AN ORDINANCE AMENDING ORDINANCE-NS 60, THE
SUBDIVISION ORDINANCE OF THE CITY OF SARATOGA,
RELATING TO POWER TO ACCEPT OR REJECT DEDICATIONS
AND EXECUTE IMPROVEMENT AGREEMENTS ON SITE
APPROVAL, FOUR OR LESS LOTS, AND CORRECTING
CLERICAL ERROR IN SECTION 7.1 THEREOF
The City Council of the City. of Saratoga does hereby
ordain as follows:
Section 1: The last sentence of Section 7.1 of
Ordinance NS 60, the Subdivision Ordinance of the the
City of Saratoga, is hereby amended to read as follows:
Neither final map nor site approval shall be
granted for any lot, site or subdivision which
is not in conformity with the zoning ordinance
of the City of Saratoga, nor which has been or
is created in violation of any such zoning
ordinance, nor which is not consistent with
the general plan or any applicable specific
plan, nor for any intended use which would not
be in conformity with the district regulations
in which said lot, site or subdivision lies
at the time of final approval.
Section 2: There is hereby added to Section 24.2
of Ordinance NS 60 ofthe City of Saratoga, which section
is Contained in Article 3 thereof, and which s~tion is
captioned "Action on Parcel Map", the following paragraph:
In acting on final site approval, or any time
thereafter, the Planning Commission shall have
the power and authority on behalf of the City
to accept or reject offers of dedication as are
contained on the parcel map, and said Planning
Commission is hereby empowered on behalf of the
City, through its Chairman or Vice-Chairman, to
execute such improvement agreement or agreements
as are required pursuant to Section 23.3 hereof.
Section 3: If any section, subsection, sentence,
clause or phrase of this ordinance is for any reason held
by a court of competent jurisdiction to be invalid, such
decision shall not affect the validity of the remaining
portions of this ordinance. The City Council of the City
of Saratoga hereb declares that it would have passed this
ordinance and eac~

section, subsection, sentence,
and phrase thereof, irrespective of the fact that any one
or more sections, subsections, sentences, clauses or phrases
be held invalid or unconstitutional.

SectiOn 4: This Ordinance will take effect and be'
in fulT Eorce and effect thirty (30) days after its
passage and adoption.
This Ordinance was regularly. introduced and after
the waiting time required by law was thereafter passed
and adopted at a regular meeting of the City Council of
the City of Saratoga held on the 2lst day of April ,
1976 by the following vote:
AYES: Councilmen Bridges, Kraus, Brigham, Corr, and Matteoni
