AN ORDINANCE OF i,THE CITY OF SARATOGA
AMENDING SECTIONj':lS-45.060 OF THE CITY
CODE CONCERNING DESIGN,REVIEW':
The City Council of the Cit. y..Of~Saratoga~hereby ordains as follows:
SECTION 1: Subparagraph (a)(8) of Section 15-45.060 in Article 15-45 of the
City Code is amended to read as follows:
"(8) Whenever, in the opinion of the Planning Director, the construction
or expansion of a main or. accessory structure may be incompatible
with the neighborhood, or may create a perception Of excessive
mass or bulk, or may unreasonably interfere with views or privacy,
or may cause excessive damage to the natural environment, or may
result in excessive intensification of the use or development of the
site."
SECTION 2: If any section, subsection, sentence, clause or phrase of this
Ordinance iS for any reason held by a court of competent jurisdiction to be invalid 6r
unconstitutional, such decision shah not affect the validity of the remaining portions
of this Ordinance. The City Council of th.e City of Saratoga hereby declares that it
would have passed this Ordinance and eaeh section, subSection, sentence, clause and
phrase thereof; irrespective of the fact that one or more sections, subsections,
sentences, clauses or phrases may be held invalid or uneonstituti0nal.
SECTION 3: This Ordinance shall be in full forge and effect thirty days after its
passage and adoption.
The above and foregoing Ordinance was regularly introduced and after the
waiting time required by law, was thereafter passed and adopte~l at a regular
meeting of the City Council of the City of' Saratoga held on the 18th day of
Getober , 1989, by the following vote:
