AN ORDINANCE OF THE crrY OF SARATOGA
AMENDING SECTION 9-50.010 OF .THE crrY
CODE CONCERNING REPAIR OF VEHICLES ON
RF.,SIDENTIAL PROPERTIF.,S
The City Council of the City of Saratoga hereby. ordains as follows:
SECTION h Section 9-50.019 in Article 9-50 of the City Code is amended to read
as follows:
"$9-50.010 Vehicle repairs on residential properties
(a) The following terms, as used in this Section, shall have the meanings
respectively ascribed to them in this Paragraph:
(1) Front area means that portion of a site bounded by the side lot lines
and extending from the front lot line to the exterior surface of the
main structure on the site.
(2) Exterior side area means that portion of a site bounded by the front
area and the rear yard setback line, ahd extending from the exterior
side lot line of a corner lot to the exterior surface of the main
structure on the site.
(3) Rear area means that portion of a site bounded by the side lot lines
and extending from the rear lot line (or the rearmost portion of the
lot if there is no rear lot line) to the exterior surface of the main
structure on the site.
(b) No person shall engage in the repair of any motor vehicle, trailer, camper
unit or boat on any residentially zoned site within the City except in accord with the
following regulations:
(1) The vehicle, trailer, camper unit or boat must be currently registered
tO a person resident at the site at which it is being repaired at the
time it is being repaired.
(2) Except for emergency repairs, no vehicle .repairs shall be permitted
on any public street, public trail, or other public right-of-way, nor
shall vehicle repairs be permitted on any private property within
public view or within a front area or.exterior side area. Emergency
repairs shall be ~ompleted within.48 consecutive hours from the time
of breakdown and such repair activity shall not be conducted on a
regular basis. The reoccurrence of any repair activity within a period
of 15 days from the conduct of the last such activity shall constitute
a presumption of regularity.
(3) Vehicle repairs may be conducted within the rear area provided that

such activity and the storage of all repair equipment, supplies,
vehicles and parts, are completely enclosed within a structure or
completely screened from public view by a permanent solid fence or
wall which has been constructed or installed in accordance with the
regulations contained in Chapter 15 of this Code.
(4) No repair activity shall be permitted which creates a level of noise in
excess of the levels permitted under this Code or any other
applicable ordinance, rule or regulation of the City or the State.
(5) No repair activity shall be permitted which creates any smoke or
noxious fumes or odors which are discernable to occupants of
adjoining real property or to members of the general public using an
adjoining public street or public right-of-way.
(c) No residentially zoned site shall be utilized for the performance of
maintenance or repair work on motor vehicles for the purpose of selling or offering
such vehicles for sale or rental; provided, however, this restriction shall not apply if
not more than one vehicle is sold during any twelve month period."
SECTION 1: If any section, subsection, sentence, clause or phrase of this
Ordinance is for any reason held by a court of competent jurisdiction to be invalid or
unconstitutional, such decision shall not affect the validity of the remaining portions
of this Ordinance. The City Council of the City of Saratoga hereby declares that it
would have passed this Ordinance and each section, subsection, sentence, clause and
phrase thereof, irrespective of the fact that one or more sections, subsections,
sentences, clauses or phrases may be held invalid or unconstitutional.
SECTION 3: This Ordinance ,.shall be in full force and effect thirty days after its
passage and adoption.
The above and foregoing Ordinance was regularly introduced and after the
waiting time required by law, was thereafter passed and adopted Ta~_~ a regular
