AN OPaINANCE OF THE CITY OF S/~TOGA
AMENDING SECTION 14-40.050 AND SECTION
14-40.060 OF THE CODE OF THE CITY OF
S/~TOGA REPFALING PROVISIONS PERTAINING TO
CONDITIONkL FINkL SUBDIVISION M_APS
The City Council of the City of Saratoga hereby ORDAINS as
follows:
SECTION 1. Section 14-40.050 of the Code of the City of
Saratoga is hereby amended to read as follows:
"(a) The City Council shall at its next available regular
meeting after filing of the final map with the City Clerk,
approve or disapprove the final map. At the time of
approval the Council shall accept or reject any offers of

(b) No map will have any force or effect until unccn

interest in any property described in any offer of dedica-
tion on the final map which is accepted by the Council shall
pass until recordation of said map.
(c) If the final map is not approved by the City Council,
the City Clerk shall return the map to the subdivider or
owner with a written statement setting forth the reasons for
disapproval.
SECTION 2. Section 14-40.060 of the Code of the City of
Saratoga is hereby amended to read as follows:
"(a) Upon approval of a final map by the City Council
~ .... = ........ ~---~ the City Clerk shall sign and affix
the City seal to the Clerk's certificate attached to such
map and shall deliver the map to the City Engineer who shall
cause such map to be filed for record in the office of the
County Recorder in accordance with the Map Act.
(b) ~enever covenants, conditions and restrictions
(CC&Rs), offers of dedication by separate instrument, deeds,
or other documents affecting title and relating to the final
map are to be recorded, all such documents shall be executed
and acknowledged and delivered to the City for recordation
together with.the applicable recording fees, if any, and the
City shall have no obligation to cause the final map to be
delivered for recordation unless and until all of such other
documentation is delivered to the City for sequential
recordation along with said map. The City Engineer shall
cause delivery of all of said recordation to be made to the
County Recorder at the time of delivery to said Recorder of
the final map, and shall instruct the Recorder as to the
sequence and chronology of recordation of said documents.
(c) Within ten day after recordation of the final map, the
subdivider or owner at his own expense shall furnish the
City EngineerSwith one blue line print of the recorded map.
SECTION 3. This Ordinance shall be in full force and effect
thirty days after its passage and adoption.
The above and foregoing Ordinance was regularly introduced
and after the waiting time required by law, was thereafter passed
and adopted at a regular meeting of the City Council of Saratoga
held on the 2nd day of October , 1991, by the
following vote.
