Home My WebLink About71.37 ORDINANCE NO. 71. 37 AN ORDINANCE OF THE C1TY COUNCIL OF THE C1TY OF SARATOGA AMENDING SECTION 11-05.030 OF THE CITY CODE TO PROHIBIT USE OF SKATEBOARDS IN CERTAIN AREAS OF PUBLIC PARKS, AND AMENDING SECTION 11- 05.070 OF THE (;rrJC CODE TO DESIGNATE VIOLATIONS OF PARK REGULATIONS AS INFRACTION OFFENSES The City Council of the City of Saratoga hereby ordains as follows: SECTION 1: Section 11-05.030 in Article 11-05 of the City Code is amended by designating Paragraph (o) as Paragraph (p) and adding a new Paragraph (o), to read as follows: "(o) Ride or propell a skateboard upon any driveway, roadway, parking area or tennis court within such park." SECTION 2: Paragraph (a) of Seerion 11-05.070 in Article 11-05 of the City code is amended to read as follows: "(a) The violation of any provision of this Article shall be unlawful and constitute an infraction, subject to the penalties as set forth in Chapter 3 of this Code." SECTION 3: If any section, subsection, sentence, clause or phrase of this Ordinance is for any reason held by a court of competent jurisdiction to be invalid or unconstitutional, such decision shall not affect the validity of the remaining portions of this Ordinance. The City Council of the City of Saratoga hereby declares that it would have passed this Ordinance and each section, subsection, sentence, clause and phrase thereof, irrespective of the fact that one or more sections, subsections, sentences, clauses or phrases may be held invalid or unconstitutional. SECTION 4: This Ordinance shall be in full force and effect thirty days after its passage and adoption. The above and foregoing Ordinance was regularly introduced and after the waiting time required by law, was thereafter passed and adopted at a regular -1- meeting of the City Council of the City of Saratoga held on the 6th day of April , 1988, by the following vote: AYES: CounciLmeml~rs Anderson~ Cleve~ger, Moyies and Mayor Peterson NOES: CDunci]member Hlava ABSENT: None ~ ATTEST: (/(/~, The above and foregoin is a true and correct -2-
