A. RESOLUTION N0. 690
A Resolution of the City Council of the City of Saratoga Commending
Gerald Hensen for His Educational ContributiOns and Achievements in
- Being Conferred the Outstanding Teacher Award by the A.I.A.A.
Following areading of the resolutilon, it was move~ by.Councilman Diridon
and seconded by Councilman Bridges ~Resolution No. 690 be adopted. The
motion was carried. The City Manager presented Mr..Hensen the resolution.
B. RESOLUTION NO. 692
A Resolution of the City Council of' the City of Saratoga Commending
Lois Burke as "1973 Citizen of the Year".
It was moved by Councilman Diridon'and secoDded by Councilman Kraus that
Resolut ion No. 692 be adopted.' TheI motion was carried.
IV. SUBDIVISIONS, BUILDING SITES AND ZONING REQUESTS
A. SDR-i095 PETER MATULICH, MARION ROAD, 1 LOT
It was moved by Councilman Kraus an~ seconded by COuncilman Brigham that.
Resolution No. SDR-1095-1, granting Final Building Site Approval, be adopted.
The motion was carried. ~
B. SDR-932 GEORGE A. AKERS, EL CAMINO!GRANDE, 2 LOTS
It was moved by Councilman Diridon ~nd seconded by Councilman Kraus that
Resolution No. SDR-932-1 be approved. The'motiOn was carried.
V. PUBLIC HEARINGS
CONSIDERATION OF PLANNING COMMISSION RECOMMENDATIONS RE: SARATOGA GENERAL
PLAN AND SPHERE OF INFLUENCE PLAN ~Cont'd. 4/2, 4/9 and 4/17/74)
The City Manager indicated there are several items Of correspondence related
to the General Plan which have been~received Since the previous meeting;
These are as follows:
1) Z. Zettle~.~Greely, qhairman, Greater Prospect Hills Homeowners Association,
expressing support of the City o~ Saratoga's appeal on"the Bohtman Road
property
2) Anthony T. Cocciardi,.22631 Mt..Eden Road, suppQrting the concept of a
road pattern through' the lower ~oothill area west of Saratoga-Sunnyvale Road.
3) Curtis L..Coleman,' Attorney for Charles Marldon, owner of property in
Area A, Mt. Eden, correcting ~ statement in a previous letter to the
Council related to Mr. Maridon's~.property.
Mayor Smith asked for any comments ~from the audience concerning the General
P1 an.
Mr. Weir, representing the Greater ArguelloLHomeowners Association, stated
he is satisfied with the' revision's that have been made to date in the General
Plan Objectives, Policies and Actions. However, he indicated he would like

~his revision was acceptable to thel Council.
A c~izen commented with regard to :item 17, page 5, pertaining to ~nforcement
of. private property~r~g~t~ on ~roRerties'bordering trails. It was asked how
the City intended Itogo a~out epforcing this. The'.Mayor replied that the
Council would Soon be formulating ~/~'~k~_for~"' ~i[te.~ in order to implement
a.trails and pathwaXs map in th~ City. ·

suggestions'
The City Manager indicated under 'iC~UN~Y P~ANN~'i0~JE~i~E~ Community
Development, it lhad .been suggested ythat-ite~il~ ~~ ~ovide archi-
tectural design review for all commercial development in Saratoga."
Dr. isaac Abrams Commented that itSwas his understanding this would not be
restricted to "Commercial", but would pertain to all development in Saratoga.
City Attorney Faber Johnston stated he'.~ld disagree withj~he requirement
to provide architectural design review for aff'd~ve[Opmen[,~as he felt this
would be running into a dangerous field indireet'ing as a matter of policy
to'have'design review.on every home which
stated that as the law now stands,!he doesn tfeel it could be implemented.
'~Th~'~i~'~'~[~o'~h~_~ stated that the tpriVate ~ndividual has the right to create
~f~wn ~d~n~Land unless he is in the business of building homes and selling
to others, he didn't see how we could enforce this requirement.
Saratoga General Plan (Cont~d.)
Mayor Smith suggested the COuncil suspend making 'any judgment on this point
until more information is received.:
A suggestion was made that the wording for Nq. 12 be"'~o the greatest legal
extent possible, provide. architectural design review £6r all development in
Saratoga". The Council felt this ~ording would .be acceptable.
Continuing to page3, item=5, Councilman Kraus ~ug~st'ed wording be substi-
tuted to reflect "no visual damage to the existing environment". ~he Council
concurred in this suggestign.
Page 4, item 14: The. City ~anage~ pointed out the addition of this' {tem, and
indicated this woU~-agc~mRl,is~ wha't.was previqusly. suggested with regard to
protection of the ridgelines.
Page 5, item'13: The City Manager advised the second sedtence in item 13,has
been struck as previously suggested,.
Page 6, Area A, Item 1: .This item would be modified as suggested earlier in
the meeting. Also, wording wSuld b~ inserted to clarify what is meant by
"conservation' evaluation".
Also under this section is th~ addition of item 5: "Explore the feasibility
of a.new collector street to serve the western hill a~ea." This was added as
'a result of the discussion at'the previous public hearing pertinent tO Item 2
(Delete the Wardell Road'extension to Old Oak Way.)
Page 7, Item 3: The footnote has been revised to clari~y or separate out the
element of the PD district. Footnote No. 2 pertains to "PD-Mixed use";
· Footnote No. 3 pertains to/'PD-Residential"~
Councilman Bridges commented that this change ~lears up his concern in that
it autom'atically moves the zoning up so there'wOuldn't.be development, except
of the highest typeT
Page 8: There were no change~ recommended.
Page 9: F~otnotes have been changed:~to give the clarification pointed out
above..
No. 8, stating "Quito Road should b~ improved to four lanes from the Lawrence
Expressway to Allendale Avenue." hab been eliminated.
Pages 11 and 12: No changes were recommended.
Page 13: T~is has been revised to reflect the new footnotes.
Sphere of Influence Plan
Page 1, Environmental Resource Management: It has been recommended to sub-
stitute wording in No. 10,·to reflect: "To preserve the historical and
archeological values in the area.",~ratber than "values o£ a site". This
revision was acceptable to the Council.
Page 2, Community Development: The~ City Manager indicated that No. 4 has been
eliminated as it was felt there was 'some duplication to the other points in
this section.
Councilman Bridges didn't feel this'entire point should be eliminated; rather,
the portion pertaining to "apartments" be dropped. In this way, No. 4 would
read: "Expand the criteria for types of dwelling units from detached single-
family to townhouses and attached cluster housing."

The Mayor askedif~there were any further comments with regard to the
General Plan document itself. '~-,
Ms. Lynn Belanger, Planning Commissioner, asked why Item No. 8, page 9,
pertaining to improVingOf Qdito Road to four lan~s from LawrenCe Expressway
tO AllendalellAvenue, was deleted on this draft without substituting for it
in some way to address the problems in this area.-.sbe felt this wording
should be similar to that in Item 4,~ page 10.
Councilman Brigham suggested the wor~i~g in No. 8, page~9 be similar to that
wording in Item 5, page 10, to state~: "Quito Road should be studied to
determine the .t~pe of.improyement required.~ Mayor Smith suggested the
addition:C.'?'to maximize traffic safeZty and mihimize traffic flow."
The City Manager indicated this wording would be inserted in No. 8, as
A citizen commented concerning the matter of slope density. He was con~
cerned with the fact that _several pe__opl? ~n the commun~_ty have co~~[i~ted
the person who has been holding thi~ land would never s~e th~ ~r'~e~s.
Mayor Smith po{n[ed out that this city, along with all other cities that
have, hillside areas are in a much different position than a few years ago
with regard to development of hills~ He indicated there were a number of
· problems which were costing the~H~%r~sid~ts.and ~he_~i~oa substantial
amount of money. Mayor Smith in~i~l~d thfS is weighed against the arguments
of the slope density issue, and thi~ is the balance.
Mr. Weir indicated th§t;at the ~revious meeting it had been suggested some
sort of,direction be given to the Planning Commission developing a slope
density ordinance.
Mayor Smith stated that this direction was given tothe Planning Commission
and could be formalized in a motiomor resolution~ if necessary.
It was moved by Councilman Bridges ~nd seconded by Councilman Brigham the
public hearing be closed. The motion was carried. The public hearing was
closed at 8:50 P.M.
It was moved by Councilman Bridges and seconded by Councilman Brigham that
preliminary approval be given to the GeneralsPlan OB~ectives~ Policies~ Actions
as recommended by the Planning Commission and revised this evening.,by the City
Council. The motion was carried.

The above actions'will be memorialized in the form of a resolution ~obe
drafted by the City Attorney and presented at the next meeting of the City-
Council.
The consultant advised the maps would be made available to the public in the

Consideration of an EightTMonth Extension of Ordinance No. 3-E.12, an Emergency
Ordinance Defining and Establishing Hazardous Fire Areas within Said City and
.-Providing for Fire-Retardant Roof ~overings on All Buildings Hereafter Erected
or Constructed within Said Hazardous Fire Areas. ·
Ordinance No. 3-E.12-1 Cont'd.
The City Manager explained' this was erroneously scheduled for a public
hearing in that it does not apply~to the Zoning Ordinance, but it just a
designation of hazardous fire areas. Therefore, it is not necessary to
7'~1. take any further action regarding!'the existing emergency ordinance per-
taining to hazardous fire areasj~ and the ordinance could remain in effect
untii the Council takes action regarding'the Uniform Fire Code.
Seeing no objections, the Mayor indicated this item wouldgo off the agenda.
VI, ADMINIS'TRATIVE MATTERS
A. ' MAYOR
1. Suggestion that a formbe devfsed Yor making application to fill
commission vacancies. The City Manager advised this formwould
beprepare~ and made available to the public during the next week.
2. Requested City Manager explor~ some ideas regarding C~Yf~a[lng arrange-
ment in the Council Chambers. City Manager adv~'sed ~{s'~lH '~e done.
B. FINANCE
1. Payment, of Claims
- It was moved 'byCouncilman Kraus and seconded by Councilman Diridon
disbursements 19235 through 1~295 be approved and the Mayor be authorized
to sign the warrants. The motion was carried.
C. COUNC{L AND COMMISSION REPORTS
1. Parks' and Recreation Commission - Recommendation Re: Proposal for
State Beach, Park, Recreation and Historical Facili[ies Bond Act of 1974.
The City Manager indicated that at the previous City Council Meeting
(April 17, 1974) the CouncilSadopted a Resolution Endorsing the Passage
of the State Beach, Park, Recreational and Historical Facilities Bond
Act. The 'recommended action~at this point would be to endorse the pro-
posal indicating the City's areas of interest in terms of its allocation
of funds from the State. The recommended project would be acquisition
and development of Congress Springs Park, with the alternate project
being acquisition and development of Foothill Park.
It was moved by Councilman D{ridon and seconded by Councilman Kraus
that the Council endorse the!proposal as submitted by the Parks 'and
Recreation Cormnission. The motion was carried.

· CommuniCation from the Los Gatos
Town Council, Urging the County~to Provide Full Services of the Fire
Marshall's Office to'~All Citieson a County-Wide Basis.
The City Manager suggested the Council take no action regarding this
issue at-this time, and furthersevaluation be given following a study
by the County Executive~s Office.
2. Third Quarter Crime Repor[ (Apri~ 26, 1974)
Councilman Kraus pointed out several discrepancies.in the figures con-
tained within the report. The City Manager indicated he would present
a corrected report at the next Committee of the Whole Meeting.
2. Proposed modifications to ABe2040 - Bay Area Planning Agency
The City Manager indicated' the 'proposed modifications, as follows:
a)' Provide for an interim governing body and a procedure for
establishing a permanent goVerning'body.
.. b) In June, 1978 hold an electiion to establish a ~ermanent
governiBg body.
He explained that the governing board would be composed o£ 38 members;
there would be two representatives of independent special districts
havingterritory.in a single county and two representatives of independent
special districts having territory in more than one county~
It was'the consensu~ oflthe CoUncil was that there would be a positive
respons~ to these proposed modifications.
3. Announced that on May 8th the Board oft. Supervisors would be holding a
hearing regarding the CS Zoning Ordinance,~and he would possibly have a
report to the CohBc~l at the next City Council Meeting.
· VII ~ COMMUNICAT IONS
A. WRITTEN
1. Z. ~ettler Greely, Chairman, Greater Prospect Hills Homeowners
Association, regarding the:C~ty,~ ~sition pertaining to the
Bohlman-McG~ll land division in the sphere of influence. - Noted
'and filed.
2. Anthony T. Cocciardi, 2263i Mount Eden Road, urging the Council
to consider the proposed s~udy of the lower foothill area to the west
o£ Saratoga-Sunnyvale Road~ - Noted and filed.
3. Judy Newton, Secretary, Saratoga Horse Lover's Association, 14300
Maclay Court, voicing concern about the proposed fence around the
West Valley College campus. - The City Manager advised he would have
a report regarding this issue in 2' to 4 weeks.
4. Sue Jennings.,.Community Le~der, Foothill 4-H Club, expressing concern
about the blocking of the West Valley perimeter horse 'trail. - Noted
and filed.. City Manager 'to report in 2 to 4 weeks.
B. ORAL
1. Lynn Belanger, Planning Commiss'ion, requesting the Council consider
persuing other avendes to encou,rage West Valley Coltege's cooperation'
in those matters which have an impact on the community.
Mayor Smith suggested a joint.meeting between the two governing boards
in the near future. This was agreeable to the Council.
VIII. ADJOURNMENT
It was moved by Councilman Bridges and s'econded by Councilman Brigham the
meeting be adjourned-to~an Executive Session.-The motion was carried. The
meetxng was adjourned at 9:2~ P.M.
