ROLL CALL Present: Mayor Bridges, Coucilmen Brigham, Corr, Kraus, Matteoni Absent: None B. CONSIDERATION OF POSSIBLE LITI. C~TION RE: ACTION OF THE 'GOVERNING BOARD OF WEST VALLEY COLLEGE APPROVING FINAL PLANS AND AUTHORIZING THE CALL FOR CONSTRUCTION BIDS. FOR THE OUTDOOR BLEACHERS, LIGHTING, SKI HILL LIGHTING AND APPUI~TENANCES PROJECT The City Manager indicated that the'City Council had requested that an Adjourned Regular Meeting be scheduled for November 23rd prior to their Committee of the Whole at itst Regular Meeting on Nove~beri.17, 1976. The purpose V~s tO hear a report from the City Manager concern- ing the action of the West Val~ley Governing Board on the questioned project.. The City Manage~ indicated that the Governing Board had adopted a Resolution at its~ meeting on Novembe~ 18th, approving the final plans and specifications and authorizing a call for bids for the West Valley College outdoor bl'eachers, lighting, ski hill lighting and appurtenances project. H~ further reported that this project was approved on a 5 t6 2 vote by the members of the Governing Board. The City Manager furthe~ reported that the Governing Board had further considered a vote to ~xempt themselves from the Citys current "Use Permit" and any future Use Permits, however, this vote which required a two-thirds vote failed 4 to 3. '~' ~After several questions by the City Council, it was moved by Councilmen Brigham 'and seconded jby Councilman Kraus that the City Attorney be authorized '~o proceed under the existing petition for writ~of mandate "'pertaining to the Environmental Impact Report", and to obtain a ~tate of proceedings for an injunction against any action and further- ance of the West Valley Stadium Project as previously described by the City Manager pending an alternate decision on the merits. The motion was carried unanimously. It was moved by Councilman Brigham and seconded by Councilman Kraus that the City Attorney take nedessary action to contest the violation of the City Zoning Ordinance particularly the violation of the Use Permit pertaining tothe construction of a full-scale stadium for intercollegiate activities.
