HomeMy WebLinkAbout3E-9.1 ORDINANCE NO. 3E-9.1 AN ORDINANCE EXTENDING TEMPORARY INTERIM ZONING ORDINANCE 3E-9 FOR AN EIGHT (8) MONTH PERIOD OF TIME WHEREAS, on the 19th day of April, 1972, this Council passed and adopted Ordinance 3E-9, relating to a moratorium and/or' slowing down of development in the Bohlman Road - Norton Road Area, until adequate and effective ifire pro- tection and related facilities therefore have been provided; and the steepness of the terrain add lack of sanitary sewerage can be corrected in accordance with present zoning site area standards, said Ordinance being adopted pursuant to Government Code, Section 65858, of the State of California, to last for a period of four (4) months, and WHEREAS, the Planning Commission and Planning Department of the City of Saratoga are still considering and studying, and intend within a reasonable time from date hereof, to continue the study of the matter of new and permanent · regulation~ relating to proper and safe development in said area, and in the opinion of this Council it becomes necessary to extend said interim zoning ordinance for a period of time in the futpre, NOW THEREFORE, the City Council of the City of Saratoga does hereby ordain as follows: Section 1: That certain Ordinance 3E-9, entitled "A Temporary Interim Zoning Ordinance Prohibiting Certain Uses of Certain Lands, any Applying Certain Zoning Regulations to Certain Lands, in the City of Saratoga, within that Portion of Said City Known as the Bohlman Road - Norton Road Area, Finding the Urgency Thereof", and passed and adopted as an urgency and emergency measure by the City Council of the City of Saratoga on the 19th day of April, 1972, to remain in full force and effect for a period of four (4) months from said date of April 19, 1972, be and the same is hereby extended for a period of eight (8) months from the expiration of' four (4) months from April 19, 1972. Section 2: If any section, subsection, sentence, clause or phrase of this ordinance is for any reason held by a cour~ of competent jurisdiction to be invalid, such decision shall not affect the validity of the remaining portions of this ordinance. Th& City Council of the City of Saratoga hereby declares that it would have passed thls ordinance and each section, sub- section, sentence, clause and phrase thereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses or phrases be held invalid or unconstitutional. This ordinance was regularly introduced, and after public hearing held thereon by the City Council o~ the Ci.ty of Saratoga, pursuant to notice in accord with Section 65858 of the Government Code of [he Slate of California, it was thereafter p~ssed and adopt~ at a regular mee[ing of said City CounCil held on the 16th day of.
