AN ORDINANCE OF THE CITY OF SARATOGA
AMNDING ORDINANCE NS-3, THE ZONING
ORDINANCE, BY AMENDING SECTION 18.4
BY ADDING REQUIREMENTS FOR WRITTEN
NOTICE OF PUBLIC HEARINGS ON ZONING
TO CONTIGUOUS OWNERS.
The City COuncil'of the City o~'Sara~6~a dOeS h~eby
ordain as follows:
Section 1: The following set forth sentence is hereby
added to Section 18.4 of Article 18 of
Ordinance NS-3, to read as follows:
In addition to publication, when a public
hearing is to be held on an application or
a proposal for a change in a district~oundb~,~,
notice of a public hearing shall be given no~
less than 5 days nor more than 30 days prior
to the date of the hearing by mailing, postage
prepaid, a notice of the time and place of the
hearing to all persons whose names appear on
the latest adopted t~x roll of Santa Clara
County as owning property within 500 feet
of the boundaries of the area occupied or to
be occupied~by the-use which is the subject
of the hearing.
The intention of the foregoing amendment is to re-instate
the requirement of the mailing of notices on public
hearings before the Planning Commission and City Council on
changes of zoning, which requirement was heretofore eliminated
by Section 7 of Ordinance NS-3-1.
Section 2: If any section, subsection, sentence, clause
or phrase of this ordinance is for any reason
held by a court of competent jurisdiction to be invalid,
such decision shall not. affect the validity of the remaining
provisions of this ordinance. The City Council of the City of
SaratOga hereby declares that it would have passed this ordinance
and each section, subsection, sentence, clause and phrase thereof,
irrespective of the fact that any one or more sections, sub-
sections, sentences, clauses or phrases be held invalid or
unconstitutional.

This ordinance was regularly introduced and after the
waiting time required by law was thereafter passed and adopted
