ORDINANCE OF THI~ CITY COUNCIL O1~ THE CITY
OF SARATOGA ADDING ARTICLE 70 TO CHAFFER 4
O1: THE CODE OF THE CITY OF SARATOGA,
KELATING TO HOUSEHOLD SAI.~.S
The City Council of the City of Saratoga hereby ordains as follows:
~ Article 70 is hereby added to Chapter 4 of the Code of the City
of Saratoga to read as follows:
"ARTICLE,70: HOUSEHOLD SAI
Section ~-7~010. Definition.
For the purposes of this Article, the words 'household sale" mean the offering
for sale or sale of, and disphy of personal property to the general public on
premises devoted primarily to residential use. Household sale includes that
class of event usually referred to as garage sale, moving sale, patio sale, yard
sale, lawn sale, ndghborhood s',dc, or nmunage sale. Thc tcnn household sale
is not limited to sales or offerings of household items.
Section 4-7~'T.020. Frequency Restricted.
It is unhwful for the same pe~on or persons to conduct more than two
household sales within the City in any twelve month period. It is unlawful for
more than two household sales to be conducted at the :same lo~ation within
the City in any twelve month period regardless of who conducts the sale. It is
unlawful for any household sale to be conduaed for a greater period of time
than two consecutive wce. kcnds of two days each.
Section 4-7~.030. Conunercial transactions prohibited.
It is unlawful for any person to sell at any household sale any article of
personal property acquired for the purpose of sale.
gection 4-70.040. Sign requirements.
One on-site sign may be used to advertise such a sale, which sign shall be
displayed only at the location of the sale, and only during the days of dates
and hours of such a sale. Such a sign shall not exceed four sq,,are feet in area,
and shall not exceed four feet in height."
SECTION 2. This Ordinance shall be in full force and effect thirty (30)days
after its passage and adoption.
The above and foregoing Ordinance was regularly introduced and a~ter the
waiting time required by law, was thereafter passed and adopted at a regular meeting
of the City Council of Saratoga held on the 7th day of Auqu st , 1996, by the
following vote.
AYES: Councilmembers Burger,. Tucker and Mayor Jacobs
NOES: None
ABSENT: Councilmembers Moran and ~.
