HomeMy WebLinkAboutNS-3 E-6 ORDINANCE NS-3 E-6 AN INTERIM EMERGENCY ZONING ORDINANCE PROHIBITING ALL USES OF LANDS IN A C-S ZONING DISTRICT WITHOUT USE PERMIT ~EREAS, the Planning Department, Planning Commission, and City Council of the City of Saratoga is considering and studying, and intends to further conduct studies within a reasonable timer on. new zoning regulations and clas- sifications of all properties in the City of Saratoga presently within a C-S zoning district, and the zoning regulations for C-S zoning districts, and un- less the hereinafter set forth uses are prohibited, except with a use permit, such unregulated uses may be in conflict with the contemplated zoning proposal and proposals, and it is necessary to adopt the hereinafter set forth regula- tions to protect the public safety, health and welfare, in that without such regulation, certain coneemplated uses within C-S areas of this City would be in conflict with proposed amendments to the zoning ordinance, NOW, TI~REFORE, as an interim urgency and emergency measure, pursuant to Government Code 65858 of the State of California, the City Council of the City of Saratoga does hereby ordain as follows: SE~.TION ~: No new use or occupation of any land, building or structure shall be made in any C-S zone in the City of Saratoga, with- out first obtaining a use permit therefore under the provisions of Article 16 of Ordinance NS-3 of the City of Saratoga. SECTIO~ 2: It is intended hereby that all future uses in a C-S Commercial Service District, otherwise classified as permitted uses unde~ the provisions of Section 7.2(c) of Ordinance NS~3, as such uses may have been added to under the provisions of Section 14.1 of said zoninR ordinance, are hereby prohibited without the prior obtaining of a use permit therefore. .SEC~.~O~..3: This ordinance is hereby declared to be an urgency and emer- gency measure adopted to protect the public safety, health and welfare, and shall be effective immediately upon its passage. All of the preambles of this ordinance are hereby referred to and incorporated into this Section by reference, and shall constitute a statement of the facts constitut- ing such urgency. This ordinance shall remain in full force and effect for a period of ninety (90) days from the date of adoption hereof, or until the sooner adoption of permanent amendments to Ordlnance NS-3 concerning the regulations governing or the classification of properties in, a C-S zone, which permanent ordinance shall, however, in order to terminate the effect of this urgency ordinance, specifically refer to the same as being superseded and repealed thereby, and subject further, however, to the right of the City Council pur- suant to Government Code Section 65858 of the State of California, to extend the within interim ordinance. SE~T.I.O~..4: If any section, subsection, sentence, clause or phrase of this ordinance is for any reason held by a court of competent jurisdiction to be invalid, such decision shall not affect the validity of the remafning provisions of this ordinance. The City Council of the City of Saratoga hereby declares that it w~uld have passed this ordinance and each section, subsection, sentence~ clause and phrase thereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses or phrases be held invalid or unconstitutional. This ordinance was inroduced as an urgency and emergency measure, and was thereafter passed and adopted at a regular meeting of the City Council of the City of Saratoga, on the 5th day of October , 1966, by the following vote, which vote constitutes no less than a 4/5 vote of the entire City Council of the City of Saratoga: AYES: Robbins, Hartman, Burry, Tyler NOES: None ABSENT/!
