(b) To the extent that eny provisions of this Article, or the Fire Code adopted herein by reference, constitute a modification or change in the regulations otherwise contained in any uniform code, as adopted by the City in this Chapter, it is hereby found and determined that such modifications and changes are reasonably necessary by reason of local conditions in the City, including the existence of hazardous fire areas, larger home and garage sizes, restricted traffic circulation and access to certain portions of the City and areas having steep topography and heavy combustible vegetation. 616-20.030 Section 3.105 added concerning abatement of hazards Section 3.105 is hereby added to the Fire Code, to read as follows: See. 3.105. Abatement of hazards. (a) The maintenance of real property in violation of this code, or any order of the fire district pursuant hereto, is declared to be a public nuisance and is subject to abatement in accordance with Article 3-15'of the Saratoga City Code. Rev. 6/5/90 -2- (b) Notwithstanding paragraph (a) of this Section, if real property is maintained in violation of this code or any order of the fire district pursuant hereto and such violation constitutes, in the opinion of the Fire Chief, a fire hazard of such nature that immediate action is required to protect the public health, safety and welfare, the fire district may apply the emergency nuisance abatement procedure set forth in Article 3-20 of the Saratoga City Code and take all necessary and immediate steps to abate the hazard without prior notice to the owner or occupant of the property. In such event, the Fire Chief shall perform the duties of the City Manager as described in said Article 3-20. (c) The cost of any abatement'may be collected through the levy of a special assessment in accordance with the applicable provisions of Article 3-15 or Article 3-20 of the Saratoga City Code. Such procedure is not intended to be exclusive and the City or the fire district may, simultaneously or successively, exercise any other rights and remedies provided by law. S16-20.040 Section 4.101 amended concerning requirement for permit Section 4.101 of the Fire Code is hereby amended to read as follows: See. 4.101. Scope. (a) The provisions of this article apply to permits required by Section 4.108 or other provisions of this code. (b) Unless otherwise herein noted, a permit shall be required to install, alter or change any fire hydrant system, fire extinguishing system or fire alarm system. (c) It shah be unlawful to operate, maintain or use any institutional facility until all state and local laws and regulations governing safety from fire and panic have been satisfactorily complied with and a permit for such occupancy has been issued by the Fire Chief. As used herein, the term "institutional facility" includes, but is not limited to, any hospital, ehildren's home, home or institution for persons with physical or mental disabilities or illness, home or institution for the care of aged or senile persons, sanitarium, nursing or convalescent home, certified family care homes, and day care nurseries. S16-20.050 Section 4.104.1 added granting authority to require exposure or to stop work Section 4.104.1 is hereby added to the Fire Code, to read as follows: Rev. 6/5/90 -3- Sec. 4~104.1. Authority to require exposure or to stop wurkZ Whenever any installation is covered or concealed without first having been inspected, the Fire Chief may require, by written notice, that such work shall be exposed for inspection. The work of exposing and recovering shall not entail any expense to the public entity. Whenever any construction or installation work is being performed in violation of the plans and specifications as approved by the Fire Chief, a written notice shall be issued to the responsible party to stop work on that portion of the work which is in violation. The notice shall state the nature of the violation, and no work shall be done on that portion until the violation has been corrected. $16-20.060 Section 4.109 added concerning permit fees Section 4.109 is hereby added to the Fire Code, to read as follows: See. 4.109. Permit fees. The City Council may, by resolution, establish a schedule of fees to be charged and collected by the City for the issuance of any such permits required under the provisions of this code and for the checking and inspecting services relative to these provisions. A copy of such fee schedule shall be maintained in the office of the City Engineer and such other locations as may be deemed necessary for public inspection. $16-20.070 Seetion 10.207(m) added concerning roadway and driveway gates Section 10.207(m) is hereby added to the Fire Code, to read as follows: Sec. 10.207(m). Roadway and driveway gates. Gates or other obstructions shah not be placed across access roadways and driveways unless of a design approved by the Fire Chief. Application for the installation of gates or obstructions shall be made in writing and accompanied by plans and specifications detailing the proposed installation. Existing gates may be ordered to conform to the above as required by the Fire Chief. $16-20.080 Section lO.301(g) added concerning automatic sprinkler systems Section lO.301(g) is hereby added to the Fire Code, to read as follows: Rev. 6/5/90 -4- See. 10.301(g)j Automatic sprinkler systems. Compliance with Append!x HI-A of this code shall be deemed adequate water supply, except for the following: (1) Where water supplies available for fire protection do not meet the above requirements, buildings equipped throughout with an approved automatic sprinkler system need not mandatorily comply with the provisions of this Section. (2) Buildings in excess of two stories or thirty-five feet in height, or that require a fire flow in excess of two thousand gallons per minute, shall be equipped throughout with an approved automatic fire sprinkler system. For the purpose of this Subsection, detached dwellings with exterior walls protected in accordance with the provisions of the Building Code need not comply. For the purposes of calculating fire flow, area and occupancy separation walls may not be used to reduce the building size. 516-20.090 Section 10.30l(h) added concerning instsllsUon of water type fire protection systems Section 30 1(h) is hereby added to the Fire Code, to read as follows: Sec. 10.301(h). Inst~llRtion of water type systems. Water type fire protection systems, with valves installed below grade, shall be installed in an approved box or vault. 516-20.100 Section 10.301(i) added concerning tool caches Section 10.301(0 is hereby added to the Fire Code, to read as follows: Sec. 10.3010). Tool caches. Rooms containing fire fighting equipment may be required by the Fire Chief in occupancies where personnel access, limitations, areas below grade, or unusual circumstances make fire fighting unduly difficult. All original equipment costs shall be paid by the building Owner. 516-20.110 Section 10.301(j) added concerning final inspection Section 10.301(j) is hereby added to the Fire Code, to read as follows: Sec. 10.301(j). Final inspection. No final inspection as to all or any portion of a development for which any requirements have been imposed by the Fire District shall be deemed Rev. 6/5/90 -5- completed until all such requirements have been satisfied and approved. No final certificate of occupancy may be granted until the Fire District issues a notice of final clearance to the City's Building Department. ~16-20.120 Section lO.301(k) added concerning central control station Section 10.301(k) is hereby added to the Fire Code, to read as follows: See. 10.301(k). Central control station. Where a central control station ("CCS") is required by the Fire Chief, it shah comply with the following requirements: (1) The location of the CCS shall be approved by the Fire Chief. It must be accessible from the exterior of the building. (2) A work surface adequate to accommodate building drawings and plans shall be provided. It may be collapsible or folding. (3) Minimum clear dimensions in the CCS, with equipment and fixtures installed and the work surface in the work position, shall be six feet by ten feet. (4) A water storage tank low level indicator shall be provided in the CCS. It shall indicate, by means of an audible and visual signal, when the water level falls below 100% of the rated tank capacity and it shall send a tamper or trouble signal to the central station. (5) The building fire pre-plan and simplified instructions for use of all equipment, systems and controls in the CCS shall be provided in the CCS. (6) The public telephone in the CCS shall be equipped with the following features: call waiting, call forwarding, conference calling and speed dialing. S16-20.130 Section 10.301(1) added concerning tempered glass panels Section 10.301(1) is hereby added to the Fire Code, to read as follows: See, 10,301(1). Tempered glass panels (1) When approved fixed tempered glass is used for smoke control, these windows shah be identified with round, red-colored disks. These disks shall be two inches to three inches in diameter and a minimum of 3/16 inch Rev. 6/5/90 -6- thick. They shall be affixed to the lower right inside corner of each tempered glass panel. (2) Tempered glass panels shall be located in a straight vertical line (one above the other) when viewing a building elevation. (3) The building foundation shall be marked in a like manner at a point directly below each vertical row of tempered glass windows. $16-20.140 Section 10.301(m) added concerning freight elevators Section 10.301(m) is hereby added to the Fire Code, to read as follows: See. 10.301(m). Freight elevators. When a freight elevator is provided, it shall be capable of operating on emergency power only. ~16.20.150 Section 10.301(n) added concerning stairwells Section 10.30 1(n) is hereby added to the Fire Code, to read as follows: See. 10.301(n). Stairwells. Where a commercial or multi- family residential building has three or more stories, the Fire Chief may impose any or all of the following requirements: (1) At least one stairwell shall go to the roof. All other stairwells shall have roof access by means of a ladder and hatch. (2) Stairwell doors shall have raised numbers affixed on the stairwell side, at a height of five to six feet above the floor. Numbers shall be five to six inches in height. ~16-20.160 Section 10.301(o) added eoneerning fire department training Section 10.301(o) is hereby added to the Fire Code, to read as follows: Sen. 10.301(o). Fire department training. (1) Prior to occupancy of any newly constructed building, at the request of the Fire Chief, that building shall be made available to the fire department for training operations. The.intent of this requirement is to allow an opportunity for fire fighters to train and familiarize themselves with the building. This training shall not delay occupancy of the building. Rev. 6/5/90 -7- (2) Prior to occupancy of any newly constructed building~ the building owner may be required to provide instruction and operation manuals, and familiarization orientation to all fire department personnel regarding the building's fire protection system. This information and training is to be provided in such a manner as to cover all fire fighter shifts. ~16-20.170 Beetion 10.306(i) added concerning shell buildings. Section 10.306(i) is hereby added to the Fire Code, to read as follows: Bee, 10,306(i). Shell buildings. (1) When a shell building is constructed and the finish eelling is not installed, the shell sprinklers will be installed with proper deflector distances to protect the shell and designed as ceiling sprinklers. (2) When a shell building is constructed and tenant improvements are to come later, a sign shall be placed near the riser and in the telephone and electrical rooms which states that no combustible cable may be installed above the ceiling unless it is encased in conduit or is installed according to other approved methods. 16-20.180 Beetion 10.306(J~ added eonceruing sprinkler system design Section 10.306(j) is hereby added to the Fire Code, to read as follows: See. 10.306(j). Sprinkler system design. (1) For purposes of setting the design of the automatic fire sprinkler system, documentation shall be furnished by the owner as to what type of use the various buildings will house. The following ~uideline may be used to determine system design criteria: A. Automatic fire system shall be designed as minimum NFPA Pamphlet 13 Ordinary Hazard. Group III. B. If there is storage, then the fire sprinkler system shall be designed per NFPA Pamphlet 13 Ordinary Hazard, Group III. C. If storage is over 12 feet in racks, the fire sprinkler system shall be designed per NFPA 231C for height and class of storage. Rev. 6/5/90 -8- D~ If storage is on pallets or solid piles over 15 feet high, the fire sprinkler system shall be designed per NFPA 23 1 for height and class of storage. E. If storage is over 12 feet high, the fire sprinkler system shall be designed per Article 81 of this code, including access, vents and draftstops. S16-20.190 Section 10.306(i) added to require water flow monitor in sprinkler system Section 10.306(i) is hereby added to the Fire Code, to read as follows: Sec. 10.306(i). Water flow monitor. When an approved automatic sprinkler system is installed in conjunction with a fire alarm system, the automatic sprinkler shall be provided with a water flow device which shall cause activation of the fire alarm signaling device. S16-20.200 Section 10.309(O added concerning standpipe systems Section 10.309(f) is hereby added to the Fire Code, to read as follows: See. 10,309(f), Standpipe systems. (1) The standpipe shall supply 500 gpm to each roof connection hose valve at 1'55 psi. (2) Required gpm for entire standpipe is calculated from UBC Standard 38.2. (3) Calculate to an available pressure at the fire department connection of 200 p.s.i. minimum. (4) Each 2 1/2 inch fire department outlet shall supply 250 gpm. (5) Fire department connection (FDC) piping shall be four inches for two inlets, six inches for four inlets and eight inches for six inlets. Each 2 1/2 inch FDC (receiver) shall supply 250 gpm to the system. (6) Piping, valves and fittings shall be rated for the maximum anticipated system pressure based on using an automatic nozzle and 155 pounds outlet pressure. (7) Pressure-regulating valves (not pressure-regulating disks) shah be installed as required. Standpipe hose valves shall be set at 155 p.s.i. Rev. 6/5/90 -9- (8) The fire department connection shall be located as specified by the Fire District. (9) When, in the opinion of the Fire Chief, an unusual condition or hazard exists, hose connections may be required and may be provided as outlined in Sections 3- 8.6 and 3-8.7 of National Fire Protection Association Standard # 13, 1987 Edition. 616-20.210 Section 11.203(d) added to require earthquake barriers for certain shelve~ Section 11.203(d) is hereby added to the Fire Code, to read as follows: Bee. 11.203(d). Shelves. Shelves used for the storage of containers of flammable or combustible liquids, corrosive or reactive materials shall be provided with approved earthquake barriers. Rooms containing combustible waste storage shall be provided with an approved automatic fire extinguishing system. S16-20.220 Beetion 12.110 added concerning smokeproof enclosures Section 12.110 is hereby added to the Fire Code, to read as follows: Bee. 12.110. Sub-basements. Smokeproof enclosures shall extend to all sub-basements. Tool caches located in sub- basements shall be located within smokeproof enclosures. $16-20.230 Beetion 14-104(f) added eoneerning fire alarm systems Section 14.104(f) is hereby added to the Fire Code, to read as follows: See. 14.104(19. Fire slnPm systems. (1) Any building or structure three or more stories in height shall have installed therein an approved automatic or manually operated fire alarm system, designed to warn the occupants of the building in the event of fire. The fire alarm system shall be so designed that all oeeupants of the building may be warned simultaneously, and alarm annuneiator panels shall be provided in such' locations as required by the Fire Chief. Installation, inspection and maintenance of the system shall be in accord with the standards of the National Fire Protection Association. Annunciation shall be device function as designated by the Fire Chief. Rev. 6/5/90 -10- (2) As part of any required tire alarm system~ devices to alert the hearing impaired shall be installed as directed by the Fire Chief, except that this requirement shall not apply to fire alarm systems installed in Group R, Division 3 Occupancies. ~16-20.240 Section 77.106(b) amended concerning storage of explosive~ Section 77.106(b) of the Fire Code is hereby amended to read as follows: See. 77.106(b). Storage of explosives. The storage of explosives and blasting agents is prohibited, except for temporary storage for use in connection with approved blasting operations, provided, however, this prohibition shall not apply to wholesale and retail storks of small arms ammunition or explosive rivets or cartridges for explosive- actuated power tools in quantities involving less than 100 pounds of explosive material. S16-20.250 Section 79.101(d) added concerning storage of fiammable liquids Section 79.101(d) is hereby added to the Fire Code, to read as follows: See. ~'9.101(d). Storage. The storage of Class 1 or Class 2 flammable and combustible liquids in above ground tanks outside of buildings is prohibited. $16-20.260 Section 82.104(e) added concerning storage of liquefied petroleum gas Seetion 82.104(e) is hereby added to the Fire Code, to read as follows: See. 82.104(e). Storage. The storage of liquefied petroleum gas referred to in Section 82.104(b) shall be allowed only at a business establishment located within a commercial zoning district whieh is duly licensed to store and sell gasoline. $16-20.270 Article 88 added concerning toxic gases [Adopted by separate ordinance] ~16-20.280 Section 16(c) added to Appendix H-A concerning firebreak vegetation Section 16(e) is hereby added to Appendix II-A of the Fire Code, to read as follows: Rev. 6/5/90 -11- Section 16(eL Firebreak vegetation. When brush or vegetation growth is removed and cleared away to provide a firebreak as required by this Section, suitable growth which will not form a means of rapidly transmitting fire shall be planted in such a manner so as to reduce the possibility of erosion. S16-20.290 Section 24 added to Appendix H-A eoneernieg roof coverings Section 24 is hereby added to Appendix II-A of the Fire Code, to read as follows: Section 24. Roof coverings. Roof coverings on all buildings shall be fire retardant and shall comply with the standards established for Uniform Building Code Class A or B prepared or built-up roofing. Re-roofing of existing buildings shall comply with the above, except that any re-roofing of less than ten percent of the total roof area of any building shall be exempt from this requirement. Additions to existing buildings exceeding ten percent of the total roof area shall comply with this Section. S16-20.300 Section 25 added to Appendix H-A to define and designate hazardous fire areas Section 25 is hereby added to Appendix II-A of the Fire Code, to read as follows: Section 25. Hazardous fire areas. (a) Defined. Hazardous fire areas are those lands as defined in Section 9.110 of this Code. (b) Designations. All hazardous fire areas shah be designated by the Fire Chief on a map which shall be maintained in the office of the Fire Chief and in the office of the Planning Director. $16-20,310 Appendix HI-B amended ecneernieg fire hydrants Appendix III-B of the Fire Code is hereby amended to add the following: Commercial hydrant spacing shall be a maximum of 250 feet." Rev. 6/5/90 -12- SECTION 2: If any section, subsection, sentence, clause or phrase of this Ordinance is for any reason held by a court of competent jurisdiction to be invalid or unconstitutional, such decision shall not affect the validity of the remaining portions of this Ordinance. The City Council of the City of Saratoga hereby declares that it would ha~e.~assed this O'rilin~iriCe and each section, subsection, sentence, clause and phrase thereof, irrespective of the fact thai one or more sections, subsections, sentences, clauses or phrases may be held invalid or unconstitutional. SECTION 3.' This Ordinance shall be in full force and effect thirty days after its passage and adoption.
