HomeMy WebLinkAbout71.87 ORDINANCE NO ~L e7 AN ORDINANCE OF THE CITY OF SARATOGA AMENDING SUBSECTIONS 15-12.100(b), 15-13.100(b) AND 15-14.110(b) AND (d) CONCERNING HEIGHT OF ACCESSORY STRUCTURES The City Council of the City of Saratoga hereby ordains as follows: SECTION h Paragraph (b) of Section 15-12.100 in Article 15-12 of the City Code is amended to read as follows: "(b) No accessory structure shall exceed twelve feet in height; provided, however, the Planning Commission may approve an accessory structure extending up to fifteen feet in height if the Commission finds and determines that: (1) The additional height is necessary in order to establish architectural compatibility with the main structure on the site; and (2) The accessory structure will be compatible with the surrounding neighborhood." SECTION 2: Paragraph (b) of Section 15-13.100 in Article 15-13 of the City Code is amended to read as follows: "(b) No accessory structure shall exceed twelve feet in height; provided, however, the Planning Commission may approve an accessory structure extending up to fifteen feet in height if the Commission finds and determines that: (1) The additional height is necessary in order to establish architectural compatibility with the main structure on the site; and (2) The accessory structure will be compatible with the surrounding neighborhood." SECTION3: Paragraph (b) of Section 15-14.110 in Article 15-14 of the City Code is amended to read as follows: "(b) No structure shah extend to an elevation more than twelve feet above the ,nearest adjacent minor ridge that does not have dense tree cover." Rev. 10/17/90 -1- SECTION 4: 'Paragraph (d) of Section 15-14.100 in Article 15-14 of the City Code is amended to read as follows: "(d) Any accessory structure not limited by Paragraphs (a) or (b) above, shall not exceed twelve feet in height; provided, however, the Planning Commission may approve an accessory structure extending up to fifteen feet in height if the Commission finds and determines that: (1) The additional height is necessary in order to establish architectural compatibility with the main structure on the site; and (2) The accessory structure will be compatible with the surrounding neighborhood." SECTIONS: If any section, subsection, sentence, clause or phrase of this Ordinance is for any reason held by a court of competent jurisdiction to be invalid or unconstitutional, such decision shall not affect the validity of the remaining portions of this Ordinance. The City Council of the City of Saratoga hereby declares that it would have passed this Ordinance and each section, subsection, sentence, clause and phrase thereof, irrespective of the fact that one or more sections, subsections, sentences, clauses or phrases may be held invalid or unconstitutional. SECTION 6: This Ordinance shall be in full force and effect thirty days after its passage and adoption.
