ROLL CALL Present: Councilmen Diridon, Bridges and Smith Absent: Councilmen Kraus and Dwyer II. VACATION 'AND ABANDONMENT OF WARDELL ROAD - Cont. from 9/6/72 and 10/4/72 Mayor Smith introduced the sUBject by indicating that this item had been continued from the last regular Council Meeting of October 4, 1972. The City Mahager then expla'ined some aiternatives on how'the property adjacent to the' proposed abandonment, which is owned by Mr. Bogart, could be .deWeloped without hurting access to the property. Mr. Walker, Director of Planning, thoroughly delineated the alternatives, showing what could be developed with the existing alignment and also with the,new alignment of Wardell Road. The alternatives illustrated indicated that there were two situations where only three lots would be allowed under the present alignment. With the new alignment, there was the possibility that four lots might be developed with proper access, either from Wardell Road or Saratoga-Sunnyvale Road. Mr. Bondelie, Mr. Bogart's attorney, questioned the height of the lot on the corner ~f the existing subdivision, Tract No. 5131. It was indicated by ' Mr. Bernard Turgeon, S~ratoga Foothills Development Corporation, that approxi- mately one and one-half feet could be taken off the height of the lot. At the present time land is being stored for the complete development of the lot once Wardell is abandoned. Mr. Turgeon indicated that they tried to keep the lot approximately twelve inches above the curb and that this was necessary in order to drain lots in the subdivision. After further discussion, it was moved by Councilman Diridon and seconded by Councilman Bridges to adopt Resolution No. 639, Ordering Vacation and Abandonment of a Portion of Wardell Road. The motion was unanimously carried. III. SANTACROCE PROPERTY, 14341 SOBEY ROAD - Cont. from 10/4/72 The 'City Manager indicated that Mr. Santacroce had not yet received anotice of the public hearing whiCh.had occurred 'or the letter regarding tonight's meeting to discuss the nature of the' publjic nuisance'on his property. Mr. Beyer indicated that a letter had been sent to Mr. San[acroce by Registered Mail, Return-Receipt-Requested, and upon follow-Up with the Post Office, he found that this letter had not been received by Mr. Santacroce. In addition, the same procedure was used regarding tonight's me!eting, and this had not yet been. delivered. ~t was recommended by the ~ity Manager that this item be delayed until the next regular meeting, by which time w~ will have notified Mr. Santacroce personally and also by mail. It was moved and seconded that 'this ~ em be continued to the next regular meeting. 'IV.'
