TYPE: Adjourned Regular ~eeting I. ROLL CALL Present: Callon, Corr, Kalb, Matteoni, Kraus Absent: None ~ II. PETITIONS, ORDINANCES AND RESOLUTIONS ~'A. ORDINANCE , AN EMERGENCY ORDINANCE IMPOSING A MOP~TORIUM ON TENTATIVE ~ IN THE PIERCE ROAD/MT. EDEN ROAD WESTERN HILL PORTION OF SARATOGA Mr. RSbinson, Planning Director, reviewed the Proposed 'Schedule for Review of the Major Issues in the Western Hillsides. Coundilman Kalb suggested a time be planned into this schedule prior to the July 24th review session to consider the basic level of improvements for Pierce Road. This was suggested to be set up on a sub-committee study session basis, to include Council representative(s), Planning Commission representative(s) , home- owner's representative(s), developer(s), and landowners, to allow them to express opinions on Pierce Road issues. This was acceptable to the remaining Council. Peggy Corr and. Jeff Kalb were appointed to serve as Council representatives to this sub-committee. Or d in an c e · Mr. Robinson described the proposed study boundary for phasing development in the western. hills portion of Saratoga-Mt. Eden Valley, which map is an~.e~i_bi~to the proposed emergency ordinance. He distributed to the Council a schedule of subdivisions which are pending ~in this district, as well as some of the maximum potential lots. Applications currently pending are Cocciardi and Chadwick, as well as .the urban service. area, which is the Mares site. It is presently anticipated the Planning Commission's first review of these applications would be August 22nd. Councilwoman Callon.commented that she believes the Council should consider a~n. emergency ordinance, from the point of view that what ~l~Ci~y ~does Ibetween now and Aughst 22nd might affect some of the map~'i'~ '~f '~e p~oj ects. EDEN ROAD ~ZSTERN HILL PORTION OF SARATOGA Councilman Matteoni indicated he has a problem with "emergency"' ~f the applications are not going to come. forward in any event, and he wonderedif there would be any inclination on the part of the affected property owners to ~llow the Council time to study this, according-to the work program that we have, without formatizing 'an ordinance. The attorney for the~p~operty o~zner indicated this'would be acceptable, .with the understanding if the'Council came to a conclusion sooner than anticipated, the l~ndowners could p~oceed with their applications. Effectively, this would delay~co~i~'~r~ffOn Of these applications before the Planning Conmissio~f~f~ ~[iod of 60 days, or not before October 22nd~1~7~. M/S: Matteoni/Kalb that base~ on the offer from the attorney for COcdiardi and Chadwick that they would not ask for further processing of their two proposals prior to August 22nd (which under the time- t~ble which staff has provided would not bring. their matters before the Planning Commission for hearing until 'late October 1979), the Council adopt the second paragr~b~of the proposed ordinance recital, ~ich reads as follow~~ ' 'This Council i~ presently.s't~dying,~ and intends to con- tinue studying, methods of controlling the orderly development in conjuDc~ion wi~t~_~>t~e ,ability of this City to have~the necessary services'including, but without limitation,~a~equate t~affic circulation, and including in said studfes~ inter'alia, to what!exten~Pierce'~Road should be improved, ~f at all; to what extent additional or alternate circulation patterns should be developed, if at all;the chronological phasing of issuance of. Building Permits-in',~irect relati'on t~'the up-dating of Pierce Road and/or otherwise making adequate provision for increased traffic impact on existing roadways in said area; and by reason of the increased impetus for development in said area'it becomes necessary to temporarily forestall the approval of any other Or further tentativ~ subdivision maps in said area pending the completion of said studies'and the adoption of adequate courses of action.
