ROLL CALL Present: Councilmen Kraus, Corr, Matteoni, Bridges Absent: Councilman Brigham B. MINUTES It was moved by Councilman Kraus and seconded by Councilwoman Corr the minutes of September 3, 1975 and August 26,1975 be approved, and the reading be waived. The motion was carried. II. BIDS AND CONTRACTS A. ANNUAL STREET STRIPING CONTRACT It was moved by Councilman Kraus and seconded by Councilman Matteoni the staff be authorized to advertise for bids on this contract. The motion was carried. ~ B. CROP AGREEMENT (Renewal) Agreement Between the City of SaratOga and George Wightman for Cultivating and Harvesting of Crops on 4.11 Acres of Real Property Located on Saratoga and Fruitvale Avenues in the City of Saratoga It was moved by Councilman Matteoni and seconded by Councilman Kraus the extension of this Crop Agreement through the 1976-77 crop years be approved. The motion was carried. III. PETITIONS, ORDINANCES AND FORMAL RESOLUTIONS A. RESOLUTION NO. MV-IO0 Resolution Designating the Intersection of Glen Brae Drive and Via Real Drive as a~Stop Intersection It was moved by Councilman Matteoni and seconded by Councilman Kraus Resolution MV-IO0 be adopted. The motion was carried. B. Approval of Proposed Capital Improvement Program for 1975-76 through 1977-78 The Council discussed some of the questions raised at the September 9th Committee of the Whole Meeting, as well as some suggestions by Councilman Brigham, including the following: Inclusion of funds for paths along Quito Road (as part of Quito- Pollard intersection improvements); decreasing funds for quito Road bridge improve- ments from $100,000 to $50,000; fund reserve for Reid Lane-Highway 9 signal ~h~'~.improvement; McWilliams/Swannee Building site improvements; question if quito- McCoy signal should remain in the budget; listing of Arco site demolition for 1976-77, rather than 1975-76 fiscal year; and panel lighting in Civic Theatre. Following some discussion of these ½uggestions, it was moved by Councilman Kraus and seconded by Councilwoman Corr approval of the 1975-76 through1977-78 Capital Improvement Program, with the following modifications: l) Deletion of Quito- McCoy signal program; 2) Addition of $30,000 contingency funds for the signal at Saratoga-Sunnyvale Road and Reid Lane; and 3) Include Prospect Road beauti- fication Project with the list of unfunded items in back of the budget. The motion was carried. IV. SUBDIVISIONS, BUILDING SITES AND ZONING REQUESTS A. AUTHORIZE MAYOR TO EXECUTE AGREEMENT FOR EINAL BUILDING SITE APPROVAL 1. SDR-1143 W. It was moved by Councilman Kraus and seconded by Councilwoman Corr the Mayor be authorized to execute the Building Site Approval Agreement. The motion was carried. B. TRACT 5179 STONESON DEVELOPMENT, STONERIDGE DRIVE It was moved by Councilman Kraus and seconded by Councilwoman Corr improve- ments be accepted for construction only. The motion was carried. C. TRACT 5384 JAMES W. DAY, RANCHO LAS CIMAS WAY It was moved by Councilman Kraus and seconded by Councilwoman Corr improve- ments be accepted for construction only. The motion was carried. D. TRACT 5631 OSTERLUND ENTERPRI, SES, INC., SAN PALO CT. It was moved by Councilman Kraus and seconded by Councilwoman Corr improve- ments be accepted for construction only. The motion was carried. E. TRACT 2577 SHELLEY WILLIAMS, BRANDYWINE DRIVE It was moved'by Councilman Kraus and seconded by Councilwoman Corr Resolution 36-B-149, Accepting Dedication of Streets, be adopted, and the bonds released. The motion was carried. F. TRACT 3942 RUSSELL BATE, VERDE VISTA CT. It was moved by Councilman Kraus and seconded by Councilwoman Corr Resolution 36-B-150, Accepting Dedication of Streets, be adopted, and the bonds released. The motion was carried. G. TRACT 4742 SARATOGA FOOTHILLS DEVELOPMENT CORP., MICHAELS DRIVE It was moved by Councilman Kraus and seconded by Councilwoman Corr the mo mment bond for this tract~be released. The motion was carried. H. TRACT 4742 SARATOGA FOOTHILLS DEVELOPMENT CORP., MICHAELS DR. It was moved by Councilman Kraus,and seconded by Councilwoman Corr the monument bond for this tract be released. The motion was carried. I. TRACT 5384 JAMES W. DAY CONSTRUCTION CO., INC., RANCHO LAS CIMAS WAY It was moved by Councilman Kraus and seconded by Councilwoman Corr the monument bond for this tract be released. The motion was carried. J. TRACT 5583 SARATOGA FOOTHILLS DEVELOPMENT CORP., BLACK WALNUT CT. It was moved by Councilman Kraus and seconded by Councilwoman Corr the monument bond for this tract be released. The motion was carried. K. TRACT 5631 C & I DEVELOPMENT CO. #4, RADOYKA DR. & SAN PALO CT. It was moved by Councilman Kraus and seconded by CouncilWoman Corr the monument bond for this tract be released. The motion was carried. V. PUBLIC HEARINGS None. . _ - 2 - VI. ADMINISTRATIVE ~TTERS A. MAYOR 1. The Mayor announced an Executive Session following this meeting-for discussion of potential litigation. B. FINANCE 1. Payment of Claims It was moved by Councilman Kraus and seconded by Councilwoman Corr the list of disbursements, 21945 through 21999, be approved, and the Mayor be authorized to sign the warrants. The motion was carried. 2. City Clerk's Financial Report - Noted and filed. 3. City Treasurer's Report - Noted and filed. C. COUNCIL AND COMMISSION REPORTS 1. Planning Commission - Recommendation Re: Capital Improvement Program This recommendation to include the Prospect Road Beautification Project as an unfunded item in the Capital Improvement Program was noted in the earlier discussion and action regarding the approval of the 1~975-76 through 1977-78 Capital Improvement Program. 2. Parks and Recreation Commission.- Recommendation Re: Support of U.S. House of Representatives Bill 1049 to Establish a Program for the Prevention and Control of Dutch Elm Disease. It was moved by Councilman Kraus and seconded by Councilwoman Corr to support U.S. House Bill 1049. The motion was carried. D.DEPARTMENT HEADS AND OFFICERS No reports. E.CITY MANAGER 1. Report on Cost Benefit Study Re:' City Services - Parker Ranch E.I.R. In his attempt to analyze cost data as part of the Parker Ranch E.I.R., the City Manager indicated this information would accomplish the following: 1) Update the numbers in the addendum report by .the Center for Environmental Design. He explained they have not attempted to carry those figures any further than updating them, in that they question the fact ~ O~i~i ~l'~u r~ "26' n"6~r~i at~'~G~n~a~ t~' ~ ~s s~d~oi~g revenues. =-"! This was comp6~"~ ~611ows: Streets - $2,660 per mi"l~;. $4,203 per year, add 25% for hill area = $5,253 per year. Storm Drains - $1,000 per mile; $2,700 pe~ year; add 25% for~h~ll area - $3,375 per year. He reported that based on these figures, approximately $3,575 in gas tax monies would return to the City annually as a result of the development. It was indicated this information would be further considered at the continued public hearing on the Parker Ranch E.I.R. on October 1, 1975. -3- 2. Santa Clara Valley Water District North Central Zone Flood Control Advisory Committee It was moved by Councilman Matteoni and seconded by Councilwoman Corr to re-appoint Robert S. Shook as the City's representative to the North Central Zone Flood Control Advisory Con~nittee. The motion was carried. VII. COMMUNICATIONS A. WRITTEN 1. Judge and Mrs. John S. McInerny, 19175 Monte Vista Drive, protesting actions of the Building InspectOr in granting variances from the Swimming Pool Fencing Ordinance.'- City Manager directed to look into " the~v~iance process outlined i~ Ordinance 38.59, and report at a I~o~.~~~of ~he Whole Meeting in October. 2. George W. Woodard, President, American Indian Council of Santa Clara Valley, Inc., requesting the City Council issue a Use Permit to establish an indian encampment during a two-week period to commemorate next year's Bicentennial Celebration. It was moved by Councilman Matteoni and seconded by Councilwoman Corr to refer this matter to the Planning Commission for consideration in issuing a Use Permit for use of the Fremont High School District Site, with the recommendation that the Zoning Ordinance be interpreted to tie this activity to the education aspect indicated in the Ordinance. The motion was carried. 3. Copy of letter addressed to the Planning Commission from Mr. and Mrs. D. McKenzie, 18680 Vessing Road, concerning Resolution 740 (establishing pre- liminary standards of hillside development). - Noted and. filed. 4. Mr. and Mrs. Andrew Beverett, 19597 Via Monte Drive, encouraging the start of construction of the new library. - Noted and filed; City Manager to respond. 5. Mrs. John McBryan, 20275 La Paloma Ave., Re: Delays in starting construction of new library. - Noted and filed; City Manager to respond. 6.
