PLACE: Saratoga City Council Chambers, 13777 Fruitvale Ave., S~atoga, Calif. TYPE: Regular Meeting I. ORGANIZATION A. ROLL CALL Present: Councilmen Brigham, Diridon, Kraus and Bridges Absent: None B. MINUTES It was moved by Councilman Kraus and seconded by Councilman Brigham the mihutes of November 20, 1974, Decembers4, 1974, December 7, 1974, and December 10, 1974, be approved. The motion was carried. II. BIDS AND CONTRACTS A. CALIFORNIA DENTAL SERVICE AGREEMENT A~reement Between the City of Saratoga and California Dental Service for Benefits to Employees and Dependents It was moved by Councilman Diridon and seconded by Councilman Kraus the Mayor be~authorized to execute the agreement. The motion was carried. B. EXTENSION OF AGREEMENT WITH MANAGING GARDENER FOR COMMUNITY GARDEN It was moved by Councilman Diridon and seconded by Councilman Kraus the Managing Gardener Agreement be extended to June 30, 1975. The motion was carried. III. PETITIONS, ORDINANCES AND FORMAL RESOLUTIONS A. RESOLUTION NO. 494-1 Resolution of the City Council of the City of Sa'rato~a Amending Resolution No. 494, Settin~ Forth Guidelines to Identify AffirmativelActi6n to be Taken by Contractors on City Projects to Provide Full Employment Opportunity for Minorities and Women It was moved by CouncilmanKraus and seconded by Councilman Diridon Resolution No. 494-1-be. adopted. The motion was carried. B. RESOLUTION NO. 717 Resolution of the City Council of the City of Saratoga Adopting an Affirmative Action Policy for City Employment in the City of Saratoga It was moved by Councilman Brigham and seconded by Coun(ilman Diridon Resolution No. 717 be adopted. The motion was carried. C. ORDINANCE NO. 51 (Second Reading) Ordinance Calling a Special Municipal Bond Election for the Purpose of Su~mittin~.~to the Electors of the City of Saratoga the Measure of In(~i~.,~. a B~nded~I, ndebtedness of Said City for the Acquisition, Construction and Completion of Public Library, etc. ORDINANCE NO. 51 (Cont'd~) · - It was moved by Councilman Kraus ~nd seconded byeCouncilman Brigham Ordinance No. 51 be adoptedand.the reading o~ the.ordinance be waived. RESOLUTION-NO. 718 Resolution of the City Council of-the City of Saratoq~ Call.inq a Special Maximum Property Tax Rate ElectiOn and~Requestin9 the Board of Supervisors of Santa Clara County to Provide the Services',of the Registrar of Voters for a Mailed Ballot Special Election on March 4, '1975 It was moved by Councilman Brigham and seconded by Councilman Kraus Resolution No. 718 be adopted. The motion was carried. E. RESOLUTION NO. MV-53.1. C e'Tal t o ' 'T icycle Lanes' on Certain-Ci ty Streets . _..~ It was moved by Councilman Diridon and seconded by Councilman Brigham Resolution No. MV-53.1 be adopted. The motion was carried, 3 to 1 in favor, Councilman Kraus votingin opposition. · F. RESOLUTION NO. MV-89 Resolution Prohibiting "U Turns" at VariOus Signalized Intersection~ in the City of Saratoga It was moved by Councilman Brigham and seconded by Cognci!~an Kraus Resolution No. M~-89 be adopted. The motion was carried. G. RESOLUTION NO. 719 A Resolution of the City Council o'f the City of Saratoga Commendin9 Jerome A. Smith for His Contributions to All Saratogans It was moved by Councilman Bridges and seconded by Councilman Bribham Resolution No. 719 be adopted. Th~ motion was carried. IV. SUBDIVISIONS, BUILDING SITES AND. ZONING REQUESTS A. SDR-1137 FREDERICK KEEP, GARROD ROAD, 1 LOT It was moved by COuncilman Kraus and seconded by Councilman B~igham Resolution SDR-1137-1, granting Final Building Site ApprOval, be.adopted. The motion was carried. B. SDR-1048 DAVID PIDWELL, CANYON VIEW DRIVE It was moved by Councilman Brigham and seconded by~ Councilman Kraus the request for extension of Final Building Site Approval Agreement be granted, allowing Agreement to expire on DeCember 5, 1975. 'The motion was carried. V. PUBLIC HEARINGS A. NUISANCE ABATEMENT (Cont'd. 11/6/74)- ProRertX at 12175-12241Saratoga-Sunnyvale Roa~ an~ 20401Miljevich Drive Mayor Bridges re-opened ~he public hearing at 8:09 p.m. The City Manager explained that this matter was continued on November 6, 1974, to allow the owner of these (~t]~'~take Ste'ps to eliminate some of the pro~je~the City felt were caus'i~g a~public nuisance. He then intro- duced Mr. Upson, the City's Code Enforcement Officer, and asked him to bring the Council up to date on the events since that time. NUISANCE ABATEMENT ( Cont' d. ) Mr. Upson reported that things have been progressing satisfactorily relevent to these two properties. He indi!cated that the house trai'ler located at the rear of the property at 12175~12241 Sarat6ga-Sunnyvale Road has been -'vacated, and Mr. Spaich has indicated the trailer would be moved in the next few days. He indicated that the miscellaneous pieces of farm equipment have been re- moved, and the owner is in the process of remov!ng the firewood which had previously been sold on this property. With regard to the problem at 'Hanson Motors, Mr. Upson~,t~pthe previously reported 32 automobiles has been reduced to 17, 10 of whi~h~re~inoperative and are stored behind the garage. Mr. Upson explained the reason the auto- mobiles are kept"¥n front of the garage is because of vandalism; therefore, Mr. Hanson is asking~the Counci~'s cooperation in allowing to,continue this practice on a rotation basis. Mr. Upson commented, however, there is a provision in the City Code that vehicles must be kept out of public view. Mr. Upson commented, also, that there is the problem of the septic tanks relevant to the two houses located on this property. He indicated that Mr. Spaich has worked wi~h the Health.Department and has agreed to connect these two homes with the main sewer line. ,He indicated he felt this was progressing very well and the problem should be cleaned up in the very near future. Mr. Upson then reported'on the property at 20401Miljevich Drive, indicating that the problem of the chickens has been removed, as well as the problem of the inoperative vehicles stored on the property, and the sta~king of fruit crates has been corrected. He indicated, however, that the City Attorney has determined that the property l~ne in question is in fact the rear property line, in which case, Mr. Spaich would ,be required-to move the structure so that it is 25 feet from the rear property l'ine. !Mr. Spaich maintains, how- ever, this is the side'property line. Mr. Upson explained that this structure in its present location obstructs the view of a fami'ly on Kilbride Court, and also, permits for plumbing,electricity,. moving, etc. have not been obtained to allow this structure to remain'on this property. The City Manager indicated it would be~t'aff'L/'~(~o~ndation to separate these two issues, continuing the public hearing ~6'~t~roperty at 12175- 12241 Saratoga-Sunnyvale Road to the regular meeting on January 15, 1975, at' which time a progress report would again be presented relevant to the sewer hookup, moving of the mobile home, the Hanson Motor problem, etc., and treating the Mi.ljevich Drive property differently. He suggested that if the problems on this property are not resolved within a stated period of time, the City Attorney be directed to take the-necessary legal steps to remove the problems existing on this property? Councilman Kraus conm~ented that he didn't feel'it would be unreasonable for Mr. Hanson to screen the inoperative automobiles on this property from the public view, indicating he would rather look at a fence than all of the ol~ cars being stored on this property.' Mr. Spaich ad~essed the Council and'stated it was his intention to ask Mr. Hanson to remove all of the inoperative cars; however, if it was the Council's desire to install a fence, he wou3d compl:y with this request. He also assured that the house trailer would be removed during the next week. Mr. Spaich commented he felt the structure on the Mi~ljevich Drive ~roperty could be easily moved to conform with regulations; however, it was :his opinion the property line in question was the side property line, which would allow the structure to remain where it is. Donald Miller, 20399 Kilb~ide Ct., commented that this building appeared almost overnight, and no permits h~d been obtained to move~6/~h~ ~h~i.~ building, and he ~felt to move it to conform~h~h~ ~d~~l~ also be wrong. - 3- · NUISANCE ABATEMENT Cont!d.) It was moved by Councilman Diridon and .seconde~by.Councilman Brig~am~the hearing on the propertylat~12175~12241'SaratOga~S6nnyvale Road be continued to the regular City Council Meeting of January 15, 1975, and an up-dated progress report be heard at that time; .also, the public hearing on the property at 20401Mi]jevich Drive be closed and the ClityAttorney be authorized to take whatever action necessary to bring the violations into conformance with the City Code. ~he motion was carried. Director of Public Work9 -.Report Re: Saratoqa Gardens Petition .. Mr. Shook reported the staff had met with approximately 40 to 50 residents of the Saratoga Gardens Area, at which time alternative solutions to the indicated traffic problems were discussed. However, no consensus was reached on these alternatives; th.erefore; it was' suggested input from this meet'ing be taken into consideration and a recommendation be prepared for the meeting of January 7, 1975. 4. Director of Public Works - Report Re: Hydrant on Al-lendale Ave. Near Community Center It was moved by Councilman Kraus and seconded by Councilman Diridon the fire hydrant on Allendale Ave. be approved, in the amount of $7,380.00 (Warrant No. 20565) and the Saratoga School District be allowed to reim- burse the City one-third of this amount. The motion was carried. 5. Director of Public Works Ordinance'No. 52 - An O~di~ance.Amending Chapter 9 of the Saratoga City Code and Establishing and/or Re-establishing Certain Public Streets~ and Portion of. PQblic Streets in 25 M.P.H. . and 35 M.P.H. Speed Zones It was moved by Councilman Diridon and seconded by Councilman Brignam Ordinance No. 52 be introduced and the reading waived. The motion was carried. 6. Director of Planning - Report Re: E.I.R.~ West Valley College Parking Lot No. 3 Planning Director's comments in December 10,-1974 memorandum to be related to Governing Board at West Valley College. E. CITY MANAGER 1. Recommendation Re: Annual Contribution to Chamber of Commerce - The City Manager announced a discussion of this matter would be continued C__b~'~6~t~6~ ~he Whole Meeting in January. 2. Tax Rate Statement for Proposed Library Bond Issue~_~was moved by Councilman Diridon and sec'onded by Councilman Kraus the Statement be submitted to the County Registrar of Voters for inclusion in the sample ballot, and if legally oossible, numbers 1 and 3 be reversed,-placing No. 3 first in sequence. The'motion was carried. 3. Report Re: Communication from William Paul Walter, 6089 Wellfleet Way,. Jan Jose (Con',t. 11/20/74) - ~he Council heard comments from Mr. Walter regarding this matter; however, no specific recommendation was presented.
