AN ORDINANCE OF THE CITY OF SARATOGA
REQUESTING INCLUSION OF CERTAIN TERRITORY
WITHIN SAID CITY, IN THE SARATOGA FIRE DISTRICT
(HAKONE GARDENS)
WHEREAS, there exists within: the City of Saratoga a Local
Fire District, known as the Saratoga Fire District, and there also
exists within said City certain territory not within the boundarias
of any Fire District, but which is. contiguous to said Saratoga
Fire District, and, :
WHEREAS, pursuant to Health and Safety Code Section 14022
of the State of California, said Saratoga Fire District has elected
to come under the provisions of Part 2.~, Division 12 of the Health
and Safety Code of the State of California, known as the Eire
Protection District Law of 1961, ~nd,
WHEREAS, said property became a part of the City of Saratoga
pursuant to Annexation Ordinance No. 43 heretofore passed and adopted
on February 1, 1967, and the inclusion of said area into the Saratoga
Fire District was requested to be included within ~aid Fire District
by the Santa Clara County Local A~ency Formation Commission, and,
WHEREAS, under and by virtu~ of the provisions of the Fire
Protection District Law of 1961, this Council is desirous of causiBg
the inclusion of said land in the~Saratoga Fire District under the
provisions of Health and Safety Cgde Section 13948 of the State of
California,
NOW, THEREFORE, the City Council of the City of Saratoga
does hereby ordain as follows:
Section 1: The District Board of the Saratoga Fire District
is hereby requested to include within its
boundaries all that real property;more particularly described and
delineated on Exhibit "A" attached hereto and incorporated herein
by reference, which lands constitute a portion of the City of
Saratoga, and said District Board of Fire Commissioners is hereby
requested to ~pprove said inclusion forthwith.
The above and foregoing ordinance was regularly introduced,
and after the waiting time required by law was thereafter passed
and adopted at a regular meeting of the City Council of the City
of Saratoga held on the 16th day of p~cember , 1970,
by the following vote:
