A spokesman f~om the Fire Marshal's office
discussed changing the current.~ystem to
direct billing, subject to consideration at
a future time, which would save 15 to 20% of
the cost. Fire Marshal's office wo61d still
notify property owners if property needed

Fred Irany, Pierce Road, stated his-'objection
to the' 35% administrative fee on top of the
discing charge. He also felt his hay f~i:eld
was unfairly plowed, and that he didn't re-
ceive the not.ification.
Fire Marshal's spokesman outlined the ~ee
structure, and s~ated that property owners
are sent notification and have the option to
do the work themselves.
CoUncilwoman Jensen questioned the use of
herbicides in this program. She would like
some communication in the future about possi-
ble a|.ternative methods, other than the use
of herbicides. An inspector from. the.Fire
Marshal's office discussed which herbicides
]'a~e now used, in addition to discing, and
stated there.did not seem to be any problems.
The public hearing was closed at 9:14 P.M.

B. AMENDMENT TO RECREATIONAL COURT. Plapning Director Rob Robinson'~eviewed the
ORDINANCE GF-314(a) ; reasons for staff's initiation of this re-
vision. During the last two years under the
current ordinance, the PlanningCommis~ion
has denied alltennis dourts where the foot-
print of the court exceeded 10% slope.. The
revised ordinance al.lows a variance procedure
for these cases. If th~ slope is less than
'~lO~%~taff wi'll-have apprOva'l, and the Plan-
!-,ning.DirectOrisr~commendl.g that there be·
an appeal process p~ovisi:6.!of!staff de~ision.

ORDINANCE GF-314la) (Cont'd) stated that he has tackled the recreational
court ordinance on a number of occasions, and
is in opposition to its language and purpose~
If you want to protect neighbors, you have to
make an ordinanc~ to protect the neighbors;
if you want to protect land, you haveto make
an ordinance that you cannot dig holeS, or
disturb a'10% grade, or whatever. He feels
the ordinance is in error in prohibiting cer-
tain types of construction onlyiif it is to
be used as a recreational court, and to allow
the same construction for a patio, or other
use,

Councilman Mallory asked if the exis'ting

The Council discussed the requirements for
noticing proposed tennis courts, an appeal
procedure on all tennis courts, and the
· opt[on to requirea use permit for all courts
Staff was directed to come back with a modi-
fied proposed ordinance for ConSideration,
which would reflect the discussions this
evening. The City Attorney would also dete~-
mine whether the ordinance would be returned
to the Planning Commission for their prior
consideration, or if it would be bitought dir-
ectly back to Council.

The Council discussed the City's current
procedures concerning enforcement of the sign
ordinance now in effect. City Manager point~
ed out that due to cut backs in overtime pay
af.ter the passage of Proposition 13, the
Code Enforcement Officer did not work week-
ends, which is when most of the violations
occur.
Monica Butler, Los Gatos-Saratoga Board of
Realtors, narrated a brief slide show and
demonstrated'to Council how the new sign

cover the cos't of the low bid. Since this
company had not do~e work previously for the
City, the references had been thorpughly
checked.

3. Sewage Treatment Plant Failure Mayor Pro'Tem Jensen further reported on the
San Jose~anta Clara Sewage .Treatment plant.

failed, ahd solids are being put into the bay.

from a large a~ea. Capacity is not sufficient

still in an emergency, and the problem wonIt
" be solved by temporary measures.
