AN ORDINANCE OF THE CrrY OF SARATOGA ADDING
SECTION 6-15,140 TO THE CITY CODE CONCERNING
OFFENSIVE CONDUCT
The City Council of the City of Saratoga hereby ordains as follows:
SECTION h A new Section 6-15.140 is added to Article 6-15 of the City Code, to
read as follows:
S6-15.140 Offensive conduct
(a) As used in this Section, the term "public place" means any road,
sidewalk, building, park, school, or other space or area in which the City or other
public' agency holds an ownership or leasehold interest, or is otherwise under public
control or maintained at public expense.
(b) It shall be unlawful for any person to urinate or defecate in, upon, or
about any publie place within the City, or to urinate or defecate at any place in
public view, except restroom facilities installed for the purpose of receiving urine or
feces.
(c) Any violation of this Section shall constitute an infraction.
SECTION 2: If any section, subsection, sentence, clause or phrase of this
Ordinance is for any reason held by a court of competent jurisdiction to be invalid or
unconstitutional, such decision shall not affect the validity of the remaining portions
of this Ordinance. The City Council of the City of Saratoga hereby declares that it
would have passed this Ordinance and each section, subsection, sentence, clause and
phrase thereof, irrespective of the fact that one or more sections, subsections,
sentences, clauses or phrases may be held invalid or unconstitutional.
SECTION 3: This Ordinance shall be in full force and effect thirty days after its
passage and adoption.
The above and foregoing Ordinance was regularly introduced and after the
waiting time required by law, was thereafter passed and adopted at a regular adjourned
meeting of the City Council of the City of Saratoga held on the 7th day of
August , 1990, by the following vote:
AYES: Councilmembers Anderson, CleVenger, Kohler, Monia and Mayor Stutzman
NOES: None
ABSENT: None
