AN ORDINANCE OF THE C~TY OF SARATOGA APPROVING
THE ANNEXATION TO SAID CITY OF CERTAIN INHABITED
TERRITORY .DESIGNATED AS "WESTBROOK ANNEXATION 1972-2"
WHEREAS, pursuant to the provisoions of th~ Annexation Act of 1913,
a special election was duly ordered'and held in the 12th day of December, 1972,
in certain inhabited territory contiguous to the City of Saratoga, designated
as "Westbrook Annexation 1972-2" and.which is hereinafter more particularly
descr'ibed, and
WHEREAS, at said special election the following question was submitted
to the qualified electors residing ijn said territory:
"Shall West~rook 'Annexatign 1972-2 be annexedto and
. incorporated within the' City of Saratoga, ~he pKoperty
therein to be subject toitaxa~ion af~erLsuch annexation
equally with all other property within said City·
of Saratoga?",
and
WHEREAS, it ~ppears from a canvas of the returns of the votes cast at
said special. election that a major~tyof all votes eas[ in said territory on
said question favor annexation u~o~ the terms contained in [he question sub~
mitted, and
WHEREAS, it appears that the;special electionland all proceedings
relating thereto have been conducted strictly in accordance with law,
NOW, THEREFORE, the City Council of the City of Saratoga does hereby
ordain as follows:
Section 1: That the annexation 8f inhabited territory contiguous
to the City of ~aratoga and'designated as "Westbrook
AnnexatiOn 1972-2" be and the same is hereby approved 'upon the terms
contained in the aforesaid ~uestion which was submitted at the'
special election held on th~ 12th day of December, 1972. .Said
territory is more particularly described as follows:
All that certain real .property situat~ in the County of~
Santa Clara, State of California, more particularly described as
follows:
BEGINNING at a point {n the southerly boundary of~.Prospect Road,
said southerly boundary being the.city limit line of the. City of
Saratoga, a municipalcorporatioh, and. the prolognation of the
centerline of Johnson Road,. as said roads are shown on the map of
Tract 1222 and recorded in. Book 46 of Maps, Page 6 and 7, Santa Clara
County Records; THENCE from sai~ Point of Beginning, leaving
City of Saratoga city limit line, north 5° 09' 39" east 20.00
feet to a brass plug in the cen~erline of Prospect Road;
THENCE north 5° 09' 39" east l123.31feet along the centerline
of the above mentioned Johnson Road to a RR spike; THENCE south
86° 57' 50" east 1140.54 feet to a granite monument at the
northeasterly corner of the af0~ementioned Tract 1222, said point
also being the most nqrtherly corner of Tract 1179, Recorded in
Book 44 of Maps, Page 28 and 29~ Santa Clara County Records;
THENCE along the northerly boundary of Tract 1179 south 61° 20' 22"
east 587.42 feet to a point on the centerline of Saratoga Creek
as shown on the map of ,the aforementioned Tract 1179, said point
being south 61° 20' 22" eastl~7..0~ feet fro~ an.irOn pipe; THENCE
along the centerline of said S~ratoga Creek the following bearings
and distances:
SOUTH 35° 33' 23" west-156.53 fe~t;'
THENCE south53° 16' 08' West 188.t0 feet;
THENCE south 31° 16r08" west 175.56 feet;
THENCE south 0° 38' 52" east 264.00 feet;
THENCE south 41° 01' 08" west 287.10 feet to a point in the
centerline of Prospect Road, ~aid ~oint also being on the City
of Saratoga city limit lines;.thence aldng said city limit line ~outh
8° 26' west 20 feet to the southerly boundary of Prospect Road~as
shown on said Tracts No.'s 1222 and 1179; thence along last mentioned
southerly line being in the city limits lina of Sarahoga, north 81°
34' west 80.52' and north 85° 41' west 1172.34' to the point of
beginning,
Section 2: The City Clerk is ~ereby directed to prepare a certified
copy of this Ordinance, giving the date of its passage,
and transmit the same to the Secretary of State of the State of
California for filing.
This Ordinance was regularly ~ntroduced and after the waiting time
required by law was thereafter passed and adopted this ~ day of
Uadd~'~ 1973j~ by the following vote:
