ORDINANCE NO. .16

AN 0RDIN~CE CREATING A PLANNING COMMISSION
FOR THE CITY OF SARATOGA
The City Council of the City of Saratoga does hereby
ordain as follows:
SECTION l:
Sec. 1.1 There is hereby established and created a
City Planning~ Commission of the City of
Saratoga, which Planning Commission shall consist of seven members
to be appointed by the Mayor with the approval of the City Council.
Said Planning Commission shall be operative on the day following
t~e effective date of this 0rdin~nce and upon the appointment
and qualification of all the members thereof, and until such time
the City Council of the City of Saratoga shall continue to
exercise all powers of a City Planning Commission.
Sec. 1.2 Upon the first appointment of members to
said Planning Commission, three members shall
be appointed for a term of four years, two members for a term of
three years, and two members for a term of two years. Thereafter,
successors to the first members shall be appointed for four-year
terms.
SECTION 2:
Sec. 2.1 The powers granted to a City Planning Commission
under the terms of Article IV of Chapter 3 of
Title 7 of the Government Code of the State of California shall
not be exercised by said 'City Planning Commission without the prior
consent of the City Council.
SECTION ~: If any section, subsection, sentence, clause or
phrase of this Ordinance is for any reason held
by a court of competent Jurisdiction to be invalid, such decision
shall not affect the validity of. the remaining portions of this
Ordinance. The City Council of the City of Saratoga hereby declares
that it would have passed this Ordinance and each section, subsection,
sentence, clause and phrase thereof, irrespective of the fact that
any one or more sections, subsections, sentences, c~auses or nhrazes
be held invalid or unconstitutional.

waiting time requi~ed by law was thereafter pass~d and adopted this
