ROLL CALL Present: Councilmen Brigham, K~aus, Corr, Bridges Absent: Councilman Matteoni (arrived later) B. MINUTES -Councilwoman Corr requested a modification on page 5 of. the December 1, 1976 minutes relevant to thediscussion on Ordinance'No. 38.72:- She 'i~aicated 'th~s~"~6~l~'i~k~'i~6~e~s~ that Section 203(c)~d~d not not speak to 't~e"~r~i~ai~compl~i6t' 6r6Ught befqre the Council relevant to disturbance by motorbikes on. private roads. It was then moved by CouncilmanBrigham and seconded by'Councilman Kraus the minutes of November 17, December 23, and December 1 (as corrected) be approved. The motion was carried. II. CONSENT CALENDAR · A. COMPOSITION OF CONSENT CALENDAR It was moved by Councilman Kraus and seconded by Councilman Brigham the Consent Calendar composition Be approved.. The motion was carried. B. ITEMS FOR CONSENT CALENDAR 1. Tract 5631, Osterlund Enterprises, San PalO Court "' Final Acceptance and Release of Bond (Adopt Resolution 36-B-172 2. Payment of claims 3..city Treasurer's Report 4. City Clerk's Financial Report It was moved by Councilman Brigham and seconded by Councilman Kraus the 'items for Consent Calendar be a~proved. The motion was carried. III. BIDS AND CONTRACTS' A. AGREEMENT BETWEEN CITY OF SARATOGA AND MECHANICS RESEARCH, INC. RE: APPLICATION TO ERDA FOR DEMONSTRATION SOLAR HEATING AND COOLING PROJECT FOR SARATOGA COMMUNITY LIBRARY: It was moved by Councilman Kraus and seconded' by Councilman Brigham the B. PAYING AGENCY AGREEMENT BETWEEN CITY OF SARATOGA A~D BANK OF AMERICA NATIONAL TRUST AND SAVINGS ASSOCIATION It was moved by Cou milman Kraus and seconded by Councilman Brigham the agreement be approved., and the Mayor be authorized to execute same. The motion was carried unanimously. .. IV. PETITIONS, ORDINANCES AND RESOLUTIONS A. RESOLUTION NO. 798 ~ .. Resolution Commending the Saratoga Bicentennial Committee It was moved by Councilman Brigham and seconded by Councilwoman Corr Resolution No. 798 be adopted. The motion was carried. V. SUBDIVISIONS, BUILDING SITES AND ZONING REQUESTS None. VIo PUBLIC HEARINGS None. VII. ADMINISTRATIVE MATTERS (Councilman Matteoni arrives) A. MAYOR B. COUNCIL AND COMMISSION REPORTS C. DEPARTMENT HEADS AND OFFICERS 1. Directo~ of Public Works Report Re: Hazardous Stairs at Guava Court ~Cont'd. 11/3/76) Mr. Shook, Oirecto~ of Public Works, explained that this report comes about as a result of a letter from Mrs. O'Leske, requesting that the City take some action with these stairs which are located between Guava Court and the Southern Pacific Railroad tracks. Councilman Kraus inquired i~ a barricade at the bottom of the stairs Would cause more problems. Mr. Shook commented that he felt a barricade would restrict the children'in getting off the bottom of the steps. Following additional discussion of this matter, the Mayor suggested the staff conduct a study to determine how many children use these\ stairs, and also, how much traffic goes through this area. The Council concurred in this suggestion. Mr.'.Shook indicated he would attempt to accomplish this in January, and have a report back to the Council in February. 2. Director of Public ~Jorks Report Re: Restricting Hours of Parking Along Allendale Ave. !MV-118) ~Cont'd. ll/17) Mr. Shook indicated that the staff h~s ~6~iT~e~e~~ ~.' [~l~req~'~ for exemption from the no parking requi~nt~'~' ar~a ~igna~e~~ by Resolution MV-118, and finds no justification in this exemption. Therefore, it was the staff's recommendation the request be denied. It was moved by Councilman Kraus and seconded by Councilwoman Corr the request for exemption from Resolution MV-118 be rejected. The motion was carried unanin~usly. 3. Director of Public Works Report Re: Mr. Wolff's Request to Review Policy on Repair of Sidewalks Damaged by Street Trees (Cont"d. 12/01) At the request of Mr. Wolff, this matter was continued to the January 5th meeting. - 2- D. CITY MANAGER 1. Claim Against the City Re: Complaint to Recover Damages InCurred to Dr. Andrew W. H..Wong'S Automobile on Sobey Road Mr. Shook indicated the City staff would bewilling to work with Mr. Rodriguez on an encroachment permit'basis to widen his driveway It was moved by Councilman Brigham and seconded by Councilman Kraus to deny this claim and refer it to the City's insurance carrier. The motion was carried unanimously. 2. Purchase of Land'on Central Park Site The City Manager advised that the City woul~ be closing escrow on Monday for purchase of the remaining piece of land on the Central Park site as a result of the bond sale for the proposed library. 3. Committee of the Whole Meeting - Tuesday, December 21st. ~..wa~ r~9ommended the~becember 21st Committee of~th~ Whole Meeting < be cancellie~. This was'~cc~Dt~l¥ to th6 C6~il'. VIII. COMMUNICATIONS A. WRITTEN 1. Jerry Kaufman, 12300 Radoyka Drive, requesting the City Council to reconsider his petition concerning "No Parking" signs in front of his home. It was moved by Councilman Kraus and seconded by Councilman Matteoni to adopt Resolution MV-119, Resolution Limiting Parking on~ portion of Radoyka Drive, and the resolution be modified to clarify that until the signs are installed designating No P~rking 8:00 a.m. to 7:00 p.m., the parkin limitation shall be "No Parking at Any Time". .~he~'6(i'6n~a~ ~Yrie~ ~ni~ously.~ 2. The City Council of the Cit9 of Chowchilla~ requesting the City of Saratoga's support of reform of the Criminal Justice System (Resolution 47-76) - The Council took no position On this resolution. 3. The City council of the city of Carson, requesting the City of Saratoga to adopt a resolution protesting the practice of th~ Department of Motor Vehicles-in selling n~mes and addresses of citizens upon request to any individual or company so requesting~ and urging repeal of the law authorizing t~is practice.(Resolution 76-220) It was moved by Councilman Kraus and seconded by Councilwoman Corr to support Resolution 76-220 of the City of Carsbn. The motion was carried unanimously. 4. Saint Andrews School, 13601Saratoga Avenue, thanking the City for its continued consideration'and efforts to solve the pedestrian safety problem at Saratoga and Fruitvale Avenues. - Noted and filed. 5. West Valley Youth Advisory Board, 348 North Santa Cruz Avenue, Los Gatos, recommending Joyce Sogg and Marlene Duffin be reappointed to the Board for another term of office, and the City Council appoint three new members to the Board. It was moved by Councilwoman Corr and seconded by Councilman Brigham to reappoint Joyce Sogg and Marlene Duffin to the West Valley Youth Advisory Board, and advertise for replacements for three board members. The City Council of the Cit~ of South E1 Monte, requesting the City of Saratoga's support of Resolution No. 76-1954, opposing the re- distribution of sales tax revenues on the basis of population. It was moved by ~ayor Brid~es and seconded by Councilman Kraus to ~ ~l~xpressing the Oppos~t~ view of this re~e~t. _!he ~mot~'~n was carried. 8. Orrick, Herrington, Rowley and Sutcliffe, Counselors and Attorneys at Law, enclosing final opinion on City of Saratoga 1976 Library Bonds. Noted and filed. B. ORAL IX. ADJOURNMENT It was moved by Councilman Kraus and seconded by Councilm~n Kraus the meeting be adjourned to Executive Session for the purpose of discussing potential litigation~6~S~e~i~~'~e reco~ened following Executive Session.
