based on time and materials ' Lines with a ceiling of $3,000 plus 10~ overrun with approval of the Council. Councilman Hartman moved; seconded by Councilm~n Tyler; to authorize the Mayor to execute an agreement between the City and Jennings, McDermott and Heiss for engineering services for plan lines on Fruitvale Avenue, subject to the final approval of the City Attorney; motion carried unanimously. TRAFFIC SIGNAL ~AII~TENANCE - COX AND SARATOGA A~NFE The City Administrator explained that upon completion of the Saratoga Avenue construction, the County had asstamed maintenance of the traffic signal at Cox & Cox and Saratoga Avenues~ since it was on the stretch of road the City had Saratoga released to allow use of expressway funds. The City has been notified that Signal as of May 15th~ there wilt be a charge of approximately $50 per month per intersection to continue County maintenance. Mro Huff recommended this as the most feasible method of maintenance, since it is the ohly traffic sig- nal under City Jurisdiction. Councilman Hartman moved that the ~'~vor be authorized to execute an agreement with the County of Santa Clara fo~ maintenance of the traffic signal st Cox and Saratoga Avenues, subject to final approval by the City Attorney; seconded by Councilmen Robbins; unan- imously carried and so ordered. III PETITIONS, ORDINANCES AND FORMAL RESOLUTIONS A. O~DINANCE 38.16 - INTRODUCTION M~. H~f read Ordinance 38.16, an ordinance relating to weed and rubbish abatement. After discussion of details in the ordinance by the Council, Mayor Glennon declared Ordinance 38.16 introduced on the first ~eading, 0rd. and referred it to the Public Welfare Committee for study and recommendation. 38.16 The committee was directed to confer with the Fire Marshal to determine the distance from any building or structure within which dangerous materials would be deemed to create a violation (Page 1~ Sec~ 6.52, line ]~). B. RESOLUTION NO. 357 Mr. Huff said this is a resolution opposing payment of compensation for removal of certain outdoor advertising signs, displays and devices. It was Res. presented at the last Council meeting but deferred to this meeting for a 3~7 decision after study. The consensus e~ among the Councilmen was that a better effect would result in individual letters being written to Congress and the Senate by .the Council~n on this subject° Without Mayor Glennon ordered the matter removed from the agerids= SU]~ARY OF MINUTES, SARATOGA CITY COUNCIL, MAY 17, 1967 Pg 2 Ill C. ~ESOLUTION NO. MV-1t Mr. Ruff reported that Resolution MV-11~ creating a two-hour parking zone Eeso on a portion of Big Basin Way from 4th to 5th Street~ resulted from request ~-ll of the Chamber of Commerce and recommendation of the Chief of Police end the Public Welfare Committee. Co~mcilman Hartman moved for adoption of Resolution MV-11; seconded by Councilman Tyler; motion carried unanimously. C. RESOLUTION 36~B-91 The City Administrator explained that the developer had corrected or the Res. bonding company had paid for all deficiencies in the streets in Tract 3~85. 36-B-91 The streets have been maintained for one year and it is now recommended that they be accepted for maintenance and the bond released by the City. Coun- cilman Hartms moved for adoption of Resolution 36;B-91; seconded by Coun- cilman Tyler; motion carried unanimously and so ordered. IV Sb~DIVISIONS, BUII=DING SITES AND ZONING RE~/ESTS A. SDR-687 - RICE BECK Maps for final building site approval for SDR-687, Richard Beck, one lot 8DR.-687 on Carniel Avenue were presented to the Council. ~. Huff explained that Beck since the existing subdivision had been approved more than ten years ago, it is necessary that Mr. Beck apply for site approval on one lot. All con- ditions have been met except flood control clearance# and he recommend,ed approval. Councilman Tyler moved for adoption of Resolution SDR-687-1j subject to flood control clearance; seconded by Councilman Hartman anc~ un- animously carried. B. TRACT ~79 - COLUMBUS FOUNDERS SAVINGS - SD-613 Maps for final approval of 15 lots on Wardell Road, Tract 4279, Unit I'~ for Columbus Founders Savings A~sociation were presented to the CounciL1. ~/a~. Huff reported thsb all conditions had been met except design const~Euc- Tr 4279 tion and an offer to dedicate an 18 foot minimum access road through U~it I SD-613 of the Columbus Founders property and across the ColumbUs property to t'~he Columbus existing minimum access road off Pierce. A report from the Planning DiLrec- Founders tot ~ated March 13~ 1967, recommended that Condition 6 on the Subdivisi~on Savings Committee Report dated February 28, 1967, be modified to not require imi.prove- ment of the private extension of Wardell Road~ since the applicant does not have right of way on said road. TOM TRAYNOR~ 22284 DeAnza Circle~ North~ Cupertino~ represented the app]ii- cant and requested modification of Conditions 6 and 12. After Council discussion, Councilman Hartman moved; seconded by Councilman Tyler; fo~. adoption of Resolution SD-613-1 approval of final map of Tract 4279, SD-613~ subject to dedication of those portions of Wardell Road running through Lots i through 10~ as a 25 foot half street from the centerline; and dedication and improvement of that portion of Wardell Road contiguous to Lots i and 15; and subject to compliance with Condition 12; motion carried unanimously. C. TRACT 4300 - SARATOGA F0~HILLS DEVELOPMENTCORPORATION - SD-672 ~. LEROY HIATT explained to the Council that the Tr 3591 oak tree on the access road to the highway would not create a traffic haz- Hi~tt srd since only a right turn is possible at that point. Councilman Hartman moved for adoption of Resolution SD-682-1~ subject to filing of record map and necessary deed and clearance letters; seconded by Councilman Burry; unanimously carried. E. TRACT l~042 - CLAUDE T. LI~SEY - SD-68~ Mrs Huff explained that this is the fifth unit of Claude Lindsey's subdivi~ sion and consists of 53.lots north of Cox Avenue between Fredericksburg Tr ~04~ and the railroad, and stated that all conditions have been met° Council- Li~dsey man Robbins moved for adoption of Resolution SD-684-1; seconded by Council- man Burry; motion carried unanimously and so ordered. F. DOUGLAS HIES - SDR-670 Maps for final approval of one lot on Sobey Road for Douglas Hines were presented. to the Council. ~. IIuff explained th~b all conditions had been SDR-670 met except payment of inspection and storm drain fees and posting of a Hines bond for Condition II-J on the Building Site Committee Report dated Febr- uary 14~ 1967. Councilman Tyler moved for adoption of Resolution SDR-670-1: subject to posting of required bond and payment of inspection and flood control fees; seconded by CoUncilman Hartman; motion eartied unanimously° G. SDR-673 - CHURCH OF JESUS CHRIST OF LATTER DAY SAINTS - ALLENDALE AVENUE M~. Walker reported that the Church of Jesus Christ of Latter Day Saints has provided compliance with all the conditions impDeed in the Building SDR-673 Site Committee Report dated February 1~ 1967 except posting of a bond for Latter improvement of Allendale Avenue. The delay is due to substantial revision Day of their improvement plans, necessitating approval by the State and County~ Saints which has not been secured to date. Mr. Walker read a letter from Bishop Church Nelson~ assuring the Council that the necessary bond willbe posted for Condition II-B~ C~ D~ H and K, as soon as the amount is determined. Motion by Councilman Tyler adopting ReSolution SDR-673-1, subject to Dosting of required bond; seconded by Councilman Hartman; motion carried~ V PUBLIC HEARINGS A. C-lOS - GEORGE W. DAY CONSTRUCTION CO. Mr. Huff explained that C-105 ~s a re~sst for fezcuing from R-1-40, O00 to R-1-20,000 on Allendale Avenue by George W. Day. The Planning Commission recomnends the change of zoning and the p~slic hearing was noticed for this time. A communication supporting this change of zoning was received from Mr. and Mrs. A. L. Hanson, 13761 Dolphin Drive, Saratoga. The maps for the proposed rezoning were presented to the Council° Mayor Glennon declared C-105 the public hearing on C-105 opened at 9:R~ PoM. and directed that all files Gas Day be introduced into the record. Ord. NESTOR BARRETT, 675 North let Street, San Jose, appeared to represent the MS-3- applicant and explained he had represented George Day before the Planning ZC-38 Commission in this matter and had received their approval.. A. Lo F~tNSON~ 13761 Dolphin Drive, Saratoga, spoke in favor of the rezoning and also ad-. vocated further rezoning of low density areas so they could be subdivided~ ~;~. Walke~ stated that the Planning Commission approved only fezcuing of lots bet~.reen Pottoe and Harleigh and other marked areas on Exhibit A on Allendale Avenue were not to be included in the change of zoning° P~olic hearing was closed st 9~35 P~Mo on motion of Councilman Hartman; seconded by Councilman B'~ry and uaanimously carried. FINANCE (1) It was moved by Councilmen Burry; seconded by Councilman Robbins; and unanimously carried to approve the list of disbursements dated Claims May 17, 1967 and authorize that warrents be drawn in paplnent for a total of $20~325.01. (2)Financial reports of the Treasurer and City Clerk for April~ 1967, were accepted by the Council. C. COUNCIL COMMI'ATE~S ~NDREPORTS (1) Councilman Tyler transmitted the Public Welfare recommendations to hire Petersen Brothers to surface a portion of Chester Avenue. Coun- Chester citmanTyler moved; seconded by Councilmen Hartman; to adopt the Public Ave Welfare Committee report dated May 17, 1967 and hire Petersen Bros. Surfacing to surface Chester Avenue from Allendale Avenue to 825 ft. south at a cost of $1,650, for reshaping the existing road, priming and apply- ing a double seal coat of oil and screenings; motion carried unanimoust~vo ADS Plas- (2) Councilman Tyler moved; seconded by Councilman Hartman, to approve use tie pipe of ABS plastic pipe for sewer laterals only; motion carried unanimously. (3) Councilman Hartman moved; seconded by Councilman Burry; to accept the Public Welfare Report dated May ll, 1967 concerning construction of Piedmont Piedmont Road, subject to the conditions set forth by the staff, and Road indicating willingness of theeCity to accept the Street upon construc- tion to proper Standards; motion carried unanimously~ (4) Action on approval of Hakone Gardens kitchen improvements as outlined Hakone in the Policy Con~littee Report dated May 17~ 1967 was deferred bythe Gardens Mayor until the lease with the Florence Crittenton Circle is reviewed. (5) Councilman Robbins read the report of the Policy Committee dated May 17, 1967 recommending prohibition of alcoholic beverages on all City property. Alcoholic STUART HOWELL, representing the Chamber of Commerce, and M~S. TOY, Beverages representing the Los Gatos-Saratoga Symphony Association and on City JOE ASSENZA, spoke to the Council advocating serving of alcoholic property beverages on City property on the basis that local functions would suffer economically if such use is prohibited. The Chamber of Commerce plans to sell beer at the forthcoming AnnualFestival in Wildwood Park in September; and the Symphony Association has already made plans for a champagne reception in the Council Chambers on July8th. Mayor Glennon deferred a decision on this matter for the present, dir- ecting that any permits for serving of alcoholic beverages on City property be s~ject to Council approval~ and instructed the staff to initiate a study of the policies of other cities. D. DEP~TMENTHEADS A~ OFFICERS (1) The Planning Director announced that the Citizens' Committee on the General General Plan Review was meeting each week ~ the Redwood School, ~th Plan Review good attendance, and reported that wcrk x~as progressing satisfactorily. E. Q~Y ADMINISTRATOR (1) Mr. Huff read a letter from Ro Go Eastman requesting a one year's ex- SDR-623 tension for improvement& zequired on Allendale Avenue. He stated that Eastman adverse weather had postponed work this winter and he now would like to hire the contractor working on adjacent property to make his improve~ monte. Motion by Councilman Hartman granting one yesa~'s extention to R. G. Eastman, 8DR-623~ seconded by Councilman Burry; motion carried unanimously. SU~'~RY OF MINUTES, S~RATOGA CITY COUNCIL; MAY 17, 1967 Pg 5 VII CONMUNICATION8 Ao WRITTEN (1) Mayor Glennon read a letter and resolution from the Good Government Good Group supporting the Council and staff in their efforts to enforce ' Govt Group City ordinances, in particular, tile sign ordinance, and to correct violations thereof. (2) Mr. Huff read a note of appreciation from the Senbr Civics Class of Saratoga High School for the reception given them by the Council at the last meeting. League (3) A letter from the League of Women Voters of LoS Gatos-Saratoga was of Voters referred to the Citizens' Committee for the General Plan Review by '..~ Mayor Glennon. B. ORAL (1) STUART IiO~LL, read a letter from the Saratoga Chamber of Commerce announcing a presentation on May 25th at the Council Chambers by EG&E, outlining a Congress for Community Pro~ams. (2) JOE ASSENZA requested the Council to study the traffic hazard created Saratoga by poorly marked curbing on the divider strip on Saratoga Avenue, and A~e suggested the staff or Council visit Sacramento to observe the refle~ Divider tor lighted center divider strips installed there. Mr. Huff reported that the staff was working on an estimate of cost for such installati on. Mayor Glennon acknowledged the presence of Stuart Howell, Seratoga Chsnber of Commerce; Dr. Warren Sturla, Youth Center, Inco; and thanked the Good Govern- ment Group and Mrs. Dorothy Parker for the serving of coffee.
