HomeMy WebLinkAbout3E-10 ORDINANCE 3E-10 AN INTERIM EMERGENCY ZONING ORDI- NANCE PROHIBITING CERTAIN USES OF CERTAIN LANDS, OTHER THAN AS SPECI- FIEDr WITHIN THE CITY OF SARATOGA WHEREAS, the Department of Planning, the Planning Conmission and the City Council of this City are considering and studying, and intend to conduct further studies within a reasonable time, and to conduct hear- ings on and make recommendations concerning, new zoning regulations and classification~ for these parcels of real property more particularly shown as the cross-hatched sections on the sectional district map attached hereto as Exhibit '~" hereof, and WHEREAS, pending the ultimate adoption of such permanent regulations and classification it is necessary to prohibit such use or uses as may be in conflidt'~ith the same, and at the same time to'not delay or penalize development of said property in a manner as would probably not be in con- flict with such contemplated changes, NOW,'THEREFORE, AS INTERIM URGENCY AND EMERGENCY MEASURE, pursuant to Government Code Section 65858 of the State of California and the police powers of this City, the City Council of the City of Saratoga does hereby ordain as'follows: Section 1: No new use..or occupation shall be made of any of the ~eal ~operty shown and. delineated as the.cross-hatched 'areas on Exhibit "A" at[~ch~d hereto, save and except as permitted in a "C-N" zoning district and by this ordinance, nor unless andLunti! a~use permit therefore has been obtain- &d in 'accord with Article 16 of Ordinance NS-3 of the City of Saratoga, nor until any applicable provisions of Section 21151 of the Public Resources Code of the State of California have been complied with. Section 2: Anythingto the contrary in Section 7.7 of Ordinance NS-3 not withstanding, the minimum site area shall be eight (8) acres. Section 3: This Ordinance is hereby declared to be an urgency and emergency measure adopted ,to protect the public safety, health and welfare, and shall be effective irmnediately upon its passage. All of the preambles to this Ordinance are hereby referred to and incorporated into this section by reference, and shall constitute a statement of the facts constituting such urgency. This Ordinance shall remain in full force and effect for a period of four (4) months from the date of adoption, or until the sooner adoption of perm- anent amendments to Ordinance NS-3 concerning the regulations governing or the classification of properties in the area more particularly shown and delineated as the cross-hatched area on Exhibit "A". : -1- Section 4: If ~ny section, subsection, sentence, clause or phrase of this ordinance is for any reason held by~a court of competent jurisdiction to be invalid, such decision shall not affect the validity of the remaining portions of this Ordinance. The City Council of the City of Saratoga hereby declares that it would have passed this Ordinance and each section, subsection, sentence, clause and phrase thereof, irrespective of the fact that any one or more sedtions, subsections, sentences, clauses or phrases be held invalid or unconstitutional.
