AN ORDINANCE ESTABLISHING A PORTION OF SARATOGA AVENUE AS A-45 MILE, PER~ HOUR SPEED DISTRICT AND - AMENDING-ORDINANCE NO. ~4A IoF THE 'CITY DF SARATOGA TO INCLUDE THE SAME* The City Council of the' City!~ofI Sara~oga does hereby ordain as follows: SECTION 1:' The C~ty Council, of the City of Saratoga does, on the basis of an engineering and traffic . survey, hereby determine and declare that the prima facie speedT.'limit of 55 miles per hour is more than a reasonable or a safe speed for any person to drive a vehicle on or along the hereinafter described hfghway. SECTION 2: Section 1.1 of Ordinance N0. 4A of the City' of Saratoga is here~y .amended by adding to Section 10.5.4-3.1 of the Santa clar~a County Ordinance .Code therein adopted by reference, the following described portion of Saratoga 'Avenue which is h~eby declared t~'be a 45 miles per hour· speed zone, and no person shall drive a vehicle on or along the following describe'd portion of said highway at a speed greater than 45 miles Iper hour: Saratoga AVenue from i~s intersection with Fruitvale Avenue, northeast to the Saratoga City limits. S. BCTION 3: This 'ordina, nce is hereby declared to be an · urgency and emergency measure, effective immediately upon its passage and adoption, and enacted for the preservation of the public peace, health~ and s~fety, morals and welfare, and based upon the facts that jv~hicle drivers are constantly operating motor vehicles upon said streets in excess of said speeds and will, unless immediately prohibited continue to do so and cause a-menace to said peace, health, safety and welfare, and on' the basis that the ~Bove set forth streets and highways are necessary for the immediate-orderly movement of traffic under reasonable and safe c6nditions. If- for any reason this Ordinance does not qualify as an emergehcy ordinance, ~hen the same shall be effective thirty (30) days after its passage and adoption.
