AN ORDINANCE OF THE .CITY. OF. SARATOGA CREATING
A SALARY .AND WAGE FUND, APPROPRIATING MONEYS
THEREFOR, AND PRESCRIBING :TIME AND METHOD OF
PAYMENT AND RATIFICATION .OF PAYROLL AND REIM- BURSEMENT .OF FUND.
The City Council ofthe City,of Saratoga does hereby ordain
as follows:
Section .1: SALARY AND WAGE FUND
Section 1.1: There is herebylcreated a special revolving
fund under the supervision of the City'Clerk
of the.City of Saratoga, to be.known as the .SALARY.AND
WAGE FUND, and being.Fund No. 21-A. Paymen~ of salaries
and wages to City Officers and employees shall be made by
check drawn by the-City Clerk against .this fund as .hereinafter
set-forth.
Section 1.2: T~e City-Clerk is.hereby directed to transfer
:thesum of. $8,000.00 from the General Fund (No. 21)
to said Salary and Wage Fund andto establish a separate bank
account for s~id Salary and Wage Fund with the Bank of.America
National Trust and Savings.Association, Saratoga Branch, and to
thereafter draw against said accbunt as set~forth in t~is
ordinance·
Section 2: PAYROLL ~
Section 2.1: Pursuant to Government.Code Section 37202 and
37208 of the State of CaliforniA, and other
applicable laws, the City Clerk~is authorized to prepare a
bi-monthly payroll and to issue ~checks against the salary and
wage fund for 'the payment of all salaries and wages to the
several.officers and employees of the City.of Saratoga as
such salaries and wages are authorized by a duly app~oved
city budget.or~otherwise by the City Council
Section 2.2: Payment of.the payroll shall be made on the
5th and 20th .d~ys of each month, after'certi-
fication as .herein set ~forth. The.head of each City department
shall certify and approve his respective departmental payroll
or attendance record for employees of his respective department
prior'to the said 5th and 20th of each month, and shall present
.the.same to the City Clerk who ahall thereupon certify and
approvesaid payrolls and issue checks in payment therefor
against~the salary and wage fund.
Section 3: AUDIT ANDREIMBURSEMENT
Section 3.1:~ Each payroll shall be presented to the City
Council for ratification and approval at the
first meeting thereof held after-the delivery. of payroll checks·
Upon such ratification and approval, a warrant in the amount
of such paid and approved payroll shall be ordered drawn on
the General Fund to reimburse .said Salary and Wage Fund.

Section 4: CONSTITUTIONALITY;AND EFFECTIVE DATE
S[ction 4,1: This .ordinance shall be.in full force and
effect.thirty_(30):days after its passage
.and adoption.
-Section 4.2: If any section, subsection, sentence, clause
'or phrase ofthis.ordinance is for'any reason
held by a-court Lof competent .jurisdiction 'to be .invalid, such
decision shall .not affect .the validity.of the remaining
portions .of this ordinance. The.City_ CounCil of .the City of
Saratogahereby. declares that.it~would have passed this ordi-
nance.and each section, subsection, sentence, clause and phrase
thereof, irrespective.of the factcthataiy one or more sections~
.subsections, sentences, clauses .or 'phrases .be .held invalid or
unconstitutional.
.This.ordinance was 'regularly. introduced and after the waiting
time required by_law was thereafter passed andadopted-at a regular
meeting of the.City Council.of the.City.of Saratoga. held'on .the
3rd day of August .,!960, by the following vote:
