PLACE: Saratoga City Council Chambers, 13772 Fruitvale Ave., S~ratoga, California TYPE: Regular Meeting I. ORGANIZAIION A. ROLL CALL Present: Councilmen Bridges, Diridon, Dwyer, Kraus, and Smith Absent:' None B. MINUTES It was moved by Councilman Bridges and seconded by-CouncilmanI Diridon that the minutes of the.meeting of December 19, 1973, be approved. The motion was carried. C. PRESENTATION - RESOLUTION'NO. 683 Resolution of the City Council of the City of Saratoga.Designating Coach Ben Pierce as a Distinguished Citizen of Saratoga ~nd declarinM January 16, 1974 as "Ben Pierc~ Da ".. Y Mayor Smith recognized Coach Ben Pierce, present in the audience, and pointed out some of his past accomplishments ~s Coach of the Saratoga High School Falcons football team. ~'s~'o~d. byeCouncilman Kraus and seconded by ~g6nc~a~wye~' that Resolution No. 683 be adopted.. The'motion was carried. II. BIDS AND CONTRACTS A. SARATOGA-ALTA VISTA STORM DRAIN EXTENSION It was moved by Councilman DFyer and seconded by Councilman Kraus that the' work on this project be accepted and the staff be authorized to file ~he Notice of Completion.' The motion was carriedl III. PET~TIONS,'ORDINANCES, AND FORMAL RESOLUTIONS A. ORDINANCE NO. 3-E.12 ~mergency Ordinance with the Cit'y of Saratoga Defining and Establishing Hazardess Fire Areas within Said City and Providing for Fire Retardant Roof Coverings on All Buildings Hereafter Erected or Constructed within Said Hazardess Fire ~reas. The City Manager explained that thi~ request w~s briefly considered at the last City Council'Meeting; however, no action was taken at that time. He thenrre.ferenced the proposed 'draft resolution and also the map exhibit, out- lining the designa~ed'hazarde.ss fire area and boundaries. He ~urther explained that primary objective of the ordinance is to provide for ~dditional restrictions with regard ~o z~oof coverings on new projects constructed in this hazardess fire area. Chief Ernest Kraule of Saratoga Fire District addressed the Council and urged that action be taken~to e"'~act ~"6'~dfnance~in the next ~eeek~fB~fh~_.7~ '~'p~'building'beason arrives and,new construct£o~ Lakes place. ORDINANCE NO. 3-E.12 (Cont'd.)~ The question arose as to the cost differential in using asbestos material in lieu of redwood shake. However,; this present figure was unknown. Mr. Doug Gravelie, Architect representi9g Stoneson Construction Corporation, commented that it was his feeling the new units of the Saratoga Oaks Apa~,tments would not be constructed in a heavily wooded area, and therefore, could be b~passed. The City Manager was asked to read the pro osed ordinance, and this was done. The question arose as to how property locaEed on or straggling the boundary line of the hazardess fire area would be treated. It was suggested that suit- able language be inserted to clarify this. The City Attorney suggested the first sentence in Section lI,~, ~ec~d paragraph, be modified, and add the following: ". . . save and except] as follows: that where, if at all, .the di~bs.ion line'delineating the boundary of the hazardous fire area should besect a parcel of property in one ownersh~ip, then such division line shall be deemed to be the easterly lines of such parcel and such hazardous fire area shall include the whole of such parcel which otherwise would be sotbisected." Mayor Smi[h suggested that thi~ issue be continued later on the agenda to give those interested parties an opportunity to review the contents of the ordinance and present their views.'~ B. ORDINANCE N0. 38.56 An Ordinance Establishing Truck Rou'te~ within the City of Saratoga Upon the recommendation of the City Manager, the Council consented to continuing this item to the next regular meeting. C. RESOLUTION NO. 684 Resolution of the City Council of the City of Saratoga Approving Request of Saratoga Fire District to Consolidate its Maximum Tax Rate Election with the City's Municipal Election. The City Manager explained that t~ere would be approximately five precincts consolidated, and the measure on the bal'lot would be whether or not a tax increase to 70¢ per $100.00 in the Saratoga Fire Protection District should .~ be authorized. Adoption of this resolution would provide for this consoli-' dati6n. It was moved by Councilman Bridges ~nd seconded by'Councilman Dwyer that Resolution No. 684 be adopted. The motion was carried. IV. SUBDIVISIONS, BUILDING SITES, AND ZONING REQUESTS None. V. PUBLIC HEARINGS None. (Continuation of discussion Re: Ordinance No. 3-E.12) Mayor Smith opened the floor for discussion, again pointing out the language .modificatl~on in Section II. He explzained that there there is an entire fire ordinance yet to be considered by the County, and this is one segment of that hazardess conditions described by Chief Kraule at the previous City Council Meeting. - 2 ~ ORDINANCE NO. 3-E.12 (Cont'd~) Guy Ruscigno, Projects Manager for Stoneson Construction Corporation, addressed the Council and indicated he would have two concerns with regard to this ordinance . 1) availability of materials; and 2) price of material. Mayor Smith asked if any materialslrequired for a conventional roof could be eliminated in the use of asbestos in order tosubtract some of the cost of this material. Mr. Ruscigno commented that there would be added cost because 5/8" plywood would be required, as well as solid sheering with the asbestos material. He indicated his last estimate on asbestos was at approximately 25¢ per square foot.' Following additional discussion related to fire retardant roofing, materials, and estimated costs, it was moved by Councilman Dwyer and seconded by Councilman Kraus that this item be 'continued to an Adjourned Regular Meeting on Tdesday, January 8th, and the Council adopt the policy that no building permits be issued for any proposed structures ~w_~ !pyfi'~0~'~Tlt~._f~re retardant standards until January 9, 19747 Also, the City Manager be directed to develop information with regard to cost and availability of mater{als in implementing this emergency ordinance. The motion was carried. A. MAYOR 1. Announced an Exechtive Session 'to follow Adjourned Regular Meeting on Tuesday, January 8. 2. Requested that the City Manager investigate the possibility of installing a bicycle rack in the Village. 3. Announced dinner for Coach Ben Pierce to be held on January 16th; City Council Meeting postponed to January 17th. B. FINANCE 1. Payment of Claims - It was moved by Councilman Kraus and seconded by Councilman Diridon that the list of disbursements be approved and the Mayor be authorized to sign the warrants. The motion was carried. C. COUNCIL AND COMMISSION REPORTS ~ 1. Plannin~ Commission, Re: Request by George Novakovich to Pu~ 11 Acres under. Land Conservation Agreement (Williamson Act). Councilman Dwyer expressed his opposition to thi~reqqestCfjr the following reasons: 1) scarcity of residential property -- felt the City would be contributing to the problem of soaring costs; 2) felt the Council would be creating headaches ~or future City Councils in their control of this land for development. Mayor Smith advised that t~e public hearing on this matter has been scheduled for January 16th. D. DEPARTMENT HEADS AND OFFICERS E. CITY MANAGER 1. Excess Property by Division of Highways~7 Upon the recommendation of the City Manager, it was moved~pd~seeon~edDthat the City Manager indicate to the State that the City of Saratoga is not interested in purchasing this property. - 3 - CITY MANAGER REPORT (ContZd.) 2. Statui Report Re: West Valley Freeway Corridor - It was moved by Councilman Diridon and seconded by Councilman Smith that the City Manager indicate to the State Department of Transportation its interest in preserving the right-of-way ~for a future multi-modal transportation corridor; however, reserve comment with regard to the financial aspects until {nformation.is received ~ertainent to the specific parcels which would be'involved *ithin this;~ight-of-why.
