ROLL CALL Present: Councilmen Smith, Dwyer, Bridges, Diridon and Kraus ' Absent: None II. PETITIONS, ORDINANCES~AND FORMAL RESOLUTIONS Ordinance Granting a Franchise to Communications Systems Corporation to Construct~ Operate and Maintain a C~ble Television System within the City of Saratoga The City Manager reviewed the situation pertaining to the negotiations on the cable franchise for the City of Saratoga. He indic'ated there were two areas still under consideration Which had not been resolved -- the first being the period of time in which t~e basic cable system had to be com- pleted, and second, the length of time for the proposed franchise. He indicated he would like the Council~s concurrence with the proposed arrange- ment providing for a fifteen;year franchise, with the option to renew for five years. It-was felt this would meet the requirements of the F.C.C. and still allow for a twenty-year franchise. The City Council was concerned also about the clarification in Section 6 of the ordinance granting the franchise which pertains to the construction schedule. It was felt that the system shoul~ be-completed within eighteen months from the initial start of construction. Discussion then centered around the service area boundaries which had been defined in Exhibit "A". After considerable discussion, it was agreed that. the entire city should be ser~ved ~ithin eighteen months, with the exception of Service Area II, which would be based on an assessment district type of arrangement, as opposed to the line assessment charge proposed by the applicant. The Council indicated support in the remote area tq provide for thirty months 'construction, but indicated it would have to be done under the new arrangement. Furthermore, it was recommended that Area I service area boundaries be modified to include some of the adjacent areas originally proposed in Area II. The City Manager was 'asked to work out the details of the service area on' a new map and to develop the service area arrangement proposed and discuss it with Mr. Nishimpra, the cable app~lic'ant. It was moved and seconded that thisitem be continued to a future regular meeting of the City Council as soon as the City Manager has had an opportunity to develop this new information and'discuss with the applicant.
