AN ORDINANCE OF THE' CITY OF SARATOGA
TEMPORARILY AMENDING ORDINANCE' NS-60,
THE SUBDIVISION ORDINANCE OF THE CITY
OF SARATOGA, BY PROVIDING THAT THE
PLANNING COMMISSIONsSHALL HEREAFTER BE
THE ADVISORY AGENCY UNDER ARTICLE THREE
OF SAID ORDINANCE.
The City Council df the-City of Saratoga does
hereby ordain as follows:
Se6tion 1: Section 2.3 6f the Saratoga ~ubdivlsion
Ordinance NS-60 establishes-a Land Developmen.t Committee consmst~,.
lhg =of ~the Director of Planning, the Director of Public works,
and one member of the Planningi CommisSion. Pursuant to, Section
2.1 of Ordinance NS-60, the Land Development Committee ms de~ig=
nated as the Advisory Agency having the authority to approve sub-
di'visions of less than five lots, building site approval of
single undivided lots or parcels, and onher subdivisions processed
under Article Three'of Ordinanbe NS-60. It is the intention of
the City Council. of the City of Saratoga to temporarily transfer
all of the responsibilities and functmons now per-formed by the'
Land Development Committee to the Planning Commission of the
City of Saratoga in order to'determine whether such responsibil-
ities and functions should be performed by the Planning Commission
on a.permanent basis.
Secti6n 2: For a period of n~ne, months from the.~f-.
fective'date of this ordinance, the Planning Commission of the
City of Saratoga shall be de'signated as the-single and ODly
Advisory Agency under Section 2.1 of Ordi. nance'NS~6~,-with author-
ity to exercise powers as set forth in"Section 2.2 of Ordinance
-NS-60~ and all responsibilities and functioDs now performed by
the Land Development COmmitte~{.~ ~ciUd.i~g, but 'n6t limited to,."
the revlew of subdivision maps an~ ~pplication~ .fQ~';b~i'iding-site
approval processed under Article Three of.~said.ordinance, and".the
authority to determine complia~j or to waive or modify any condi~
tlons as may be set forth in a t~native mad or'b~ilding site approv-
al~ shall h~reafter be ~erformed by the Planning Commission of
the City of Saratoga. . ~, ~ .~.
Sectio~ 3: If any s&ctio~, subseCtion, sentence., clause
or phrase of this ordinance is for any reason'held, by ~ Court of
competent jurisdiction to be invalid, such decision 'shall not.
affect the validity of the remaining portions of. this ordinance.
The City Council of the City of Saratoga hereb~ declares that it
would'have passed this 6rdinan~e, and each Sec'tion, subsection-;
sentence, clause or phrase hereof, irrespect'ive of the fact .that
any one or more sections, subs~ctions, sentences, clauses or
phrases may be held invalid or unconstitutional. '
Section 4: This ordinance shall be in fullforce and
effect thirty days from and ~fter the'date of its passage and
adoption..
