MORAN - SARATOGA AVENUE - CONTINUED FROM 7-2l-7l Public Hearing opened at 8:27 P.M. No one in the audience wished to comment. Continued to October 6, 1971. B. PUBLIC HEARING ON FORMATION OF PRIDES CROSSING SOUTH PARK MAINTENANCE DISTRICT City Manager stated that the hearing had been noticed and all property owners in the area had been notified. The district would be formed for the purpose of providing for maintenance of landscaping along Cox Avenue which was installed by the subdivider. City Manager read into the record statements from the Planning Director and the Director of Public Works. He noted one ,communication opposing formation of the district from Mr. & Mrs. George B. Bunyard, l2625 Miller Avenue and a petition signed by 34 residents of the Prides Crossing area. Public Hearing opened at 8:33 P.M. Charles Huff, 12725 Miller Avenue objected to inclusion of parks in the district and referred to the possibility of a park being constructed in the Prides Crossing South area. He also requested that the matter be continued since there was a possibility that the Prides Crossing Homeowners' Association would assume the cost and this would have to be brought to a vote. Mr. Huff also noted that only 54 out of the total of lIO proposed lots are occupied at the present time. Hubert Bath, 12603 Miller Avenue also objected to the wording of the Resolution and requested that the word "parks" be stricken and that specific requirements be substituted. ':; ;"":''1';: '-~ , . . Bunyard, 12625 Miller Avenue suggested that in future development the City already have these special districts set up so that property owners 'are aware of the various taxing areas before moving into an area. She also referred to the fact that some cities use the Gas Tax to maintain landscaping along collector streets. Mayor Pro Tern stressed that the purpose of the District is to maintain that area adjacent to the fences along Cox Avenue. If there were any additions, a further public hearing would be required. It was the consensus of the Council that there was no objection to striking the word "parks" from the Resolution. Public Hearing continued to November 3, 1971. Staff directed to work with Mr, Davis concerning acceptable wording of the Resolution; and will expect a communication from Prides Crossing Homeowners' Association. VI. ADMINISTRATIVE MATTERS A. MAYOR 1. Called for an Executive Session to discuss potential litigation and personnel matters. B. FINANCE 1. Payment of Claims Approved disbursements dated September 15, 1971 and authorized Mayor Pro Tern to sign the warrents. 2,3. Treasurer's Report and City Clerk's Financial Report - noted and filed. C. COUNCIL COMMITTEES AND COMMISSION REPORTS l. Planning and Environmental Committee report on the General Plan Review, 1971 presented for information. 2. Adopted Planning Committee report authorizing hiring a consultant to establish right-of-way line off Saratoga-Los Gatos Road across Dr. Cermak's property. 3. Adopted Management Committee report concerning designation of City's basic liability insurance. 4. Approved City's participation in the Federal Public Employment Program and authorized preparation of the application and that the Mayor Pro Tem be authorized to execute the contract:with-tne County. D. DEPARTMENT HEADS AND OFFICERS 1. Director of Public Works announced that signs would be changed indicating a 15 minute parking limit in front of the Post Office. 2. On recommendation of Director of Public Works, Mayor to direct a letter to Mr_ Hart, State Division of Highways and the Transportation Policy Committee of Santa Clara County indicating the CityJs strong desire that Highway 9 remain part of the State system. 3. Thoroughfare Street Lighting Committee minutes noted. 4. City Attorney reported there will be a permanent injunction in the Cocciardi Quarry case'prohibi ting future operátion of the quarry. 5. City Attorney reported he will meet with Mr. Lloyd Homer, Attorney to discuss further possibilities concerning thé Brookglen-Cox park site. E. CITY MANAGER l. Proposal from Robert Folendorf, landscape architect for median landscaping on Prospect referred to Management Committee. ' 3. On City Manager's recommendation, Council approved an amount up to and not exceeding $120. to trim the trees along Prospect Avenue in the Brookview area, 4. Announced a Symposium on CATV to be conducted by A.B.A.G. on October 15, 1971. VII. COMMUNICATIONS A. WRITTEN 1. Council" authorized City Thomas, Shoen and Redd. Thomas' was present. Request from the Porsche Club of America for permission to hold a Funkhana on October, 3 approved. 4. Letter to the Mayor indicating that the City of Cupertino has gone on record endorsing the change from Saratoga-Sunnyvale Road to DeAnza Boulevard. City Manager to direct a letter to Cupertino and the State Division of Highways expressing disapproval of this change. 5. Copy of a letter from San'Mateo Board of Supervisors directed to Chairman Corteze of Santa Clara County Board indicating their rejection of the Mid Peninsula Regional Park District. 6.' Letter from Mrs. F.K. Goodill announcing her resignation from the Youth Commission. 7. Letter from Henry Bose advising of progress on the Scavenger Committee report. 8. Letter from Mrs. Walter M. BOrer supporting the proposed park in prides Crossing South. 9. Copy of City Manager's letter to County Planning Director regarding proposed transmission lines between Davenport, the nuclear power plant and this area. B. ORAL 1. Mrs. Ruth OWen complimented the city on the reduction of the illegal car sales at the Argonaut Shopping Center. 2. Charles Huff asked for stricter control of speeders in the Prides Crossing South area. Councilman Dwyer noted that the City now has a full time Sheriff's car with radar equipment to handle this type of problem. II. ADJOURNMENT The meeting adjourned to Executive Session at 9:30 P.M.
