HomeMy WebLinkAboutNS-3.23 ORDINANCE NS-3.23 AN ORDINANCE AMENDING ORDINANCE NS-3, THE ZONING ORDINANCE OF THE CITY OF SARATOGA, BY AMENDING SECTION 18.11 THEREOF RELATING TO TIME LIMIT EXTENSIONS UNDER CONDITIONAL RECLASSIFICATION. The City council of the city of Saratoga does hereby ordain as follows: Section li The last paragraph of Section 18.11'of' Ordinance NS-3' of the City of Saratoga, which last paragraph was added by Section 5 of Ordinance.NS-3.6, is hereby amended to read as follows: When~verba condition Of reclassification under this Section imposes a time limit within which ~ a particular use shall be established, or con- struction of a particular structure or structures shall be commenced, or completed, or both, the City Council shall have power, in cases of undue hardship, to grant a reasonable extension of such time limit condition or conditions provided that an application has been made to the City Planning Commission for such extension prior to the expira- tion of the original time limit or limits in -- question, and thereafter the Planning Commission has examined the applications and the reasons therefor, and made a recommendation thereon to the Council. The City Council, a~.,~er recommenda- tion b~ the City Planning Commission, shall have additional power to modify, waive, or with the consent of the owner of the property to substitute, conditions of reclassification at any time prior to the time of automatic reversion of the ~istrict Classification which occurs on failure to comply with the conditions of approval. The powers of the City Council to extend time limits, or to modify, waive, or change conditions, are matters of grace only. Section 2: If any section, subsection, sentence, clause or phrase of this ordinance is for any reason held by a court of competent jurisdiction to be invalid, such decision shall no~ affect the validity of the remaining portions of this ordinance. The City Council of the City of Saratoga,hereby declares that it would have passed this ordinance and each section, subsection, sentence, clause and phrase thereof, ,..irrespective of the fact that any one or more sections, subsec~ 'tions, sentences, clauses or phrases be held invalid or unconsti- ~'~ tutional.
