AN ORDINANCE CREATING A DEP~RTMENT OF PUBLIC WORKS OF
THE CITY OF SARATOGA AND.DEFINING THE DUTIES AND
RESPONSIBILITIES THEREOF
The City Council of the City of Saratoga does hereby ordain
as follows:
SECTION l: There is hereby created a Department of Public
Works of the City of Saratoga, which department
shall be under the supervision, direction and control of
the Director of Public Works, hereinafter called "Director",
and subject to the'general administrative supervision of the
City Administrator. ~
SECTION 2: The Director shall be a registered CiVil Engineer
of the State of California, shall be appointed
by the Mayor with the advice and consent of the City Council,
and the term of said appointment and the compensation therefor
shall be as set forth by resolution or order of the City Council.
~ SECTION ~: Subject to the approval of the City Council, the
Director shall organize and maintain such divisions
in his department as the operations of said department may in
'.' the judgment of said Director and said City Council require,
and he shall be responsible for the direction, supervision
and control of all divisions of said department and for the
· performance of the function and duties herein assigned to
said Department of Public Works.
SECTION 4: The function and duties of the Department of
Public Works shall be as follows:
(a) To plan, administer'and supervise a Comprehensive
public works maintenance program for the City,
including the planning and programming of their
road maintenance schedule, and the supervision,
direction and control of the public works mainten-
ance crew.
(b} To coordina~e~ assist and supervise the inspection
and review procedures of subdivisions within the
city by the County of Santa Clara Planning, Engineer-
ing, and Health Departments, and to act in a'liais~n
capacity between said county and city in all technical
matters dealing with subdivisions, records of survey,
joint street and highway projects,~ flood control prob-
lems, and other public works functions.
(c) The design, construction, maintenance, add clearing
of all streets, alleys and other public ways now open
or which may hereafter be opened, and the removal of
all obstructions from the same.
(d) The supervision of the design, construction,
operation and maintenance of all city buildings, shOpS
and yards.

(el To prepare and present a~ually a departmental
budget, and to perform all phases of engineering
work required in connection with all of the functions
of the city not hereinabove specifically enumerated.
(f) To perform such other functions or duties as may
from time to time be directed by the City Administrator,
or as may hereafter be specified or directed by order
of the City Council.
SECTION 5: The City Administrator shall have the authority
to employ a public works maintenance crew con-
sisting of a foreman and such additional employees as
authorized by the City Councilyet such salary or wage
scale as shall be adopted by. resolution of said City Council,
and said public works crew shall be under the exclusiv~
authority, direction, and control of the Director of Public
Works, subject to general administrative supervision of the
City Administrator. ~
.SECTION ~: Ordinance No. 22 and Resolution No. 41 of the
City of Saratoga are hereby superseded and repealed.
SECTION 7: If any section, subsection, sentence, clause or
phrase of this ordinance is for any reason held
by a court of competent jurisdiction to be invalid, such decision
shall not affect the validity of the remaining portions of this
ordinance. The City Council of the City of Saratoga hereby
declares that it would havelpassed this ordinance and each
section, subsection, sentence, clause and phrase thereof, irres-
pective of the fact that any one or more sections, subsections,
sentences, clauses or phrases be held invalid or unconstitutional.
This ordinance was regularZy introduced and after the waiting
time required by law was thereafter passed and adopted on the 7th
day of October , 1959, at a regular meeting of the City
Council of the City of Saratoga:by the following vo~e:
