PLACE: SARATOGA CITY COUNCIL CHAMBERS, 13777 FRUITVALE AVENUE, SARATOGA, CALIFORNIA TYPE: REGULAR MEETING I. ORGANIZATION A. ROLL CALL Meeting called to order at 7:~5 P,M. All Councilmen present. Mayor welcomed the Civics Class from Saratoga High School. B. Minutes of January 6, 1971, approved as distributed. C. APPOINTMENT OF PLANNING COMMISSIONERS Mayor Robbins appointed Roderick V. Fagan to fill the unexpired term of Planning Commissioner Crisp to January, 1973; Gerald Stan Marshall to January, 1975; and Charles Smith to January, 1975. Appointments approved by Council 4-1. Councilman Smith abstained feeling Council should delay the appointment until a qualified woman can be found to serve on the Planning Commission. Resolution No. 557 recognizing distinguished service rendered to the City by Dr. iTheodo~e M.~on ~dopted unanimously. D. SPECIAL PRESENTATION BY MARY C. DAVEY Mary C. Davey and Tom Brown presented a proposal for a Mid-Peninsula Park and Open Space District ~nd asked for Council endorsement. Without objection, this matter was referred to the Planning Committee for report back at the next meeting. E. PRESENTATION BY REFERENDUM COMMITTEE Resolution No. 556 adopted accepting donation from Prospect Road Widening and Beautification Referendum Fund presented by Mrs. Alice Rawak for use on widening and beautification of Prospect Road. II. BIDS & CONTRACTS PURCHASE OF A) ONE CAR AND B) TWO PICK-UP TRUCKS Without objection referred to Management committee and continued to February 3, 1971. B. AGREEMENT WITH SANTA CLARA COUNTY FOR LABORATORY TESTING AND FIELD INSPECTION ~ CONTINUED FROM 1-6-71 Without objection, continued to February 3, 1971 meeting. C. AGREEMENT WITH SANTA CLARA COUNTY FLOOD CONTROL AND WATER DISTRICT FOR CONSTRUCTION OF WALKWAY ALONG SARATOGA CREEK ADJACENT TO CAL-WEST DEVELOPMENT. Without objection, referred to Planning and Management Committees for report, if they so desire. III. PETITIONS, ORDINANCES AND FORMAL RESOLUTIONS A. MENDENHALL - MT~ EDEN ROAD - REQUEST FORiRECONSIDERATION OF CONDITION Without objection, referred to the~Planning Committee and continued to February 3, 1971. ~ V. PUBLIC HEARINGS A. C-134 - VAN HOAG - SARATOGA AVENUE'- CONTINUED FROM 1-6-71 - REQUEST FOR CHANGE OF ZONING FROM "R-i-10,OOO"~(SINGLE-FAMILY RESIDENTIAL) TO "R-i-iO,000 P-C" (SINGLE-FAMILY RESIDENTIAL PL~.NNED COMMUNITY) Public Hearing opened at 8:52 P.M. Alfred Dossa, Attorney for the applicant stated that they must stand on the proposal already submitted for 73 Units. Salvadore Falcone, owner of part of the property; Edward LaCreix, of Pike Road; and Miles Rankin,. Realtor, spoke in favor of the rezoning. Public Hearing closed at 9:15 P.M. Council voted unanimously to deny rezoning without prejudice. B. SARATOGA GENERAL PLAN - RETIREMENT HOUSING - CONTINUED FROM 1-6-71 Public Hearing opened at 9:23 P.M., closed at 9:24 P.M. and continued to February 3, 1971. C. ORDINANCE NO. NS-3-27 - CONTINUED FROM 1-6-71 - PUBLIC HEARING ON AjMENDNDENT OF ORDINANCE NS-3- TO PROHIBIT THE USE OF MOTOR VEHICLES FOR ADVERTISING PURPOSES Public Hearing opened at 9:24 P.M. There were no conments from the audience. 'Public Hearin~ closed at 9:25 P.M. Ordinance No. NS-3-27 adopted prohibiting the use of motor vehicles for advertising purposes. D. SDR-876 - JOSEPH NEVILLE - CONTINUED FROM 1-6-71 - APPEAL FROM PLANNING COMMISSION DENIAL OF TENTATIVE MAP APPROVAL Public H~aring opened at 9:26 P.M. There,were no comments from the audience. Public Hearing closed at 9:27 P.M. Staff directed to forward a copy of the Committee report to Mr. Neville. E. REQUEST FOR CITY TO DESIGNATE PORTION OF PAUL MASSON VINEYARDS PROPERTY AS AN AGRICULTURAL PRESERVE Policy Committee report of 15 January 1971 adopted. It was the consensus of the Council that the Planning Commission should review requests for establishment of Agricultural Preserves, and that the staff should review economic implications. -2 - °SARATOGA CITY COUNCIL - SUMMARY ~ MINUTES - JANUARY 20, 1971 Public Hearing opened at 9:37 P.M. Ralph Sackerman, Assistant Treasurer, Paul Masson Wineries stated that this application was being made in connection with an application to the Santa Clara County to establish the entire Paul Masson hill top property/as an agricultural preserve - a total of 575 acres. County hearing is scheduled for February 26. He also agreed to investigate the possibility of establishing hiking trails through the property. Public Rearing closed for the evening at 9:40 P.M. and continued to February 3, 1971. Referred to Planning Commission for recommendation on establishment of agricultural preserve and to staff for report on economic implications. F.I REQUEST FOR CITY TO DESIGNATE PORTION OF MARIDON AND TORRE PROPERTIES AS AN AGRICULTURAL PRESERVE Public Hearing opened at 9:43 P.M.,.closed at 9:44 P.M., continued to February 3, 1971 and referred to the Planning Commission for recommendation re establishing preserve; to staff re economic impact. VI. ADMINISTRATIVE MATTERS A. MAYOR 1. Moved for approval of $25.00 gift certificate in honor of Mary Lou?'Tex" Gebhard's retirement. Motion carried unanimously. '2. Announced ABAG proposed budget with 7% increase co~ering 3 additional ?'~ positions, City Manager to contact Mayor James asking him to advise executive committee of Saratoga's opposition to proposed increase in view ofcurrent economic situation; and requesting clarification of purpose of increase. B. FINANCE 1. Payment of Claims Approved list of disbursements dated Janu~ ry 20, 1971 and authorized Mayor to sign the warrants. 2,3. City Clerk's Financial Report and Treasurer's Report noted and filed. C. COUNCIL COMMITTEE AND COMMISSION REPORTS t. Youth Commission Report on lowering the voting age to 18 at State and Local level taken under advisement by the Council. Parks & Recreation Commission Proposed Procedure for ~aster Plan Development approved. 3. Parks & Recreation Commission Proposed Master Plan for Trails and Pathways referred to Planning Commission for consideration in 1971 General Plan Review. 4. Policy Committee report on Admiral Frederick G. Crisp memorial approved designating large conference room as the Crisp Conference Room. 5. Planning Connnittee report recommending against establishemnt of Pike l-7~Road-Saratoga Hills Road pathway given by Mr. Smith. Edward LaC.~oix of the Pike Road AssOciation and Mr. & Mrs. William Kruse spoke in favor of the pathway. ~'Stanford Attwood spoke against the path. Council approved report. 6, Planning Committee report on Wildwood Park Debris Basin noted and filed. Policy Committee report on Tenure: on City Commissions approved establishing 2 term limit with 10 year maximum for Planning Commission and 3 term limit with 7 year maximum for Parks & Recreation Commission. 8. Public Welfare Committee report on Via Monte Entrance approvide providing for soil sterilization, installation of 2 faucets and removal of fountain machinery. 9. Public Welfare Committee report recommending that Cox Lan~ ~ma{n closed approved. 10. Public Welfare Committee report recommending installation of reflective markers on Prospect Road approved. D. DEPARTMENT HEADS & OFFICERS 1. Planning Director authorized to arrange for codification of the Subdivision and Zoning Ordinances at a cost of $1,914.00. E. CITY MANAGER 1. Requested approval of $2,400 for 160 hours of extra Sheriff patrol. Referred to Public Welfare Committee. 2. Announced I.C.C. "Mini" Laborl Seminar on January 27, ~971. VII. COMMUNICATIONS A. WRITTEN 1. Letter from five residents of Kilbride Court re Miljevich fire is being followed up by city staff. 2. Letter from John A. Hardouin re professional unemplo~yment in the Santa Clara Valley noted and filed. 3. Letter from Nancy Freed, 19820 Charters Avenue indicating need for street lighting noted and filed. 4. Letter from Mrs. William J. Watson, Jr. of San Jose re left turn lanes on Prospect noted and filed~ 5. Letter from Dadi Noeggerath complaining about the Hartman Nursery referred to staff. 6. Letter from Prides Crossing Homeowners Association asking to be kept fully informed about the proposed extension of Brookglen Drive to Cox Avenue noted by Council. This matter is presently in committee. 7. Resolution from City of San Mateo memorializing the California legislature to provide meaningful tax relief for the homeowner noted and filed. 8. Letter from Mrs. Charles Smith concerning tree trimming on Norton Road referred to staff and Brian Gage. 9. Letter from Robert Plane concerning the pedestrian death on Saratoga Avenue in front of Sacred Heart Chruch and asking for better control and improved lighting referred to staff. 10. Letter from School Board Association announcing a Spring conference on February 26 and 27 noted and filed. 11. Petition from merchants on Prospect Road requesting a two-way left turn~ lane referFed to staff. 12. Letter from Bruce Anderson suggesting creation of a motorcycle park referred to Parks and Recreation Commission. - 4- SA~TO~ CITY COUNCIL - SUMMARY OF ~TES - JA~ARY 20, 1971 B. O~L 1. Mrs. Patricia R. Knapp and Marshall Hall presented a petition from residents of Arroyo de Arguello asking for clarification of plans for the creek area. Referred to Planning Committee. 2. Mrs. Mary J. Moss, 20777 Pamela Way presented a petition signed by eleven residents asking t he Council to use its authority to declare the rock noise at the GoW. Leish~n home, 29770 Pamela Way a~public nuisance. Referred to staTff. 3. Planning Commissioner Lively inquired about re-paving of Quito Road in the Cox Lane area. Since this is in the San Jose jurisdiction Mayo~ will send a letter to the Mayor of San Jose requesting re- ~ paving.
