HomeMy WebLinkAbout71.59 ORDINANCE NO. ~1. 59 AN ORDINANCE OF THE CfYY OF SARATOGA REPEALING ARTICLE 15-20 AND (YrHER PROVISIONS OF TIlE CITY CODE RELATING TO THE LIBairED INDUSTRIAL ZONING DISTRICT The City Council of the City of Saratoga hereby ordains as follows: SECTION h Section 15-10.010 in Article 15-10 of the City Code is amended by repealing Paragraph (j); renumbering Paragraph (k) to (j); and tenumbering Paragraph (1) to (k). SECTION 2: Article 15-20 of the City Co(~e is repealed in its entirety. SECTION 3:' Section 15-30.110 in Article 15-30 of the City Code is repealed. SECTION 4: Paragraph (i) of Section 15-35.020 in Article 15-35 of the City Code is amended to read as follows: "(i) With respect to any site or structure located within a C-N, C-V, C-H, P- A, R-M or MU-PD district, not more than twenty-five percent of the number of required off-street parking spaces may consist of compact parking spaces. If, in the application of this Paragraph, a fractional number is obtained, one compact parking space may be provided for a fraction of more than one-hag and one standard parking space shall be provided for a fraction of one-half or less." SECTION 5: Paragraph (r) of Section 15-35.030 in Article 15-35 of the City Code is repealed and Paragraph (s) of said Section is renumbered to Paragraph (r). SECTION 6: Paragraph (b) of Section 15-35.060 in Article 15-35 of the City Code is amended to read as follows: "(b) Retail establishments Less than 5,000 sq. ft. 0 warehouses, storage 5,000 to 12,500 sq. ft. 1 facilities, restaurants 12,500 to 20,000 sq. ft. 2 20,000 to 30,000 sq. ft. 3 30,000 to 50,000 sq. ft. 4 50,000 to 75,000 sq. ft. 5 Each additional 75,000 sq. ft. r' SECTION 7: Paragraph (a) of Secton 15-46.020 in Article 15-46 of the City Code is amended to read as follows: "(a) In each of the following cases, no building permit shall be issued until the proposed improvements have received design review approval by the Planning Commission pursuant to this Article: (1) Any new main structure in an R-M, P-A or C district. (2) Any expansion over five hundred square feet to an existing main structure in an R-M, P-A or C district. (3) Any substantial exterior alteration, as determined by the Planning Director, to an existing structure in an R-M, P-A or C district, (4) Any addition over twenty-two feet in height to an existing main or accessory structure in an R-M, P-A or C district. (5) Any parking lot in an R-M, P-A or C district covering an area of one thousand square feet or greater. (6) Any structure, except a single-family dwelling or accessory structure, having a gross floor area of one thousand square feet or greater, located in an A, R-i, HC-RD or NHR district." SECTION 8: Upon the effective date of this Ordinance, any site which is then classified as a limited industrict district shall automatically become and remain an unclassified site having no specific district designation, pending further action by the t}lanning Commission. SECTION 9: If any section, subsection, sentence, clause or phrase of this Ordinance is for any reason held by a court of competent jurisdiction to be invalid or unconstitutional, such decision shall not affect the validity of the remaining portions of this Ordinance. The City Council of the City of Saratoga hereby declares that it would have passed this Ordinance and each section, subsection, sentence, clause and phrase thereof, irrespective of the fact that one or more sections, subsections, sentences, clauses or phrases may be held invalid or unconstitutional. SECTION 10: This Ordinance shall be in full force and effect thirty days after its passage and adoption.
