TYPE: Adjourned Regular Meeting I. ROLL CALL Present: Councilmen Kalb, Corr, Kraus, Matteoni, Callon Absent: None II. CONSIDERATION OF ORDINANCE 38.85: AN URGENCY & EMERGENCY ORDINANCE OF THE CITY OF SARATOGA IMPOSING AN ALTERNATE SALES AND USE TAX ON CERTAIN TRANSACTIONS AND DECLARING THE URGENCY THEREOF (Cont'd. 6/21/78) The City Attorney pointed out a modification in Section 14-37, first line, to reflect "An excise tax . ", rather than "Any excise tax " It was moved by Councilwoman Corr and seconded by Councilman Kalb Ordinance 38.85 be introduced and adopted. The motion was carried unanimously. The City Clerk then proceeded to read the ordinance in full. III. FINAL MAP APPROVAL - TRACT. 6393, BRIAN KELLY, INC., GORDON KNAPP, INC., OAK CREEK INVESTMENTS It was moved by Councilwoman Callon and seconded by Councilwoman Corr the adoption of Resolution 861, deleting Condition 1 re- quiring a Landscape MaintenanCe Agreement. The motion was carried unanimous ly. IV. CONSIDERATION OF 1978-79 FISCAL YEAR OPERATING BUDGET (Cont'd. 6/21/78) A-.~__RESOLUTION 860, A RESOLUTION APPROVtNG BUDGET FOR FISCAL YEAR ~ 1978~79 B. RESOLUTION 780-4, A RESOLUTION ALTERING AND ESTABLISHING FEE SCHEDULE C.ORDINANCE 38.86, AN URGENCY AND EMERGENCY ORDINANCE OF THE CITY OF SARATOGA ESTABLISHING A' CONSTRUCTION. TAX Mr. Hendrickson, Assistant City Manager outlined some of the proposed~..b~'~r~g~'expe~d~tures for reduction and these were discussed by hhe ~Council. .He further advised that. the City has received information from the State rela~i~ze to distribution of State surplus monies. He explained that there are~.~three primary conditions to receiving these funds: 1) No salary increases may be granted to any local govern- ment employee in excess of the inc.rease to any state employee during 1978-79. 2) Police programs be maintained at the 1977-78 levels. 3) Requires the cities to expend at least 1/3 of the general fund reserves on hand as of July 1, 1978 in excess of 5% of the 77-78 revenues. Therefore, it is the sta~f's ~ecommendation to proceed with the budget process as prop6sed, making whatever cuts are. necessary. Mr..Hen~rickson then discussed those proposed personnel cuts, and also, what services would~be affected'with these cuts. He discussed Community.Center use by community oriented groups and the proposal of..only charging these groups for set uD fees and staff~pervision time. Sponza re: Co~uni~y Garden. 6)' Rear Admiral M~tcalf re: Hakone Gardens' The Mayor ~e=op.enedqthe public hearing at 8:28 P.M. Mr. Pasetta, 20251 Saratoga-Lo~s Gatos Road, addressed the Council co~enting that Hakone Gardens should not be considered in the same category as othe~ pa~ks. ;Mr. Pasetta was of the opinion expenses should be cut in other areas, i.e., removing la~ on planting strip on Saratoga Avehue and pla~ting ivy. He further · suggested [rying to inte~estYJapaa~a~A~rica~*d~fl6~i~'teasing the Garden and maintaining i[7~- ..... L -~ ........... ""~ ...... Mrs. Kocher, 15139 Park Drive, coaented that she believes every. effort should be made to not allow..funds to be taken from main- tenance of Hakone Gardens, and this should be one of the Council's priorities. John Foley, Mayor, City of Monte Sereno, urged that the Council continue to conduct inspection services for Monte Sereno. Charles Robbins, 19348 Monte Vista Drive, voiced his co~ents in support of continuing to maintain Hakone Gardens. Ann Peck, 14275 SaratOga Avenue, advised that her mother's kinder-. garten class for the past two years has spent every Tuesday in ApriY at Hakone Gardens as part of a Japanese cultural unit. She then read a letter written to Kathy Yoshomota from a third-grade student participating in a trip to Hakone Gardens. Ms.: Peck urged that the Council not close Hakone in.that it has been valuable to school children. Marlene Duffin, resident on Canyon View Drive, urged that the Coundil continue'to fund the Youth Service~Bureau. Ms~ LaGreen, 14500 Fru~t~ale AVenue, co~ented that' she worked many weekends this year at Hakone Gardens, and saw many people slow do~ and appreciate the unique beauty; therefore, Urged the Council's consideration in keeping the Garden open. - 2 - Pamela Nesbit, 15450 Pepper Lane, exprelssed comments in support of continued funding fo~ the Youth Service Bureau. Karen Bates, Springer Road, commented that 4,000 children in our area are being reached each year in the prevention program,.and only 7 percent of the children who go through the Youth Service Program end up in Juv~nile Hall. Therefore, she urged that the Council look at the Youth Service Bureau with a great deal of importance Mary Wade, Farwell Avenue, commented that $2,700 is such a small amount of money to keep the garden open 52 ~eeke~ds~y~r~'~Tand surely this can be found somewhere. Charles Griffin, 20365 Williams Avenue, addressed the Council on behalf of the Saratoga Community Gardens. He thanked the City Council for its continued funding of the project. However, they still are in the process of trying to recover-~h~=~B,O00 budget cut, and would appreciate it if the Council woUla~'donsider-an r~Y~i~;~'~'~i~-!remaining $1,000. ' Esther Lapar, Saratoga Community Garde~ Board, commented that they have been trying for weeks to find 'this ~m6~:j_~_~=f~ grants, and will definitely miss.the $5,000. r~! .............. · It was moved by Councilman Kalb and seconded by Councilwoman Callon the public hearing be closed. The motion was carried; the public hearing was closed at 8:44 P.M. Mr. Hendrickson explained that the maximum l~ss would be $380,500, and if using the $266,230 proposed reduction in services, along with $63~r00~carryover, this Would leave only $51,200 remaining to be f~U~h. If working towar'd the lower figure, $356,000, this would leave approximately $26,700 to be found. .Ifjzadditional revenues were .?~1~_~ approximately $12,000 could be added for inspection service fees; $100,000 for construction tax; and based on the C.P.I. increase since 1975, an increased busine'ss license tax bringihg approximately'S7,1500. It was moved by Councilwoman Corr and seconded.by Councilman Kalb to adopt Resolution 780-4, with a modification to Exhibit "A".to reflect "$45.00 for the firstS2,000 plus $5.00 for each additional $1,000 or fraction thereof, to and-.~including $10,000~; and a modification to Exhibit "C", itemize(2) to reflect 1.0¢/SF. The motion was carried 4 to 1, Councilwoman Callon in opposition due to concerns relevant~ to~l~i~oPb~fldi~g~f~&~"a~ '~h~'~ower end of the scale The Council then discussed proposed Ordinance 38.87, An Urgency and Emergency Ordinance of the City of Saratoga Increasing Certain~7~ ~B~In~s License Fees in Proportion to the Increase in the Con~'~ ~i~6~=fndek from December 1974 to March 1978, and Iraending Chapter 4 of the Saratoga Cit~ Code in Relation Thereto, It was moved by Councilwoman<~a~B>and seconded by Councilman~f~attedai to adopt Ordinance 38.87, mod{'f~ing Section 4-110.1 to refle~t~-a~~' increase to Classification "B'.' (peddlers and solicitors) and Classification "C"(2) (contractors), and this ordinance be read into the record at. the closing of the meeting this evening. The motion was carried unanimously. The Council then discussed the memorandum from t~e Director of Community Services setting forth an administrative policy to establish fees forzvarious pregrams at the Community Center. An objection was raised to imposing the $1.00 fee increase to teens, as well as any fee_Tincrease tO senior citizens. It was moved by Councilwoman Corr and seconded by Councilman Kalb to adopt new fee recbmmendati6ns as set forth in the memorandum dated June 27, 1978 from the~H{ty~r'°~i~d~l~ .... the p~oposed increase for th~"t&e~"~0g~.' unanimously. The Council then discussed the various pgssib~e'.~ition cutbacks. These would entail the following: Grading Inspector $24,500 Asst. Civil Engineer $22,900 (Traffic Engineer to be transferred into this position) Associate Planner $29,643 (Re~re~nts ~%.ti~~ - p~io~n;=_ /375"~im~'$1{ 80'0.~d~htfon)'~ Park Maintenance Man $15,'600" .... ' ....... '~ .... Mr. Hendrickson rec6mmended that if the Council eliminates the position of Assistant Civil Engineer, consideration be given to reinstating the CETA Personnel Aide at $3,700. The Council discussed the philosophy of cutting back in some of the Planning ~egulations as a result Of Jarvis-Gann. There was some controvers~ relevant to a 5 percent reduction in this area, versus a "'de-regulation" of certain~.~i'~h~'l~g~slation. Barbara Sampson~,~ Director of Community Services, outlined 'an option to keep Hakone Gardens open 7 days per week, reducing full-time staff and retaining part-time staff in order not to reduce the efficiency of the full-time staff. This would reduce the cost of keeping Hakone Gardens open and allow more ma~j.hours. t~d~'~a'i~'~7'~ (~h~e'~'f ~F~h'i~ and E1 Quito Parks ~ ' '- ...... Consideration was also given to reduction of the CETA parks position in the amount of $3,300. - 4 - Following considerable deliberation, it was the concensus of the Council to retain the positions of Grading Inspector, Park Maintenance' Man, Associate Planner at 3/5 time~T~'~'~ ~ ~ ~E~e~i~"~iI~'i i~is would amount to a total savli~g~ Of'~'!'~ '$~=6~O00,'~iR~f~di~F~dditions to revenue, and would allow $8p,000 to add inuotheritems proposed to be cut. The Council agreed to add the.following programs back intQ the budget: Youth Service Bureau $12j000' Uniform Allowances.(1/2) $ 2,500 Management Development $ 1,000 Tuition Reimbursement $ 700 It was further agreed to add back in 40 hours of supplemental daytime police service at $48,500. Councilman Kalb pointed ou~ that $31/~00 add~io~ ~v.~_u~_~.would be generated by~{~tl~i.n~tH~li~ic~hY~ugh additional '6~f~i~'f~de~it~'t~o ~e ~traf~i~ ~ety ~u~d; therefore, [~e Assistant Civil Engineer position could.be funded out of this amount. This would require removal of the CETA Engineering Aide position. This was agreeable to the Council. It was moved by .Councilwoman Corr and seconded by Councilman Kalb the adoption of 38.86, An Urgency and. Emergency Ordinance of the City of Saratoga Imposingan Excise Tax on Construction of Buildings and Mobile Home Lots in the City of Saratoga. The motion was carried unanimously.
