Mayor Robbins referred policy of city approval of Sanitation and Sanitary District assessment projects to the Policy Committee for study and recommendation. IV. PUBLIC HEARINGS A. C-133 - M.W. FRAZIER - SARATOGA AVENUE AND COX AVENUE - CONTINUED FROM 11-18-70 Mayor Robbins re-opened the Publi~ Hearing on C-133 at 8:05 P.M. Donald Tenenbaum, Attorney for the applicant stated that he had met with the Planning Committee of the City Council and that the applicant requests per- mission to amend his application for re-zoning to P-A, "Professional-Administrative' It was the applicant's rqquest that the matte~ remain at City Counci level rather than being referred back to the Planning Cormmission. .Mayor Robbins continued the Public Hearing, referred the matter to the Planning Con~nittee! of the Council with instructions to meet with the SubdivisiQn Committee of the Planning Commi.ssion to decide whether to hold the continued hearing before the Council December 16 or~to place the amended application on the next Planning Commission agenda. FredgStyles, 18990 Saratoga Glen Place, representing the Saratoga Homeowners Association stated that his Association ~s~not opposed to P-A zoning. Mayor Robbins instructed the PlanZing Director to notify all persons within 500' and representatives of each ~omeowners Association of the time and place of the~i~ti~LPublic Hearing pertaining to the amended application. B. C-136 - CAL WEST COMMUNITIES, INC. - SARATOGA AVENUE - REQUEST FOR CHANGE OF ZONING FROM "A" (AGRICULTURAL),TO "R-M-3,000" (MIrLTI-FAMILY RESIDENTIAL) The City Manager reported that this Hearing had been noticed through publication in the newspaper and mailing of notices to people within 500'. The Planning CommiSsion recommends that this ap.plication be approved. Mayor Robbins opened the Public He'aring at 8:24 P.M. Alfred Dossa, attorney representing the applicant stated that this is an application for a change of zoning of a parcel consisting of 6.265 acres. The subject area is designated on the General Plan for multiple zoning. . Mayor Robbins continued the hearin~ to December 16 and referred C-126 to the Planning Committee for study and recommendation. C. ORDINANCE NO. NS-3.26 - AMENDING CRDINANCE NS-3, THE ZONING ORDINANCE, BY AMENDING ARTICLE 3 IN RELATION TO .MAXIMUM SIGN AREA ~OR MULTI-FAMILY DWELLINGS, MOTELS, HOTELS OR LODGING HOUSES The Ordinance was readlin full. Ppblic Hearing opened at 8:33 P.M. Mayor Robbins closed the Public He~ring at 8:33 P.M., continued the hearing to December 16 and referred Ordinance NS-3.26 to the Planning Committee for study and recommendation. D'~ BROOKGLEN DRIVE DISCUSSION Mayor Robbim acknowledged the presence of a number of people in the audience interested in the Brookglen Drive extension. - 2 - SARATOGA CITY COUNCIL MINUTES - DECEMBER 2, 1970 ~ CONTINUED The City Manager reported communications from the following expressing opposition to'the extension of Brookglen Drive to Cox Avenue; Mr. & Mrs. Larry Schnaid~, 12249 Brookglen Drive; Mrs. Va~rie Newhouse, 12235 Brookglen Drive; and Mr.~& Mrs. Rod Diridon, 18891 Greenbrook Court in the form of a petition with~286 signatures; Charles F. Lautrup, 18940 Fernbrook Court; Leonard A. Stemek, 12191 Mellowood Drive; Mr. & Mrs. C. Stuart McPherson, 12198 Titus Avenue; Carmen R. & William E. Estes, 12426 Woodslde Drive; Mr. Mrs. Kirby G. Hotlis, 12090 Country Squire Lane; Louis and Jean Law, 12522 'Pa~'~age Drive;Jerome L. Hall, 12470 Brook Glen~,Drive. Mayor Robbins stated that the Council!was familiar with this problem, having read the letters on file. He noted that there had been no opportunity to hear from the people living on Miller Avenue and it was necessary to allow time for adequate hearings. Rod Diridon, 18991=~'~n~"~d~,'-~Brookview spoke on behalf Of a large group in attendance oppol~"~8~e p~d extension. Pete Rose, representing Brown and Kauffmann, the developer felt the connection of Brookglen to Miller via Brockton would be more suitable. Howard Weatherholt, 18940 Lynbrook Court and Robert Parrish, 12i93 Brookglen also opposed the proposed extension. Mayor Robbins referred the matter to the staff and the Planning Committee for further study and recommendation. Jim Naugle, 12072 Ingrid Court, representing Prides Crossing Homeowners Association, stated his group would probably object~r~6~b~i~ Miller as the only exit to the south for 950~1000 homes.' VI. ADMINISTRATIVE MATTERS A. MAYOR 1. Mayor Robbins reported on his interesting discussion with Bill Cameron and Mark Buckley, the youth members of the Parks and Recreation Commission. 2. Mayor Robbins asked for approval for the City Manager and himself to attend a one day course in time management sponsored by the University of California, Santa Cruz at a cost of $25.00 each. Approved. 3. Mayor Robbins called for an Executive Session following the meeting for the purpose of discussing personnel matters. 4. Letter from Oskar T. Thurnherconcerning the planting on Prospect Road which is re-scheduled for December 12. B. FIN~_'~CE 1. Payment of Claims Approved list of disbursements dated December 2 and authorized the Mayor to sign the warrants. C. COUNCIL COMMISSION AND COMMITTEE REPORTS 1. Saratoga-Los Gatos Road Walkway kdopted the Management Con~nittee report of November 27 recommending expenditure of $850 to $1000 to hire a surveying firm to survey Saratoga-Los Gatos Road from Vickery Lane to the Village. 2. Law Enforcement in Commercial Areas Adopted the Public Welfare committee report of December 2, for participation with the mercBants in a two month resumption of night foot patrol service in the village; supplementary daytime foot patrol and parking patrol; and circulation of a letter to merchants offering to extend similar night foot - 3 - TOGA CITY COUNCIL MINUTES - DECEMBER 2, 1970 - CONTINUED patrol on a Cooperative basis.~'~' 3. Youth Center Study Adopted the Policy Conmittee repor~ of December 2, recommending that the subject of the Youth Center as it relates to the City'be referred to the Youth Commission for study. 4. Saratoga-Sunnyvale Road between Verde Vista and Blauer The Council adopted the Public Welfare committee report of November 30 Cit ' affirming the y s interest in the Highway 85 project and agreeing that the State Right-of-Way agents acquire the r/w at the City's cost. Mrs. Cabby Sitney reported a hazardous situation at Blauer Drive, where people are making unsafe U-turns on Saratoga-Sunnyvale Road after leaving the service station. Referred to staff. D. DEPARTMENT HEADS & OFFICERS 1. Annual Report Council reviewed suggestions for Annual Report. Favored newspaper format. 2. The City Attorney reported the Judgment finding the Council not in contempt in the Cocciardi case. 3. The Director of Public Works reported the storm just passed created minor problems but no significant damage. E. CITY MANAGER 1. Report from the Chief Bdilding Official recommending preparation of an ordinance approvipg the use of plastic pipe for drain w~ste and vent pipe. Mayor so direct~d~ 2. The City Manager =ecommended. that the official minutes of each meeting contain only a surmnary of items 'considered and actions taken except in accord with Section 2-17 (f) of the City Code. !Mayor Robbins directed preparing sunmary minutes on a trial basis. 3. The City Manager recommended that the city contribute $250.00 toward the cost of lighting the field and basketball courts at R&dwood School as requested by the Youth Center. Approved, subject to approval of the Management Committee. VII. COMMUNICATIONS A. WRITTEN 1. Letter fromMrs. Kent C. Croft, 20626 Ritanna Court re Miljevich property. Mr. droft was present. The Planning Director and the City Attorney are checking up on any violations which%may be in evidence on the property a~d will pursue this problem. 2. Letter from Theodore L. Shebs opposing the widening of FruitvaleAvenue to four lanes. Mr. Shebs also outlined his views orally. 3. ~etter from Gary V. Kirk opposing designation of Fruitvale as 4 lane road. 4. Modesto City Council Resolution No. 70-1148 urging action to alleviate the problem of litter and waste disposa% created by the sale of beverages in disposable, non-returnable containers. VIII.
