HUNZIKER RELATIVE.TO previous direction to obtain INCONSISTENCY WITH THE additional information, the City SAP~ATOGA GENERAL PLAN ON Manager presented a report, dated TENTATIVE MAP APPROVAL FOR 5/11/79, from-the Director of SD-1355 (HEBER TEERLINK, Public Works, relative to the MT EDEN ROAD) street design; a report, dated 5/11/79, relative to the "service level" concept of Pierce Road mentioned in the E.I.R.; a report giving five calculations of land . in. the uni~corporated area and number of units; and a report relating directly to Pierce Road. .Upon advise of the City Attorney, Councilwoman Callon abstained from voting on this issue, due to the fact she had received campaign .... contributions from Mr. Teerlink. Councilman Matteoni discussed his previous. abstent$on from voting on this issue, and it was determined he shouldI continue to abstain at this time. REQUEST FOR PAYMENT OF The Director of Public Works OFF-SITE STORM DRAIN COSTS presented his report dated SDR-1399, FRANK MATAS\ 5/9/79, recommending approval of the request and pay him by way of storm drain fee credits prior to final approval and balance of the cost of these facilities at. the time of construction acceptance. APPLICATION SDR-1393 The Mayor opened the public. hearing at 9:32 P.M. Sylvia Jean, 18600 Aspesi Drive, indicated she wohld be happy to answer any questions the Council might have relative to this matter. COuncilwoman Callon inquired.when the 15-foot easement came into being, or when the subdivision was created. Mrs. Jean indicated Mr. Trinidad of the Public Works Department pulled the Aspesi Drive subdivision map for her, and it was created in 1956'. She had also inquired when the 20-foot ordinance went into effect, and he had indicated this ~as a~opted in 1961. Councilman Kalb inquired of Mrs. Jean if she had looked at the Parker Ranch or other developments to see what types of driveways were used. Mrs. Jean replied that she did look; however, the maps she saw did not give any widths. M~yor Kraus asked if the,Jeans own this driveway into the property. Councilman Matteoni inquired of the Planning Director if he has any personal indication from the Fire Department regarding the acceptability of the adequacy of the drive with the turn-around. Mr. Robinson replied he does not have this information. Mayor Kraus inquiredif Mrs. Jean had approached the Water District. Mrs. Jean replied when they built their first h6me, the Water District had requested a certain amount of land along the creek. They could not understand why the District wanted so muchIla~d; however, they went along with them and gave them what they wanted. The Jeans had made it very clear to the District at that time that in the future their plan was to subdivide into one more home, and the District had indicated the easements would be included in the square'footage of lot; however, in the City of Saratoga it is excluded. They found out this time they were 1,800 or 2,000 short of having the 20,000, so she went back to the Water District with their engineer, and they explained it was not their intention originally to hamper the Jeans' effortslto subdivide, so the Water District gave them back what they needed. 7 V. Emmette Gatewood, 19384 Monte Vista Drive, commented he under- stands the Council saying there is room-for this ordinance to be revised. He feels in his particular case, he has an unusual hardship. He explained that the application that initially came in for sign review is the one on the roof edg& of the building. This sign faces toward the town square or the plaza down toward the intersection. Mr. Gatewood stated they were told, nevertheless, since they were taking the florist space, that they would have to have sign review.
