AN ORDINANCE OF THE CITY OF SARATOGA
AMENDING SECTIONS 5-30.140 AND 5-30.160 OF
THE CITY CODE CONCERNING THE U'rlLITY
USERS TAX
The City Council of the City of S~ratoga hereby ordains as follows:
SECTION 1: section 5-30.140 in Article'5-30 of the City Code is amended to
read as follows:
"85-30.140 Annual review of tax rate
The rate of tax set forth in Subsections 5-30.040(a) and 5-30.050(a) shall be
subject to annual review by the City Council at a public hearing to be conducted
during January of each year. The Council shall ldetermine the need for the revenue
produced by the utility users tax, based upon past expenditures and projections of
future costs. The rate of ~ax set forth in SubsectionS 5-39.040(a) and 5-30.050(a)
may be reduced by the adoption of an ordinance amending this Article, but shall not
be increased above three and one-half percent;'! '
SECTION 2: Section 5-30.160 in Article 5-30 of the City Cod~ isamended to
read as follows:
"S5-30.160 Repeal of Article
This Article shall automatically be repealed on July 1~ 1995."
SECTION 3: If any section, subsection, sentence, clause or phrase of this
Ordinance is for any reason held by a court of competent jurisdiction to be invalid or
unconstitutional, such decision shall not affect the validity of the remaining portions
of this Ordinance. The City Council of the City of Saratoga hereby declares that it
would have passed this Ordinance and each section, subsection, sentence, clause and
phrase thereof, irrespective of the fact that one or more sections, subsections,
sentences, clauses or phrases may be held invalid or unconstitutional.
SECTION 4: This Ordinance shall be in full force and effect thirty days after its
passage and adoption.
The above and foregoing Ordinance was regularly introduced and after the
waiting time required by law, was thereafter passed and adopted at a regular

meeting of the City Council of the City of Saratoga held on the 15thday of
Nove_mber , 1989, by the following vote:
AYES: Councilmembers Anderson~ Moyles, Peterson, Stutzman and Mayor Cle~nger
NOES: None
ABSENT: None
