AN ORDINANCE OF TH~ CITY OF SARATOGA AMM~)ING
SECTION 18.13 OF NS-3 BY DEIi'TING R-1-40,000
A~D ADDING HC-RD FOR ALL LANDS ANNEXED TO TH~
CITY OF SARATOGA
WH~, there are certain areas under Saratoga's control known
as Urban Service Areas, which, if annexed to the City, would create an
inconsistency between the zoning and General Plan under the 1974 Zoning
Conformance Law, and
WHEREAS, it is the desire of the City to change the zoning
classification of lands annexed to the City in order to maintain consistency,
and
NOW, THeREFORe, the City Council of the City of Saratoga does
hereby ordain as follows:
Section 1: Section 18.13 of Ordinance NS-3, which section is
captioned "Annexed and Unzoned Territory', is hereby 8]nended to read:
"All territory which is hereafter annexed to the City and desig-
nated slope conservation on the 1974 General Plan shall automatically be
classified HC-RD. Territory which becomes unzoned through abandor~nent of
a public street, railroad right-of-way or public utility right-of-way, shall
automatically be classified in the R-1-40,000 district."
THE ABOVE AND FOREGOING ORDINANCE, after hearing held thereon
before the Planning C~m~ssion of this City on the 9th day of August, was
thereafter passed and adopted at a regular meeting of said City Council held
on the 4th day of __October , 1978, by the following vote:
AYES: Councilmen Kalb, Matteoni, Callon, Kraus & Corr
