HomeMy WebLinkAboutNS 60.12 ORDINANCE NO. N'$ 60.12 AN ORDINANCE OF THE CITY OF SARATOGA AMENDING ORDINANCE NO. NS-60.11 OF THE CITY OF SARATOGA TO EXTEND THE TERM OF SAID ORDINANCE FROM NINE. MONTHS TO F~TEEN~MONTHS The City Council of the City of Saratoga does hereby ordain as follows: SECTION 1: Section 2 of Ordinance No. NS-60.11 entitled, "An Ordinance of the City of Saratoga Temporarily Amending Ordinance NS-60, the Subdivision Ordinance of the City of Saratoga, by Providing that the Planning Commission Shall Hereafter be the Advisory Agency under Article Three of Said Ordinance", is hereby amended to read as follows: "Section 2: For a period of fifteen (15) months from the effective date of this Ordinance No. NS-60.11, the Planning Com- mission of the City of Saratoga shall be designated as the single and only Advisory Agency under Section 2.1 of Ordinance NS-60, with authority to exercise powers as set forth in Section 2.2 of Ordinance NS-60, and all responsibilities.and functions now performed by the Land Development Committee, including, but not limited to, the review of subdivision maps and applications for building site approval processed under Article Three of said ordinance, and the authority to determine compliance or to waive or modify any conditions as may be set forth in a tentative map or building site approval, shall hereafter be performed by the Planning Commission of the City of Saratoga." SECTION 2: If any section, subsection, sentence, clause or phrase of this ordinance is for any reason held by a court of competent jurisdiction to be invalid, such decision shall not affect the validity of the remaining portions of this ordinance. The City Council of the City of Saratoga hereby declares that it would have passed this ordinance, and each section, subsection, sentence, clause or phrase hereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses or phrases may be held invalid or unconstitutional. -1- SECTION 3: This ordinance shall be in full force and effect thirty (30) days f~om and after the date of its passage and adoption.
