He explained that the Planning Commission denied this variance on the basis that it could not make the-necessarX findings to approve t~r_~'~t~d'V~iance. The Mayor opened the public hearing at 8:10 P.M. Ronald J. Becht, 13479 Alder Court, addressed the Council. He advised that the Council isviewing the only building on the site, as far as the jacuzzi area. On the other side of their building site, they are considering the possibility of enclosing the patio ±nto a garden room. Mayor Kraus inquired with regard to the issue of. the jacuzzi, if this is enclosed by the dark line of the overhead exhibit, and if so, is there'a structure above this. Mr. Becht clarified that there is no structure above this, and the only construction being looked at is construction for a jucuzzi. V. 'PUBLIC HEARINGS (Conrad.) ~t% PUBLIC HEARINGS A. He explained that the traffic problem was the main reason they filed this appeal. He commented that a general environ- mental impact report should be made to know what the impact of this one development is. There- fore, it is asked that the City Council accept this appeal in the light of working out first a general environmental impact reportI~_. and ace On this before~8'6'+F__d~f~7' on this development. Bill Heiss, 14933 Sobey Road, engineer for this applicant advised that represented with this project is a tremendous amount of geological and environmental data that was pro- vided the City, and the Planning Commission took this into their deliberations as they did all the other impact reports and other data which has .been submitted for this and other projects underway. Further, there are not any unknowns as far as what is occuring in this particular area. Mr. Heiss indicated that this~.~'~e~ ~.~.~gMed against the ~Yh~t was prepared by Nolte; if you take the traffic information and add it to the Nolte Study, you f{nd that the traffic increase on Pierce Road due to this project is in the neighborhood of 5 percent. He commented that this is an excellent application of the HCRD Ordinance?~}which is carrying out the concept from the General Plan. Further, the area of traffic is one of the primary concerns of the Planning-Commission. This plan takes care of the delemma with a very long cul-de-sac where its only other alternate is Canyon View Drive. Nearly half of the land is devoted to open space. 'Within that open space is an ~ntegrated trail system which also ties in with the road system. - 5 - V. SYSTEM AT 20 PSI RESIDUAL (SD-1409) The Mayor opened the public hearing at 9:53 P.M. David Ritter, 120 Carlton Avenue, #26, Los GatoS, commented that under his previous site approval, he was given a condition of a fire system of 700 gallons a minute. To meet this condition, he had to gain three easements over three other sites up in the mountainS. He installed the system, and-it was ru~ning in February'of 1976. With this residual~ the 700. gallons-per-minute requirement was met. .2) InstallatiOn of the 1,497 feet of water main and the fire hydrant:was completed around February 1976. He pointed out that the Uniform Fire C~de is still the same, and it is still.700 gallons-per-. minute, and it is up to the individual cities to increase or decrease. this amount. 3) in April 1979, a checklist was sent to' the City Planning Commission from the Saratoga Fire District requiring 1,000 gallons-per-minute flow on SDR-1409, which is the same property as SDR-1208. He indicated that this requirement fs impossible to meet due to the elevation of the water tank and size of~the water main. Mr. Ritter commented that this hydrant only services one existing house, which did not participate in the 'installation of the fire hydrant, and it would only s&rve- only one'other house. 9 ~.
