AN ORDINANCE AMENDING ORDINANCE NO. 28 BY ADDXNG WESTERN
CALIFORNLA TELEPHONE COMPANY TO ~QIE ENUMERATED UTILITIES
EXCEPTED FROM TaP. PROVISIONS ~HEREOF
The City Council of the City of Saratoga does hereby ordain as f~llows:
SECTION h The second paragraph of Section 3.1, Ordinance No.
is h&reby amended to read as follows:
The provisions of this section shall apply to all
public utilities~ includin~. without in any way l~m~tin~
the foregoin~s the San Jose Water WorkSj ~he Pacific Cos
and Electric Company~ the PaCific TelephOne Companys and
Weste~CalifoTnia Telephone Company.
S~-CTION 2..' s~ct~on 3~2s Subdiv~_ston (a), of Ordina~ce No.
· is hereby amended to read as follows:
(a) The installation of above-ground utilities by
Pacific Gas and Electric Company or San Jose Water Works,
in accord with the~_r respective franchises as set forth in
Ordinances 13, 14 and 17, or by the Pacific 'Telephone Company,
or Western California Telephone Company pursuant to the fran-
chise granted them under Section 7901 of the Public Utilities
Code.
SECTION 3: If any sections subsections sentence, clause or phrase
of this ordinance is for any reason held by a court
of competent jurisdiction· to be iovalid, such decision
shall not affect the validity of the remainin~ portions of this
urdinonce. The City Council of the City of Saratoga hereby declares
that it would have passed this ordinance and each sections subsection
sentence, clause and phrase thereof, irrespective of the fact that
any one or more sections~ subsections, sentencess clauses or phrases
be heid invalid or uncons~itutional.
This ordinance was regularly introduced and after the waitin~ time
required by law was thereafter .passed and adopted on the 5th day of
~uly , 1961s by the follow~_n~ vote:
