tLW ORDINANCE OF THE CITY OF SARATOSA AMENDING VICIOUS SECTIONS OF

THE ZONIN~ REDUCTIONS OF S~TO3A'S CITY CODE~ CONCEDING THE
INPERVIOUS COVE~E IN THE R-1 ZONE DISTRICT.
~ER~S, the City of Saratoga has recently implemented zoning
amen~ents by Ordinance 71.99; and
wnER~S, the City has applied the aforementioned amendments;
and
W~ER~S, the City has determined the existing regulations
pertaining to Impervious Coverage require further revisions.
NOW, THEREFORE, the City Council of the City of Saratoga
hereby ordains as follows:
ssection 1: Section 15-12.080 is amended to read as follows:
~15-12.0S0 Site Coverage
(a)The maximum coverage in each R-1 district shall be as set
forth in the following table:

(b) In determining the amount of impervious surface in the R-
1-40,000 zoning district,the area of a single driveway
providing vehicle access from the street to the required
enclosed parking spaces on the site and any related
turnaround area for such spaces or required for safety
purposes shall be excluded, and the maximum coverage
shall be as follows:

Seotion 2: If any section, subsection, sentence, clause or
phrase of this Ordinance is for any reason held by a court of
competent jurisdiction to be invalid or unconstitutional, such
decision shall not affect the validity of the remaining portions of
this Ordinance. The City Council of the City of Saratoga hereby
declares that it would have passed this Ordinance and each section,
subsection, clause and phrase thereof, irrespective of the fact
that one of more sections, subsections, sentences, clauses or
phrases may be held invalid or unconstitutional.
Section 3: This Ordinance shall be in full force and effect
thirty (30) days after its passage and adoption.
The above and foregoing Ordinance was regularly introduced and
after the waiting time required by law, was thereafter passed and
adopted at a regular meeting of the City Council of the City of
Saratoga, held on the 16th day of September , 1992, by the
following vote:
AYES: Councilmembers Burger, Kohler, Monia, Tucker and Mayor Anderson
NOES: None
ABSENT: None
