ROLL CALL Present: Councilmen Bridges, Diridon, Dwyer, Ktaus and Smit~ Absent: None IIo PETITIONS, ORDINANCES & FORMAL RESOLUTIONS A. REQUEST BY SARATOGA CHAMBER OF COERCE AND VILLAGE MERCHANTS ASSOCIATION FOR THE CITY TO PAY ENTIRE COST FOR TRAFFIC CONTROL SERVICES IN THE VILLAGE DURING CHRISTMAS SEASON The City Manager introduced this subject. by outlining its past history: ~nd ~ t~o' $650 fo~'~ t~r~i~' ~g~t~oi. sg~iFed,"~it~'[~e'~ffage Me~ant~ and 'the' ~ Chamber of Commerce paying the other 507°. After considerable discussion, a motion was made by Vice Mayor Dwy~r that the City pay the full cost for traffic control services during the'Christmas Season up to an amount not to exceed $650. This motion was seconded by Councilman Kraus and approved 5-0.. ~ B. REQUEST BY DR. ISAAC ABRAMS REGA~IDING DENIAL FOR DESIGN REVIEW APPROVAL TO BUILD A TWO-STORY ROME ON LOT 17 OF TRACT 5233 IN SL~4MERPLACE SUBDIVISION Dr. Abrams brought up a reqi~e~ which he wanted to discuss with the City Council during the AdjOurned Regula~ Meeting. The City Council then recessed the.meeting to meet as a Committee Of the Whole. Following adjournment of the Committee of the Whole Meeting,j the Adjourned Regular Meeting was resumed for discussion of the Abrams matter. Dr. Abrams made a presentation regarding the City's position in not allowing him to build a two-story building'on Lot 17 of the Summerplace Subdivision. He listed essentially four points in his argument: 1) What is the procedure to appeal an interpretation of a department head regarding an ordinance--who does one go to? 2) In this case, is he subject to Design Review? 3) If he iS subject to Design Review, does Design Review go with the land? 4) If Design Review does go with the land, did the Design Review Committee of the Planning Commission exceed its design standards by, in essence, changing the zoning of the above-mentioned property? The City Council discussed these points with Dr. Abrams and asked that he articulate them in a letter so that~ they could be reviewed by the City Attorney and the Planning Department staff prior to the December 6th meeting of the City Council, at which time zthis item will appear on the agenda. The Council took no action on this matter. It was.moved and seconded that the Council adjourn to an Executiv~ Session for discussion of personnel matters.
