MINUTES Minutes of September l5, 1971 approved as written. II. BIDS AND CONTRACTS A. SEAL COATING AND OVERLAYING CERTAIN CITY STREETS FOR 1971 Accepted work and authorized ;filing Notice of Completion for Gilsonite and Slurry Seal. B. REQUEST FOR AUTHORIZATION TO ADVERTISE FOR BIDS FOR THE ELVA AVENUE STORM DRAIN PROJECT Authorized advertisement for bids for Elva Avenue Storm Drain Project. C. AGREEMENT BETWEEN THE CITY OF SARATOGA AND THE SARATOGA UNION SCHOOL DISTRICT FOR CONSTRUCTION OF A ,JOINT CORPORATION YARD Mayor authorized to execute agreement with the Saratoga Union School District. City staff directed to discuss possible problems with School District staff. III. PETITIONS, ORDINANCES AND FORMAL RESOLUTIONS k. RESOLUTION NO. MV-32 Adopted Resolution prohibiting parking on Big Basin Way near Fourth Street. , B. PETITION FOR TRAFFIC CONTROLS' AND ENFORCEMENT ON MILLER AVENUE City Manager presented a petition and letter of transmittal signed by l4 residents of Miller Avenue. The Director of Public Works reported on the results of the study conducted by that Department. The matter was referred back to staff for further study in light of the Council's questions and cOmmßnts. C, REQUEST ~o DISCUSS ALLENDALE AVENUE TRAFFIC PROBLEMS City Manager presented a letter from the Allendale Area Advancement Association signed by 7 residents of the Allendale Avenue area requesting a hearing before the Council to discuss the traffic problem on Allendale and adjoining residential str~ets. Walter Bornemeier, 19225 Allendale Avenue read the petition and a list of 11 emergency measures with the request that they be put into effect as soon as possible. He also expressed some dissatisfaction with the crossing guard at Quito and Ravenwood and asked that an individual be hired who understands traffic. KANAZAWA - ORIOLE WAY Adopted Resolution No. SDR-906-l, granting Final Building Site Approval. B. TRACT '5069 - ALFRED F. DUMAS - PROSPECT ROAD Adopted Resolution No. SD-902-l, approving final map. Request to waive park fees denied. C. SDR-882 - ROBERT P. LEWIS - SOBEY ROAD Acknowledged completion of improvements and authorized release of bond. V. PUBLIC HEARINGS A. SARATOGA GENERAL PLAN, l. Retirement Housing Element Councilman Smith presented the Planning and Enviro~ental Committee report recommending the establishment of no ,new zoning district nor iand'use' . . 'designatiön on the Saratoga Genèral Plan but rather 'the 'use--of' theo,present , , , . R-M (Multi-Family Residential) designation as the best tool in planning J '_, _":"""H,tirement ,housing.., __ ,The_Committee recommended the.adoption ,of ,the ,~,--- Retirement Housing Element in the Saratoga General plan and further recommended that the matter be referred back to the Staff and Planning Commission to draft retirement housing facility guidelines and establish a sub-category (in ordinance form) of the present R-M (Multi-Family Residential) Zoning District to,accommodate retirement type housing. Public Hearing opened at 8:35 P,M. Col Barco, Dundee Avenue asked that the Public Hearing be continued so that interested parties could be notified and so he could review the above mentioned report. Public Hearing closed for the evening 8:40 P.M. ' and continued to October 20, 1971. 2. General Plan Review for ,1971 a. Clifford Beck Request for Change of Land Use Designation. Councilman Smith presented the Planning and Environmental Committee report recommending that no change, in land use designation of the northwest corner of Saratoga Avenue and Cox Avenue from Single-Family Residential to Professional-Administrative offices be made. Public Hearing opened at 8:48 P.M. Gene Fink, l22 Saratoga Avenue, Santa Clara, representing Clifford Beck presented a rendering of the office complex which they proposed. He felt this was not a prime r~sidential area because it is a heavily traffickèd corner, and that:development costs would be prohibitive. He felt strongly that there:was a need for more P-A zoning in Saratoga. Public Hearing closed at 9:00 P.M. Council voted to maintain present designation for northwest corner of Saratoga Avenue and Cox Avenue according to the recommendation of the Planning and Environmental Committee. b. Housing Element. Councilman Smith presented the Planning and Environmental Committee report recommending that the Planning Commission statement on low income housing be used as an interim Housing Element statement in the 1971 Saratoga General Plan. Public Hearing opened at 9:08 P,M. No one in the. audience wished to comment. Public, Hearing closed at 9:08~ P.M. Recommendations contained in the Planning and Environmental Committee report approved. c. Central Park. It was the consensus of the Council that the City should concentrate its efforts on neighborhood parks and discussion of the central park issue was continued to October 20, 1971. ~ . . CITY COUNCIL MINUTES - OCTOBER 6, 1971 - PAGE 3. There was a brief discussion regarding the Planned Community concept which is popular with professional planners. Mayor Robbins listed some of the advantages and disadvantages of P-C zoning. Public Hearing opened for discussion of the park element and planned community concept at 9:18 P,M. No one in the audience wished to comment. Public Hearing closed at 9:l8~ P.M. d. Institutional Zoning District Councilman Smith presented the Planning Committee report recommending abandonment for the present timeror-the proposal-for an institutional zoning distri~t a,:d to discontinue proceedings òn'þroposed Ordinance NS~3.29. These actions would result in institutional type uses being regulated 'as they are now under a conditional use procedure in nearly all of the existing zoning districts. They further recommended that on applications for use permits for institutional uses that standards for all these uses be developed. Sanford Berliner,representing Noorudin Billawala, asked that the parcel on Sousa Lane be designated for institutional use since he felt there was no question that the highest and best use would be for a convalescent hospital. However, he agreed to proceed with the Council's wishes in this regard. Public Hearing closed at 9:35 P.M. Adopted Planning and Environmental Reportpdated October 6, 1971 and discontinued proceedings with regard to Section 1 of Ordinance NS-3.29. B, ORDINANCE NS-3.29 Public Hearing opened at 9:43 P.M. Rezoning denied and proceedings terminated. VILA. T. COMPLAINTS RE MOTORCYCLES ON PIERCE ROAD Woody Linn, r3240 Pierce Road referred to his letter concerning the fire hazard and problem with noise pollution on Pierce Road. Several residents of the Pierce Road area were in attendance. The Deputy Sheriff had informed the residents that it was almost impossible for them to do anything because there is no city ordinance covering this. , The City Attorneystated'that the legislature had amended,Section 602 of the Penal Code making'motoreycle trëspassing'a mrsdemeanor. He, . also outlined several laws governing noise'pollution, and suggested that the City obtain the cooperation of the large land owners. It was the consensus of the Council that enforcement was a matter of the staff'working with the Sheriff's Department. Without objection, Mayor Robbins referred the matter to staff to work with, the Sheriff's Department and the City Attorney. Dr. Abrams mentioned that there was also a problem along Saratoga Creek. VI, ADMINISTRATIVE MATTERS A. MAYOR l. Announced I.C.C. meeting on October 7, 1971. 2. Reported on Chamber of Commerce luncheon in honor of Saratoga's 15th anniversary. The Chamber had presented the City with a plaque commemorating this. B , FINANCE 1. Payment of Claims Warrant No. 14254 deleted. Approved list of disbursements dated October 6, 1971 and authorized Mayor to sign the warrents. C. COUNCIL COMMITTEES AND COMMISSION REPORTS 1. ¡Approved Management Committee report on Prospect Road l~ndscaping approving Robert D. Council supported Parks and Recreation Commission recommendation regarding May property for possible parks use. City Manager dir~cted to forward a letter to Earl Miller of Moser and Long Agency, Inc. 6. Approved Parks and Recreation Commission report on Franklin Pathway and directed staff to notify residents who will be affected by install~tion of the pathway. 7. Parks and Recreation Commission report on Hakone Gardens referred to staff for cost estimates and to ascertain whether Tanso Ishihara would be capable of performing this work. 8. Noted a preliminary plan of regional parks for Santa Clara County. 9. Established November 1 as date' for Joint Study Session with the Parks and Recreation COlmnission. 10. Job Specifications for Parks Maintenance Superintendent referred to staff. D. DEPARTMENT HEADS & OFFICERS ll. Mayor suggested that Council review the Public Works Department's study concerning a Crossing Guard for Sacred Heart School ~nd directed the staff to contact Mrs. Allen and the other petitioners.' 6. Report on Saratoga-Los Gatos Road between Oak Street and Aloha will be presented to the Planning Committee at their next meeting. . 7. Mr. Louis Franckx, ,Chairman, Thoroughfare Street Lighting Committee presented a proposal from Mr. Ed Bennett of Beamer/Wilkinson and Associates. Mr. Bennett has proposed $2500 to $3000 for a broad range of services. The Committee has recommended services on an hourly basis to have Mr. Bennett assist in picking out specific hardware at limited interesections and for consideration as a standard. 8. Mr. & Mrs. Tidbal1~ s request for deletion of sidewalk construction at the east end of Glasgow Drive approved, subject to review by the Planning Committee. ",' E. CITY MANAGER 1. Report on Cox-Brookglen as a potential' park si te. 2. Mr. Bornemeier's suggested times that Council look at traffic on Allendale Avenue. 3. Approved City Manager's recommendation' that the City pay for PERS prior service funding in a lump sum of $6,890. 4. Code Enforcement Officer's report on Village Security and the Safer Saratoga Program referred to Public Welfare Committee for review. 5. Memo on City of San Jose Environmental Task Force referred to. Planning and Environmental Committee. 6. Council supported the nomination of Robert Quinlan, City Manager, Cupertino to the Regional Criminal Justice Planning Board. ~ ; " , . . WRITTEN 1. , Letter from Jim Naugle, Chaïrman, Scavenger Ordinance Review Committee transmitting the report of :the Committee to the Council. Mayor Robbins thanked the Committee for the tremendous amount of work and referred the report to the Management' Committee. 2. Copy of a letter from Kirk ~omstock, Mayor, Palo Alto concerning model tenant-landlord'agreement noted and filed. 3. Proposed resolution from City of Santa Rosa asking support of legislation to deduct garbage fees from, income tax noted and filed. 4. Letter from James. A. Letter from Mr. & Mrs. Henry G. Venn, l29ll Pierce Road concerning one half acre zoning for property on the northeast side of Pierce Road between the Wilson property and Foothill Lane noted and filed. 9. Letter from the Youth Center indicating that the Youth Commission report on the Youth Center ~as been received by the Board and is under committee study referred to Youth Commission. lO. Letter from Heidi Williams, ,123 Montclair Court, Los Gatos requesting that the City ,clean up Quito Road referred to Public Welfare Committee. City Clerk noted that Saratoga Beautiful is spearheading a clean up campaign in the area and the City is supplying the truck. ll. Mendenhall, 10335 Denison Avenue, Cupertino requesting relief from some of the conditions of site approval referred to staff for recommendation. l4. Letter from Mrs. John L. Scarlett, La Paz Way, indicating the need for more traffic patrol on Aspesi, La Paz and Casa Blanca referred to staff. ' l5. Dr. Abrams stated that the Board of Supervisors had referred the matter of ambulance service to the Emergency Care Services and suggested that the City send a representative to their next meeting. Mayor referred this matter to staff. VIII. ADJOURNMENT Mayor Robbins acknowledged the presence of Planning Commissioner Smith, Mrs. Slade, Jim Naugle, Eunice Stark, Ruth Owen, Thad Binkley and Mary Moss.
