Counci'lman Bridges, Brigham, Kraus, Corr, Matteoni Absent: None II. AGREEMENT WITH OPTIMUM SYSTEMS, I'NC. TO PROVIDE ELECTRONIC DATA PROCESSING SERVICES n t e contract computer The Acting City Manager submitted a report. o h proposed for and related services with Optimum Systems, Inc. He reviewed the salient points, ~ich were: An aggregate amount for the first 12 months operation, based on stated volumes specified ina letter in August 1974 from the Director of Municipal Systems of Optimum Systems, Inc., not to exceed $9 ;600; that unit prices would not be an excess of the amounts specified in Exhibit "B" for the duration of the contract; that such guaranteed prices would remain'in effect for 60 months; and the retention of the right to terminate the agreement upon 90 days prior written notice to Optimum Systems, Inc. Councilman Kraus indicated that he had~reviewed the O.S.I. payroll and financial system, and' was satisfied that it would be appropriate for the operations at the City. He also expressed satisfaction with the paragraphs in the agreement relating to .the confidentiality of the data. Councilman Brigham stated that he had reviewed the financial systems operating manual, and was satisfied with the re~Qrt' that would be produced. It was moved by Councilman Brigham and seconded by Councilwoman Corr that the Mayor be authOrized'to sign the agreement for computer and related services with Optimum Systems, Inc., subject to approval~ by the City Attorney of some re-wording in certain sections in the contract dealing with the limitations of liability, indemnification and arbitration. The motion was carried unanimously. III. CONSIDERATION OF AN AGREEMENT BETWEEN .THE CITY OF SARATOGA AND DR. NAT ABRAMS FOR PURCHASE OF LIBRARY SITE The City Manager reported that an agreement had not been prepared between Dr. Abrams and the City for action by the City Counci'l at the meeting. He indicated that a written agreement would be ready for the regular City Council meeting on October 15, 1975. He also stated that there was still slight disagreement concerning the exact location~of the property lines along the creek and adjacent to!the'two lots off Cox Avenue. Martha Beverett, representing the Friends of the Library, indicated that they. were most anxious to get on with the project. She stated that ~ey 'have w~ited so long. and that she is beginning to d~spair that there will ever be a projeet. In further clarificati on of the sti pul ati ons of the agreement, Councilman Matteoni indicated that the property owner would be required to extend all utilities to the site, as well as the paving of Saratoga Creek Drive and McFarland Drive. Marlene Duffin,. representing the American Association of University Women, also stated that they were anxious to proceed with the project as soon as possible. Councilman Matteoni said that he wanted to exhaust all the possibilities with Dr. Abrams before culminating negotiations. Mayor Bridges stated that there was a strong committment on his part .to settle on the Saratoga Avenue-Cox Avenue site. He stated that it is closest to the site that is being closed down (Quito Library), nearest to the population center of the city, and the citizens' first choice. He felt that it should be located somewhere in that area, and that this was the only available site. It was the consensus of the Council to consider the agreement at the October 15, 1975 Council Meeting. IV. CONSIDERATION OF IMPACT OF APARTMENT CONVERSIONS TO CONDOMINIUMS The Acting City Manager presented a report recapitulating the existing rental units and condominium units in'the City of Saratoga atpresent. The Council was presented with an ordinance,"Placing a Moratorium on Condomi!nium and Other Community Housing Conversions from Rental Housing in Said City'~, which is an emergency ordinance declaring a moratorium on apartment conversions to condo- miniums. The Planning Director stated that the Saratoga Creekside application for apart- ment conversion has had two hearings before the Planning Commission, and is coming up for consideration at'the Planning Commission'Meeting on October 8, 1975. However, it is unlikely that the Planning Commission.will take any action. Robert Farri'll, Gatehouse CondominiOms, Unit#Z2, spoke in favor of the proposed conversion. He indicated that'in the Gatehouse conversion, a number of individuals were allowed to continue renting. He estimated that one-third of the residents at the Gatehouse were renting. Mrs. Carin, 14333 Saratoga Ave., (Saratoga Creekside Apts.~ stated that she was quite upset about the proposed conversion. She recently moved from Virginia and began renting at Saratoga Creekside precisely because she no longer wished to be a homeowner. She was not anxious to purchase a unit because of the condition that you must buy the unit "as is", without knowing fully about the roofing, heating, air conditioning, etc. She also wondered how a senior citizen could get.a mortgate for a house~at their age, and the sense of freedom that one has in owning an apartment unit. Mrs. Gerber, also residing at the Saratoga Creekside Apartments, concurred in the comments made'by Mrs. Carin. It was the consensus of the Council to set the emergency ordinance for public hearing at the regularly scheduled meeting on October 15, 1975. It was also stipulated that all affected persons be' notified of thins public hearing. V. ADJOURNMENT It was moved by Councilwoman Corr and seconded byCouncil'm~n~Kraus that the meeting be adjourned to an Executive Session to discuss pending litigation. The motion was carried.
