AN ORDINANCE AMENDING ORDINANCE NS-3~
THE ZONING ORDINANCE OF THE CITY OF
SARATOGA, BY ADDING CERTAIN PROVISIONS
TO SECTION 16 IN RELATION TO CONDITIONAL
USES.
The City Council of the City of Saratoga does hereby ordain
as follows:
Section 1: Section 16.1-1 iS hereby added to Article 16 of
Ordinance NS-3 of the City 'of Saratoga, to read
as follows:
Section 16.1-1: STATUS OF CONDITIONAL USES
A conditional use is not a
matter of right, and the planning
commissian may deny a use permit for a use listed
as conditional use if it finds that reasonable
regulations would still not prevent the use from
adversely affecting existing uses in the imme-
diate neighborhood, or would not prevent the use
from adversely affecting surrounding property
and itssinhabitants or its anticipated permitted
use or uses.
A conditional use may be permitted
by a use permit to have different
site area, density, structure height, distances
between structures, site coverage, front, side
and rear yard minimums, off-street parking re-
quirements, other than as listed under the spe-
cific regulations for unconditional permitted
uses in the zoning district in which it lies,
but only if such changes from the specific regu-
lations are clearly set forth in Ordinance NS.3
in relation to any such conditional use.
Section 2: If any section, subsection, sentence, clause or
phrase of this ordinance iS for any reason held
by a court of competent jurisdiction to be invalid, such decisions shall
not affect the validity of the remaining provisions of this ordinance.
The City Council of Saratoga hereby declares that it would have passed
this ordinance and each section, subsection, sentence, clause and phrase
thereof, irrespective of the fact that any one or more sections, sub-
sections, sentences, clauses or phrases be held invalid or unconstitu-
tional.
Section 3: This ordinance shall be operative and take effect
on and after thirty (30) days from the date of
its passage and adoption.

The above and foregoing ordinance, after public hearing held
thereon by the Planning Commission of the C~ty of Saratoga on the 24th
day of October, 1966, was thereafter introduced at a public hearing
held thereon by the City council thereof on the 16th day of November,
1966, and it was thereafter passed and adopted at a regular meeting
of the City Council of the City of Saratoga held on the 1st day'of
February, 1967, by the following'vote:
